MARK BUSHELL requests a Transfer of Wetland Permit#3746 from Stephen Matteini to Mark Bushell, as issued
on June 22, 1989, and Amended on June 24, 2009; for an Amendment to Wetland Permit#3746 and for a
Coastal Erosion Permit to excavate the landward side of existing 124' long bulkhead and two 10' long returns to
install new vinyl sheathing, piles, and deadmen; new tie-rods will be connected to new 10"x20' long piling installed
adjacent to existing facepiles. Located: 1060 Willow Terrace Lane, Orient. SCTM#26-2-22
It is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6.3(below)and
therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
The bulkhead structure described was not constructed pursuant Board of Trustee review or a
Chapter 275 Wetland Permit.
In 2004 the Board of Trustees issued a Wetlands Permit 5890 for a construction of a new residence and
driveway that included the condition that a 10' non-turf buffer be installed landward of the bulkhead. It is
recommended that the Board requires that the existing vegetation be retained to the greatest extent
practical. Further, it is recommended that the 15' buffer proposed in this action be designed to achieve
plant density to pre-construction conditions.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a.determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form.should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated. as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold To—MM).
3: If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and_non-
supportink facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions,it shall not be undertaken.

held on Wednesday, June 24, 2009:
RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a
Transfer of Permit#3746 from Robert Keith to Stephen Matteini, as issued.on June 22,
1989, and
BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVE
the Amendment to Wetland Permit#3746 to install 4'wide terrace-box steps to provide
access from lawn area to undeveloped area landward of the existing bulkhead, and to
maintain the existing bulkhead by installing,additional walers, and as depicted on the
site plan prepared by Proper-T Permit Services, last dated June 3, 2009, and received
on.June 4, 2009 and bulkhead plan prepared by Costello Marine Contracting Corp.,
received on June 4, 2009.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.
