There is an extra "L" at the end of the permitted 70' fixed dock. The dock will need to meet the conditions of Permit#8547 prior to transfer. The following action was taken at the Southold Town Board of Trustees regular meeting held on Wednesday, September 18, 2024: RESOLVED, that the Southold Town Board of Trustees DENIES the request for a Transfer of Wetland Permit #8547, as issued December 17, 2014, from Joseph & Robyn Romano to Samid Hussain due to the fact that the dock does not conform to permitted dimensions. Mr. Hussain purchased the property located at 1415 North Parrish Drive from the Romano family on August 7, 2024. Enclosed herewith is a copy of the deed conveying the property to Mr. Hussain. Also enclosed is a check payable to the Town of Southold in the amount of$100 representing the fee associated with this request together with a duly executed authorization letter allowing me to submit this request. FAHEY applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 25, 2014, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council;and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 3.1 (A, D, J, K.3), 6.1 (A.1, A.2, A.3 and B.3), 6.3 (A-1), 9.1 (C-2, C-3 and E), 9.1, 9.2 (A.1 and A.3), 9.3 (A, B, D and F), 9.4 (A, B, E.1, E.2, E.3 and EA), 9.5, 10.4 (A, B and C), 11.1 and 11.2 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the dock is to be permitted seasonally; the structure does not cover any submerged aquatic vegetation, which is beneficial marine vegetation that supports additional marine life; the area is a high-energy wave area; the seasonal aspect of the dock takes it out of harm's way from ice and wind over times of the year that predominate; and the removal of the dock by 2 November 1st affords shellfishers, particularly scallop harvesters, with resurgence of scallops in the bay; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 20, 2014 and again on December 17, 2014, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has,considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of SEAN P. On his behalf, we submit this letter to provide the Trustees with additional information in support of his application for a Wetlands Permit for the existing seasonal dock on his property at 1415 North Parish Drive (the "subject property"). In particular, this letter will address the history of the seasonal dock on the subject property, and provides the Board with a revised survey of the property reflecting certain amendments to the proposal. We have had the opportunity to research the history of the seasonal dock on the subject property, and our research confirms that the dock has been in existence for at least 30 years. Specifically, we reviewed the Building Department files on record for the subject property and discovered several historic surveys associated with three separate Certificates of Occupancy ("C/O") issued for the property in 1986 (for a "One family dwelling," a "Deck addition to existing one family dwelling," and "Inground pool and fence to code," respectively). The building permit applications associated with all three ClOs include approved plans showing the existence of the wood dock. -i EFA Furthermore, there are several iterations of a survey by Robert A. Kart, Land Surveyor, associated with the C/Os, all of which show the existence of a "wood dock" in the same location as the currently existing dock. The earliest of these surveys is dated October 31, 1980, last revised September 23, 1984. An updated survey, last revised March 27, 1985, was stamped "Approved As Noted" by the Building Department. These surveys comport with a separate survey of the property by SeaLand Surveying & Engineering P.C., dated May 5, 1986, which similarly shows the seasonal dock on the property and was also found in the Building Department file. A copy of the various surveys and excerpts from the approved plans showing the existence of the dock are annexed hereto as Exhibit A. We also researched the history of the Administrative Wetlands Permit regulations and discovered that the jurisdiction to issue such permits was originally held exclusively by the Southold Town Board. The Town Board granted jurisdiction over issuance of such permits to the Trustees pursuant to Local Law No. 6 of 1984 ("A Local Law in relation to authorizing the issuance of Wetlands Permits by the Board of Trustees"), which was enacted on June 5, 1984. Based on the aforementioned surveys, it therefore appears that the seasonal dock on the subject property was in existence prior to the date the Trustees took jurisdiction over the issuance of Wetlands Permits. A copy of Local Law No. 6 of 1984 is annexed hereto as Exhibit B. The historic existence of the seasonal dock is further reflected in the Trustees' last decision concerning the subject property. Specifically, in 2002, the Trustees denied an application "to install a 3' x 16' ramp, 6'x20' float with two 2-pile dolphins to secure float on existing 4'x70' seasonal dock." (Emphasis added). While this Board denied the application to install the ramp and float for the dock, the minutes from the Board's hearing reflect that the Trustees plainly acknowledged the existence of the dock itself. Trustee Krupski: The applicant already has a dock. Trustee Poliwoda: Right. Trustee King: This is a seasonal dock that is removed every year, right? A copy of the minutes associated with this Board's 2002 decision is annexed hereto as Exhibit C. While the 2002 decision, along with the historic surveys and approved plans on file with the Building Department, confirm the existence of the seasonal dock on the subject property for more than 30 years, it appears that the length of the dock was inadvertently extended when it was recently reconstructed. Specifically, the 2002 decision refers to the existing 1 E I I S \ a jA dock as having dimensions of 4 feet by 70 feet, while the currently existing dock has dimensions of 4 feet by 77 feet. Accordingly, we have amended the application to reflect the removal of the 7-foot extension of the dock. Copies of a revised survey reflecting the proposed reduction in the length of the dock to its historic length of 70 feet are submitted herewith. Based upon the above, we respectfully request that the Trustees issue a Wetlands Permit to allow the continued use of the 4-foot by 70-foot seasonal dock that has existed on this property for more than 30 years. All three docks have been installed at their respective locations for more than 20 years.
