MEMORANDUM To: John BredemeY er President Town of Southold Board of Trustees From: Mark Terry, p er Principal Planner LWRP Coordinator Date: June 16, 2014 Re: Proposed Wetland Permit for JAY P. & KAREN QUARTARARO SCTM# 1000-111-14-27.1 Located: 4294 Wunneweta Road, Cutchogue. En-Consultants on behalf of JAY P. & KAREN QUARTARARO requests a Wetland Permit to remove and replace in-place +/-182' of timber bulkhead forming boat basin and +/-33' of timber bulkhead outside boat basin with vinyl bulkhead; remove and backfill (2) existing dilapidated step- down platforms and bulkhead on seaward side of platforms to be raised to same elevation as adjoining walls; remove and replace in-place +/-27'timber jetty with low-sill vinyl jetty (+/-24"-lower than existing). The above actions are EXEMPT from LWRP Coastal Consistency Review. Further, it is my recommendation that the proposed actions to dredge up to 10' off boat basin bulk heading and east side of jetty to a maximum depth of-36"ALW and use approximately 75 cubic yards spoil as backfill together with approximately 25 cubic yards of clean sand/loam to be trucked in from an approved upland source; install a 3'x14' hinged ramp, and 5'x24'floating dock, and 4'x52' wood boardwalk landward of bulkhead in northeast corner of boat basin; and provide water and electricity to dock are CONSISTENT with the Policy Standards and therefore are CONSISTENT with the LWRP. The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed actions. Cc: Lori Hulse, Assistant Town Attorney T.6wn of Southold LWRP CONSISTENCY ASSESSMENT FORM A. INSTRUCTIONS 1. A II applicants for perm its' including Tow n of Southold agencies, shall com plete this C C A F for proposed actions that are subject to the Town of Southold W aterfront Consistency Review Law . Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net), the Board of Trustees Offic ocal libraries and the Town Clerk's office. ❑ B. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ❑Yes ❑ No ® Not Applicable Pursuant to Town Code§268-5("Review of Actions")and the corresponding definitions of"action"and"minor action"by§286-3("Definitions"),the proposed project, i.e.,maintenance of a historically existing boat basin through the in-place replacement of the bulkheading that forms the basin and the jetty that both maintains the shoreline and vegetated wetlands on the west side of the boat basin and prevents the in-filling of the basin, meets the following definitions of minor action and should thus be determined to be exempt from waterfront consistency review pursuant to Chapter 268:"B. Replacement, rehabilitation or reconstruction of a structure or facility,in kind,on the same site(in place)...except for structures in areas designated by the Coastal Erosion Hazard Area(CEHA)law where structures may not be replaced, rehabilitated,or reconstructed without a permit and shoreline erosion control structures...;"and"GG. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The proposed ramp and float will be constructed with untreated decking materials,as required by Chapter 275. The proposed incidental dredging within 10'of the bulkheading and east side of the jetty will not adversely impact water quality because the spoil will consist primarily of sandy, upland soils lost to the basin through the aging bulkhead, and the effects of turbidity will be ephemeral, localized, and contained in the marina basin with a silt curtain deployed across the mouth of the basin. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY FORM Addendum for Jay&Karen Quartararo 4294 Wunneweto Road, Cutchogue SCTM#1000-111-14-27.1 Policy 6. The project seeks to maintain the function and use of a historically existing boat basin through a)the in- place replacement of the bulkheading that forms the basin and the jetty that both maintains the shoreline and vegetated wetlands on the west side of the boat basin and prevents the in-filling of the basin; b) incidental dredging within 10 feet of the bulkheading and east side of the jetty to recover lost upland soils and maintain navigable water depths;and c) installation of a ramp and floating dock inside the basin. Although the in-place replacement of the bulkheading and jetty should be deemed exempt from waterfront consistency review as described in connection with Policy 4 above, the project in its entirety is nonetheless consistent with Policy 4 and Policy 6. Specifically, the adjacent upland has been improved with and supported and protected from flooding and erosion by the boat basin bulkheading since at least 1960,and the jetty that stabilizes the adjacent vegetated marsh has been in place since prior to 1977. Without maintaining these structures, the upland soils adjacent to the boat basin would erode into the basin, causing it to lose its form, function, and use; and the vegetated marsh adjacent to the west side of the jetty would likely be lost to erosion. Thus, it would be beneficial to the adjacent ecosystem for the historically existing conditions to be maintained with the additional benefits of the existing chemically treated sheathing being replaced with untreated vinyl sheathing and the height of the jetty being lowered by 2 feet to an elevation just below average high water. Further, the spoil from the proposed incidental dredging, which is intended to restore sufficient, navigable water depths along the bulkhead, will consist primarily of sandy, upland soils lost to the basin through the aging bulkhead; the effects of turbidity associated with the dredging will be ephemeral, localized, and contained in the marina basin with a silt curtain deployed across the mouth of the basin during construction and dredging; and although the dredging will temporarily disturb the bottom by physically removing shoaled sand and silt, the surrounding habitat will not be permanently impacted or otherwise significantly adversely affected. And the proposed ramp and float will be constructed with untreated decking and will be removed seasonally. The project will conform in all ways to the rules and regulations of the Town Wetlands Law,Chapter 275,and the New York State Tidal Wetlands Act,Article 25. See attached. See LWRP Section III - Policies; Pages 38 through 46 for evaluation criteria. ® Yes ❑ No❑ Not Applicable Insofar as Policy 9 is applicable, the project is consistent with Policy 9 because the proposed maintenance of the existing structures and placement of a new floating dock inside the basin will in no way impede or preclude public access to the adjacent waterway;and maintenance and rehabilitation of the boat basin will encourage recreational use of coastal waters and public lands by the subject property owners and their guests.
