SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 29, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 22, 2014. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well .as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. The LWRP report recommends the applicants install and maintain a 15ft vegetated buffer from the top of the bluff to mitigate storm water runoff and enhance bluff stability. PROPERTY FACTS/DESCRIPTION: Subject parcel is a non-conforming 22,660 square foot parcel located in an R-40 Zone. The parcel has 96.00 feet of bulkhead frontage on the Long Island Sound. It runs 219.39 feet on the East side, 117.86 feet along Soundview Avenue, and 200.84 feet on the West side. The parcel is improved with an existing 1 story frame house. The existing structure is 51'2"from the top of the bluff. The survey shows there is a concrete cover seaward of the existing house. All is shown on the survey by Peconic Surveyors P.C. dated May 16, 2006 and last updated August 8,2013 and on a site plan by Ural Talgat,Architect dated 10-29-2014. BASIS OF APPLICATION: Request for Variance from Article XXII Section 280-116A(1) and the Building Inspector's November 12, 2014 Notice of Disapproval based on an application for building permit for additions and alterations to a single family dwelling, at; 1) less than the code required setback of 100 feet from the top of bluff. RELIEF REQUESTED: The applicant requests a variance to construct additions and alterations resulting in a setback of+/-47 feet from the top of the bluff where a 100 foot setback is required. Page 2 of 3—January 22,2015 ZBA#6825—Nikolakakos SCTM#1000-51-4-13 ADDITIONAL INFORMATION: Testimony was taken that the concrete cover in the rear yard is the cover of an active water well. County water is not available on this section of Soundview Avenue. Testimony as well as site inspection showed that other homes in the neighborhood are less than 100 feet from the bluff. Further, Suffolk County Soil and Water Conservation District issued a report dated December 29, 2014. The report stated: "The bluff was found in stable condition with good vegetative cover. The foreground (yard) leading to the bluff top is in turf grasses. The retaining wall built into the bluff face is in fair condition. The stairwell leading to the beach is also in fair condition.... The general topography of the property is sloping away from the bluff face and the land itself is entirely vegetated turf grass and some trees. It is recommended that the building plans include diverting landward any runoff that may develop during construction. During construction, it is further recommended that heavy machinery, or supplies be stored...a minimum if a 25' setback from the top of the bluff." FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 8, 2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby, properties. The area consists of single family homes many of which are set back less than 100 feet from the top of the bluff. The additions and alterations will increase the nonconformity by 3.3'. This slight increase is for steps and a landing. The existing setback for the house is being maintained. 2. Town Law.4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing setback for the house is non-conforming. Any additions and alterations to the existing residence would require variance relief. 3. Town-Law&267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 53% relief from the code. However, the'additions and alterations are consistent with the LWRP, and the Soil and Water Conservation District Report found the property to be suitable for the current proposal. The existing footprint shall be maintained, the applicant is constructing a second story addition. 4. Town Law . 267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install a 15' vegetative-buffer at the top of the bluff and pitch all storm water runoff away from the bluff during the course of construction. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town. Law 4267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a 2 story house while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267=B, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried,to Page 3 of 3—January 22,2015 ZBA#6825—Nikolakakos SCTM#1000-51-4-13 GRANT the variance applied for, and shown on survey by Peconic Surveyors P.C. dated May 16, 2006 and last updated August 8, 2013 and on a site plan and architectural drawings by Ural Talgat, Architect dated 10-29-2014 and 11-14-14 and labeled North, South,East, and West Elevations, and first and second floor. CONDITIONS: 1) The applicant shall install and maintain a 15 foot vegetated buffer with a pathway to get the existing staircase on the bluff. 2) The applicant shall pitch all storm water runoff away from the bluff. 3) The applicant shall not operate heavy machinery or store construction materials within 25 feet from the top of the bluff. