USE OF RIGHT OF WAY. The right of way shall be used for pedestrian passage and use of the beach area. Use may be by Permitted Parties, their guest and invitees, but not tenants of The Chateau. A Permitted Party is a person who is a lineal descendant of Frederick A. Ross, including by adoption, or a person who is married to or a widow or widower of a lineal descendant of Frederick A. Ross. A trust whose beneficiaries are Permitted Parties or an entity which is wholly owned by Permitted Parties shall be deemed a Permitted Party. 3. NO OBSTRUCTION. RGRC and ROSS agree and covenant that they will neither obstruct said right of way nor interfere with the use of the right of way by the other, nor prevent ingress and egress by persons, animals, or vehicles over the right of way. 4. TERMINATION OF 1994 RIGHT OF WAY. The parties hereby agree that the 1994 Right of Way is terminated and superceded by this Agreement. 5. SUCCESSORS. This agreement will run with the land, and is binding upon and inures to the benefit of the parties, their heirs, successors and assigns, except as specifically limited herein. Reference herein to RGRC shall include their heirs, successors and assign who are Permitted Parties. 6. TERMINATION OF RIGHT OF WAY. This right of way agreement shall terminate upon a conveyance of the Chateau by RGRC to a person who is not a Permitted Party. A conveyance of a partial interest in the Chateau to a person who is not a Permitted Party will terminate the Agreement only as to that party. A re -conveyance of such interest back to a Permitted Party shall restore this agreement as to such Permitted Party. 7. MISCELLANEOUS. This agreement constitutes the entire agreement between the parties, and same may be modified only in writing. The parties agree that this agreement shall be construed under the laws of the State of New York, and that in any action hereunder they waive trial by jury. After the permitted work was completed pursuant to the approved plans and issued a Certificate of Compliance earlier this year, it was brought to my attention that a right-of-way which provides the westerly adjoining property owners with access to and use of the beach on the subject property was not depicted on the land survey that was submitted with our application and used as the basis of the approved design plan. As a result, the stone was inadvertently designed to be placed within the boundaries of this right-of-way, which is now depicted on the enclosed survey prepared by Nathan Taft Corwin III Land Surveyor, dated May 29, 2014. Therefore, to remedy this situation, we must ask the Board to permit the reconfiguration of the most westerly portion of the now existing stone armor and associated sand backfill such that that no stone or backfill will be located within the boundaries of the right-of-way over the subject property, as depicted on the enclosed project plan prepared by En -Consultants, dated November 6, 2014. Although it would seem logical to modify the existing permit, I do not know whether you will be able to do so since a Certificate of Compliance for the originally permitted work has already been issued. Therefore, I have enclosed a fully completed application for a new Wetlands Permit along with recent site photographs and the new survey referenced above. The project sought to restore the pre -storm site conditions and introduce stone armor along the toe of and atop a buried steel bulkhead to a) increase the potential for the renourishment and plantings to become successfully established; and b) once established, to provide a reasonable measure of protection for the restored berm during a severe storm event. The project was consistent with Policy 4 because vegetative resource enhancement was the primary component of the design and the hard stabilization component was included for the protection and enhancement of the vegetation where prior efforts to preserve that vegetation had proven to be inadequate. Given the large fetch along this stretch of shoreline and the demonstrated vulnerability of the vegetated berm at this site to be lost avulsively to erosion during a storm event, providing some form of hard stabilization at the toe of the renourished berm was the only practicable design consideration that could effectively provide toe protection for the restored berm. Ultimately, the goal of the project was to restore, enhance, and stabilize the natural protective feature of the property to minimize loss of structures and natural resources from flooding and erosion, consistent with the goal of Policy 4. The project was successfully implemented in the spring of 2014 and received a Certificate of Compliance on May 7, 2014. The current project is designed to remove and relocate landward the most westerly portion of the existing, previously permitted stone armor and associated sand backfill such that no stone or backfill will be located within the boundaries of the right-of-way over the subject property. As part of the originally submitted plans and applications to install the stone armor, the stone was inadvertently proposed to be located inside the boundaries of the right-of-way because the right-of-way was not depicted on the land survey that was used as the basis of the original design plan.
