KONOWITZ SCTM# 1000-118-4-11 DKR Shores, Inc. on behalf of PAUL M. KONOWITZ requests a Wetland Permit to replace existing upper retaining wall with new 150' upper retaining wall using vinyl sheathing in-place; construct two (2) 10' returns using vinyl sheathing; reconstruct existing 4'x26' stairs and platforms in-place; reconstruct existing 3'x5' platform, 3'x10' steps and 20'x24' deck in-place; backfill area with +/-35 cubic yards clean fill; add jute-fabric and re-vegetate any disturbed areas with Cape American beach grass. Located: 8425 Nassau Point Road, Cutchogue. SCTM# 118-4-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are INCONSISTENT with the Policy Standards 6.3 (below) and therefore are INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The stairs and deck were constructed without Board of Trustee review or a Wetlands Permit. Further, pursuant to Chapter 275 Wetlands and Shorelines, the proposal to replace the 480 square foot unpermitted deck/platform is not a permissible action pursuant to 275-11 Construction and operation standards( below). The deck/platform is located seaward of the top of bluff. 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: LJ Platforms. [Amended 10-11-2005 by L.L. No. 17-2005, 10-9-2012 by L.L. No. 12-2012] [b) Platforms may not exceed 200 square feet and must be landward of the top of bluff The 20'x24' deck structure is also located within the FEMA Flood Zone VE (See Figure 1.) and does not meet or further Policy 4:minimize the loss of life, structures, and natural resources from flooding and erosion. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
