loci WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of

the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Southold, County of
Suffolk and State of New York, shown and designated as Lot No. 40 on a certain map entitled,
"Map of Yennecott Park situate at Southold, Town of Southold, Suffolk County, New York,
L j surveyed by Van Tuyl & Son, Greenport, New York, May 1, 1968, and filed in the Office of the
Clerk of the County of Suffolk on the 9th day of October 1968 as Map No. 5187, being bounded
6314 IC00 and described as follows:
BEGINNING at a point on the southerly Zine of Yennecott Drive where same is intersected by the
/ common division line between Lots 39 and 40 on the above captioned map;
RUNNING THENCE South 14 degrees 04 minutes 00 seconds East, along said common division
fine, 113.35 feet;
THENCE South 84 degrees 38 minutes 30 seconds West, 283.83 feet to Lot 41 on the above
mentioned map;
THENCE North 15 degrees 36 minutes West, along said Lot 41, 24.80 feet to the southerly line
of Yennecott Drive;
THENCE North 61 degrees 27 minutes 20 seconds East along the southerly line of Yennecott
Drive, 182.32 feet;
THENCE still along the southerly Pane of Yennecott Drive North 75 degrees 56 minutes East,
104.65 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by
deed dated June 17, 1994 recorded in the Qffice of the Clerk of the County of Suffolk on June 30,
1994 in Liber 11683 page 420.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