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is.de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any, variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3)years from the date such variance wasgranted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one(1)year terms. Vote of the Board: Ayes:Members Weisman(Chairperson), Schneider, Horning, Dantes. (Absent was Member Goehringer). This Resolution was duly adopted(4-0). In your letter, you are seeking an approval to replace the floor system in an existing single family dwelling by removing the existing exterior walls intact and reinstalling them upon completion of a new floor system. The proposed structural change does not constitute a demolition nor increase the degree of non-conformity relating to area setback from the top of bluff granted by the Zoning Board of Appeals. Based upon the information provided, I have determined that your requested structural modification is de minimus in nature because the proposed change does not constitute a demolition nor does it increase the non-conformity. Furthermore, the intent of the original ZBA decision will not be altered. Please be advised that the conditions set forth in Appeal No. 6825 will still apply. Contact our office if you have any further questions or concerns. I will instruct the office to send a copy of this letter and your request to the Building Department. Since y, Leslie Kanes Weisman Chairperson cc: Michael Verity, Chief Building Inspector Swiz6 Construction William Swiskey Jr., 70 Gillette Drive,East Marion NY 11939` ' 631-388-3665,Swiz6@aol.com' 5/1/17 Southold Town Building Department&Zoning Board of Appeals RETE® RE: Nikolakakos Property 2795 Soundview Drive,Southold NY MAY ®2,201 ' ZONING BOARD OF APPS Dear Southold Town Building Department&Zoning Board of Appeals, This letter is to seek approval to replace the floor system on the above said property due to safety concerns. Upon demolition of the existing structure the current floor system is structurally deficient and not properly tied to the foundation. I am requesting approval to replace the existing floor joists and girders. Sill plates will be added to properly tie the structure to the foundation. We understand that 25% of the existing structure must remain. In complying with that we plan to maintain the original foundation plan and remove the existing exterior walls intact and reinstall upon completion of a new floor system. Multiple safety issues were discovered upon demolition and include: - No Sill Plates - Floor system is not tied to the foundation - there is no box beam - the existing walls sit on a single 2x8 ledger around the entire perimeter, causing shifting of the structure - 2x8 floor joists are over spanned and deflecting over 1" - East side of structure has 2x6 floor joists which are insufficient to carry any load - Existing girders consist of 2-2x6's with splice made in center span and are deflecting over 1" and cracking Replacing the floor system would allow us to properly tie the foundation, the sill, the floor beams and wall systems together. It will give a stable and secure platform for the two-story renovation. It would also prevent us from having to do unorthodox repairs that would lead to future problems with the structure. The homeowners have worked diligently and tirelessly for three years with the town and county for all the approvals they acquired for their renovation.. We have set an October completion date and are looking for an expedited approval to keep the job moving forward to keep said date. Your prompt attention to this matter is greatly appreciated. Thank you very much. Sincerely, RECEIVED MAY 0 2 2017 rWilliam Swiskey Jr. ZONING BOARD OF APPEALS N SURVEY OF PROPERTY A T SO UTHOLD TOWN OF SO UTHOLD SUFFOLK COUNTY, N. This evaluation of the parcel located at 20795 Soundview Avenue in Southold was conducted on December 29, 2014. It was noted that the bluff was found in stable condition with good vegetative cover. The foreground (yard) leading to the bluff top is in turf grasses. The retaining wall built into the bluff face is in fair condition. The stairwell leading to the beach is also in fair condition. However, it was noted that the beach was degenerated as compared to the neighboring beaches. The general topography of the property is sloping away from the bluff face and the land itself is entirely vegetated with turf grass and some trees. It is recommended that the building plans include diverting landward any runoff that may develop during construction. During construction, it is further recommended that heavy machinery, equipment, or supplies be stored and/or a minimum of a 25' setback from the bluff top edge be observed. The heavy weight and vibrations from the machines may cause sloughing of the bluff. Finally, running machines for long periods of time have a negative impact on the neighboring bluffs. Overall, the property was found to be suitable for its current proposal with no apparent degradation to the surrounding natural resouces. I would like to thank you for requesting the comments of the Suffolk County Soil and Water Conservation District. If you have further questions regarding this evaluation, feel free to contact us at your earliest convenience. STELIOS and PENELOPE NIKOLAKAKOS #6825 SCTM#1000-51-4-13 Request for Variance from Article XXII Section 280-116A (1) and the Building Inspector's November 12, 2014 Notice of Disapproval based on an application for building permit for additions and alterations to a single family dwelling, at; 1) less than the code required setback of 100 feet from the top of bluff, located at: 20795 Soundview Avenue (adj. to Long Island Sound) Southold, NY. SCTM#1000-51-4-13 Records show that a Wetland Permit (7410) was issued in 2010 for the property to stabilize the bluff through armoring following severe erosion during 2010 storms. An Amendment to the permit was issued in 2011. