EASEMENT AGREEMENT

AGREEMENT made this 1 U day of A�L-Y, 2014 as and between CHRISTOPHER P.
BUNDY and MARGARET GROSSWENDT, residing at 130 Nevins Street, Brooklyn, New
York (hereinafter referred to collectively as "Grantors") and MILTON JAIMES and MARY
KATHERINE MARLAND, residing 744 Main Street, Greenport, New York and (hereinafter
referred to collectively as "Grantees")
WHEREAS, the Grantor conveyed to the Grantee a certain parcel known as and by 744
Main Street, Greenport, New York by a certain deed dated January 30, 2014, and recorded in the
Office of the Clerk of Suffolk County on March 4, 2014, in Liber D000012765 and Page 548
(hereinafter referred to as "Deed"); and
WHEREAS, the Deed recited and reserved a certain Right of Way in favor of the
Grantors (hereinafter referred to as "R.O.W."); and
WHEREAS, the parties are desirous of setting forth with more particularity the intent,
purposes and rights to the R.O.W.
NOW, THEREFORE, in consideration of the mutual covenants herein and other good
and valuable consideration, it is hereby agreed as follows:
1. That the R.O.W. shall be 15' wide and run the entire length of Lot 008.001 (140')
alongside and parallel to the Northerly property line as provided in the Deed.
2. The R.O.W. shall be used for ingress and egress to Lot 008.002.
3. That the use of the R.Q.W. shall extend to the benefit of the Grantors and their assigns
and/or successors, and/or their respective employees, agents, tenants and invitees.
4. The Grantors, their assigns and/or successors shall also have the right to install, maintain
and repair under the R.O.W. any and all utilities services, including but not limited to
electrical, gas, cable, internet, water and/or sewer service to connect Lot 008.002. The
cost and expense of such installation, maintenance and repair shall be borne by the
Grantors, their assigns and/or successors except that the Grantees, their assigns and/or
successors shall bear the cost of any such installation, maintenance or repair necessary
due to the negligent, reckless and/or intentional acts of the Grantees and their assigns
and/or successors, and/or their respective employees, agents, tenants and invitees. No
installation of any service may abridge, abrogate and/or interfere with the R.O.W. nor
shall such installation diminish the value of the property.
5. The Grantors, their assigns and/or successors and the Grantees, their assigns and/or
successors shall equally bear all expenses with respect to the maintenance, improvement,
repair and snow and debris removal with respect to the R.O.W. other than those provided
for in paragraph 4 herein.
6. The R.O.W. shall run with the land of and be binding upon the heirs, assigns, successors,
tenants and/or occupants of the Grantors and Grantees.
7. This Agreement may not be amended orally and may be amended and/or terminated only
upon the express written agreement of all parties hereto.
