BOUNDARY LINE AGREEMENT AGREEMENT made this 15'' day of October 2014 between 837 MAIN STREET REALTY CORP. (OWNER'S) having a business address at 304 Burr Road, Commack, NY 11725 and MICHELLE LEMARCHANT (ADJOINING OWNER) residing at 837B Main Street, Greenport, NY 11944. WHEREAS, the Owners are the owner of real property commonly known as 837 Main Street, Greenport, NY 11944, and which is also known on the Suffolk County Tax Map as 1001-002.00-01.00-019.001 and more specifically described as follows: SEE SCHEDULE "A" ANNEXED HERETO WHEREAS the Owner acquired title to the above mentioned premises by Deed recorded in the Office of the Clerk of Suffolk County on April 28, 2014 LIBER 12317 & PAGE 767. WHEREAS, Adjoining Owners are the Owners of real property commonly known 837B Main Street, Greenport, NY 11944, and which is also known on the Suffolk County Tax Map as 1001-002.00-001.00-019.002 and more specifically described as follows: WHEREAS the Adjoining Owners Owner acquired title to the above mentioned premises by Deed recorded in the Office cif the Clerk of Suffolk County on December 9, 1998 in LIBER 11933 & PAGE 287. WHEREAS, the parties desire to fix and definitely establish the boundary line between the two parcels mentioned above respectively owned by them. ANNEXED hereto and made apart of this Agreement is a survey made Colonial Surveying, P.C., dated July 8, 2014. WHEREAS, fence is located as much as 6.2 feet east of the westerly line of the common boundary line between the properties owned by the Owner(s) and the Adjoining Owner(s). More specifically, fence is located on the property owned by the Owner; WHEREAS, that the Adjoining Owners for themselves, their successors, and assigns hereby disclaim all right title and interest to the strip of land between the common boundary line and FENCE. THAT the Adjoining Owners for themselves, their successors, and assigns agree that the true dividing line between the premises is the same as shown on the Suffolk County Tax Map and that they make no claim of any land owned by Owner as shown on such tax map. THE Adjoining Owners, his successors and or assigns and/or assigns represent that the above referenced fence may be removed at anytime. NOW, THEREFORE, in consideration of the premises and the sum of one dollar by each of the parties hereto to the other in hand paid, the receipt of which is acknowledged, the parties, for themselves, their successors and assigns, covenant and agree that the Adjoining Owners for themselves, their successors, and assigns hereby disclaim all right title and interest to the strip of land between the common boundary line and fence. It is further mutually agreed and covenanted by the parties hereto that the terms set forth herein shall run with the Iand and be binding upon their successors in interest.