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policy standards and therefore CONSISTENT with the LWRP. The recommendation was made with the following assessment and recommendations: 1. The bluff on the property has been stabilized to the greatest extent practicable with shoreline armoring. 2. The seaward addition of the stone and stair landing is de-minimus. The existing setback from the top of bluff is shown as 51.3', the proposed setback is 41.9', indicating a 3.3' further encroachment into the 100' setback from the top of bluff. 3. It is recommended that: a. The Board determines what the `existing concrete cover" is as shown on the plans seaward of the residence and if it needs to be addressed (abandoned and filled). b. Although not a structure addressed in the notice of disapproval the stone pavers (patio) will affect surface drainage patterns. It is recommended that the Board determine the pitch of the stone patio and if necessary require drainage designs that would prevent storm water surface flow towards the bluff. One foot contours shown in figure 1 indicate that the property slopes towards the bluff and adjacent property. c. The Board requires that a 15' wide vegetated buffer be located landward of the top-of bluff to mitigate storm water surface runoff towards the bluff. 11ids I q s , r E¢ x e a , fir, s r z x l ti { n, e t A ` o, e Figure 1. An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted, because the proposed addition is characteristic of other residential properties in the neighborhood in scale, design and setbacks to the street. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than the area variance, because the entire existing building structure is within the 100' setback line from the bluff. The existing building structure was built prior to zoning and has not been renovated or improved since it was built. The proposed construction maintains the existing building and renovates and updates the structure to bring the structure to meet current building codes. The addition to the existing building, on the water side of the building, will be built on the location of an existing concrete terrace, filling in the corner of the existing building. The addition to the road side of the building will also be built on the location of an existing concrete terrace, filling in the corner of the existing building. The addition of the covered porch is planned on the road side of the building further away to the bluff than the existing building is. The second floor addition keeps the construction within the footprint of the existing building. The only area on the property thats meets the setbacks would then require a new building structure which would be a major financial hardship rather than what the current project would cost. 3. The amount of relief requested is not substantial because the proposed addition will be built over an existing structure which is in a non-conforming location. The house will be reconstructed within the existing footprint, with modest and appropriate expansions intended to square off the irregular shape and rationalize the interior layouts. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because it is mostly within the existing footprint of the building. The proposed construction will retain all rain water on site via new drywells and comply with all best management practices for storm water run off during construction. In keeping with requirements of the Southold Trustees, State DEC and County Health Department, it will include a new updated conforming sanitary system. 5. The alleged difficulty has NOT been self created because it is the result of a pre-existing situation where the existing house was located within the setback prior to zoning. There are no Covenants or Restrictions concerning this land. Prior to construction, the project must also be approved by The Southold Town Trustees and Suffolk County Department of Health Services. • 0 This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood, and the health, safety, and welfare of the community. The variance requested is the minimum relief practicable given the personal benefits anticipated by the applicant. The reconstruction is needed to maintain the investment and the proposed expansion is modest in scope and scale. We respectfully request that the appeal be granted, together with any further relief that is deemed necessary and reasonable. It is recommended that the Board determine the pitch of the stone patio and if necessary require drainage designs that would prevent storm water surface flow towards the bluff.
