Powers, Esq. on behalf of RICHARD BLICKMAN request a Wetland Permit for the as- built concrete seawall which is ±180 linear feet in length and ranges in width from ±0.75 to ±4.5 linear feet; install capping along the top of the eastern ±105' section of the seawall; re-vegetate a minimum area of 80sq.ft. with native wetland vegetation to be located seaward of the central portion of the existing seawall; re-vegetate 100sq.ft. of an upland area located landward of the southwestern portion of the existing seawall using native species; re-vegetate 100sq.ft. of an upland planting area located landward of the northeastern portion of existing seawall using native species; and re-vegetate 100sq.ft. of upland planting area located landward of the central portion of the existing seawall. SCTM#23-1-5 It is my recommendation that the proposed actions to permit an "as built" concrete seawall which is ±180 linear feet in length and ranges in width from ±0.75 to ±4.5 linear feet and install capping along the top of the eastern ±105' section of the seawall are INCONSISTENT with LWRP Policy 6, specifically 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built concrete seawall was built without the benefit of Board of Trustee review and a Chapter 275 Wetlands Permit. I /i Engineering Surveying anel �Ctl"ZC�S£"fl�)£',F�7 C'�1Z1£'CIZL?E', P Request for Town of Southold Wetland Permit 15345 Main Road Hamlet of East Marion,Town of Southold Suffolk County,New York Suffolk County Tax Map No.: District 1000—Section 023.00—Block 01.00—Lot No.005.000 Town of Southold Board of Trustees Wetland Permit Application Form Attachment Project Description, Purpose and Statement of Effect Due to damage inflicted by coastal storms, portions of a concrete block seawall(construction date unknown)located along the southern shoreline of Dam Pond at the above-referenced property(the "subject property")were compromised, resulting in erosion to upland areas of the site. Accordingly, in 2012,a contractor hired by the applicant installed a new seawall within and adjacent to the footprint of the original seawall, in order to protect the subject property from further erosion. The replacement seawall is 180±linear-feet in length and ranges in width from 0.75±-to-4.5±linear-feet.As the contractor failed to obtain a Town of Southold Wetland Permit for the new seawall,the applicant is seeking to legalize the new seawall by securing the required permit from the Board of Trustees. As the new seawall was also constructed without the benefit of a New York State Department of Environmental Conservation(NYSDEC)Tidal Wetlands Permit,the applicant voluntarily initiated negotiations with the NYSDEC and has entered into an Order on Consent agreement with that agency in connection with NYSDEC Notice of Violation No. 13AF57. Pursuant to the Order on Consent agreement, the seawall may remain as built,and capping may be installed along the top of the eastern 105±-foot section of the seawall. Furthermore, as detailed on the Wetland Restoration Plan,a minimum of 80- square-feet of native wetland vegetation and 300-square-feet of native upland vegetation must be installed seaward and landward of the seawall. More specifically,details of the proposed planting areas are as follows: ➢ Wetland Planting Area-80 square-feet(4 feet x 20 feet):to be located seaward of the central portion of the existing seawall. ➢ Upland Planting Area No. 1-100 square-feet(irregularly shaped):to be located landward of the southwestern portion of the existing seawall. ➢ Upland Planting Area No.2-100 square-feet(5 feet x 20 feet):to be located landward of the northeastern portion of the existing seawall. ➢ Upland Planting Area No.3-100 square-feet(5 feet x 20 feet):to be located landward of the central portion of the existing seawall. As further detailed on the Wetland Restoration Plan,smooth cord rass(S artina altenifloro)plants would be installed at 1-foot centers within the 80-square-foot wetland planting area. The proposed activities would not result in the loss of,or significant disturbance to,wetland areas,and no significant adverse impacts to wetlands or tidal waters of the Town are anticipated. The ground disturbance within the wetland area would be temporary and limited to an 80-square-foot area during the installation of the NYSDEC-required wetland plantings.
