GALLAGHER SCTM# 1000-51-1-7 I KEVIN J. GALLAGHER requests an Administrative Permit to remove four damaged or dying trees on the seaward side of the property; reconstruct existing decorative varying in height 2'-4' garden retaining walls using natural river rock; install a +/-4' in diameter decorative fish pond on the eastern side of property; install +/-4'wide flagstone walkways with gravel underlays; install a +/-15' in diameter pervious flagstone patio with gravel underlays on the eastern side of property; and install landscaping using natural vegetation along property lines. Located: 17975 Soundview Avenue, Southold. SCTM#51-1-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the Policy Standards and therefore are CONSISTENT with the LWRP provided that: 1. The use of native, salt, and drought tolerant plants are required in the area closer to the top of bluff due to salt and wind exposure. Note, the species crape myrtle is not salt tolerant and should be replaced. 2. Establish the planted vegetation as a non-turf buffer landward of the top-of-bluff. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in I' making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing:both supporting and non- suunorting facts. Category of Town of Southold agency action(check appropriate'response): (a) Action undertaken directly by Town agency(e.g.capital ❑ construction,planning activity,agency regulation,land transaction) (b) Financial assistance(e.g.grant,loan,subsidy) (c) Permit,approval,license,certification: APR I M44 ;4 Nature and extent of action: � y Project Description: I am currently proposing a limited, residential landscaping project that includes aspects impacting the first 100 feet inland of the apparent high water mark and bluff edge as designated in my recently completed survey (copy provided). The aim of the project is to improve the aesthetics of the property while avoiding any negative ecological impact and benefiting the erosion resistance of the area. I have had a landscaping plan prepared by a professional landscape designer(copy provided)and all proposed tree removals assessed by a licensed arborist who can provide a verbal assessment on request. All proposed tree removals seek to replace damaged, diseased and invasive (Norway Maple)trees with an equal or greater number of healthy, low impact and where feasible, native specimens. As part of the project we plan to re-build an existing decorative freestanding rock wall that was part of the property when purchased, but in disrepair. Minor soil fill activities(5-10 cubic yards)will be needed in connection with the rebuilding of the rock walls and all work will be accomplished manually. We have also sought to mind the local design aesthetic in the choice of species, colors and textures as part of the design. Thank you for your consideration. I hope you like the proposed activities. Specifics: Tree Removal—Please see attached(hand-drawn) rendering for location of trees identified for removal. With respect to the specific trees: • Tree#1: Tree has a rotten central core with a small bush (a California Privet) growing out of the core. In addition,the tree has girdling roots. Given proximity to the house and the historic wall it is considered a danger. • Tree#2: Tree is growing into and undermining historic brick wall (original from original manor house). Roots are actually growing under wall and destabilizing. • Tree#3: Tree has significant damage to crown and rotting in core. Again there is significant damage to the trunk with small plants and fungi growing out of the damaged areas. Crown damage is significant. The tree has a number of girdling roots. • Tree#4: Tree is covered in suckers sapping vitality. No significant foliage growth in season. A number of girdling roots and trunk damage. Walls—We are proposing retaining walls of natural river rock(round neutral colored stones). This is a repair of the formerly existing walls that had fallen into significant disrepair. The walls will terrace the hillside and allow for planting beds. The wall height will be variable, but on average 2-4 feet. The walls will NOT exceed the natural height of the hillside. Fish Pond—We are proposing the installation of a decorative fish pond with natural filtration system. The pond will be approximately 3-4 feet(though exact depth will vary according to location within the pond). The pond will be planted with native lilies, irises and bog plants. The pond will incorporate a flexible plastic liner. Installation of Pervious Walkways—We are looking to install flagstone walkways with gravel underlays as detailed in the landscape plans. No concrete will be incorporate. Approximately 3- 4 feet wide (width will vary with natural dimensions of the flagstone, but will not exceed 4 feet) Installation of Pervious Patio—We are proposing to install a flagstone patio with gravel underlays as detailed in the landscape plans. No concrete will be incorporated. Approximately 15 feet in diameter(please note approximate dimensions per submitted landscape plan).
