19. Moved by Councilman Schondebare, seconded by Councilwoman Cochran, it was
RESOLVED that the Town Board of the Town of Southold hereby proclaims July
1, 1984 as TAXPAYERS DAY IN THE TOWN OF SOUTHOLD.
COUNCILMAN TOWNSEND: We're all taxpayers.
COUNCILWOMAN COCHRAN: Every day is taxpayers day.
COUNCILMAN STOUTENBURGH: Every day is, this is ridiculous. Somebody's got
something going, I don't know.
COUNCILMAN SCHONDEBARE: Is there a second on this so we can discuss it?
SUPERVISOR MURPHY: Anyone like to second it?
COUNCILWOMAN COCHRAN: I'll second it for discussion.
COUNCILMAN STOUTENBURGH: I'd just let it die without a second.
COUNCILMAN SCHONDEBARE: Tax Action by Senior Citizens Inc., a non-profit,
non-partisan is sponsoring Suffolk Taxpayers on Parade. And they sent us a letter
and they feel at last a day to recognize the taxpayers. So they've asked us to
set aside a day that taxpayers of the towns could be recognized. They're going
to try to have a parade in Riverhead.
COUNCILMAN STOUTENBURGH: Asking for advertisers, too, on the back, $20.00
and $30.00 apiece.
COUNCILWOMAN COCHRAN: I would like to believe the Southold Town Board
considers the taxpayer every day.
SUPERVISOR MURPHY: Any other questions on this resolution? (No response.)

SUPERVISOR MURPHY; Number 20 is an emergency resolution to replace a machine
at the landfill. due to unsafe conditions.
COUNCILMAN T-OWNSEND: What was this thing about two months rental on the
back there? -- I'm sorry, I'll offer the resolution.
0. Moved by Councilman Townsend, seconded by Councilman Schondebare, it was
RESOLVED that the Town Board of the Town of Southold hereby declares that an.
emergency exists in the need to replace the Morbark Super Beever Chipper at the
Southold Town Landfill, and therefore authorizes the trade-in of said machine for
a Factory Rebuilt Super Beever S/N 120 with Cummins 504 Diesel & Clutch at a
total cost to the Town of $8,665.00, plus transportation costs.
SUPERVISOR MURPHY: On the question.
COUNCILMAN TOWNSEND: On the back of the proposal they have a three month
rental here. Have we been using the new one for three months?
SUPERVISOR MURPHY: We've used the new one for almost a year, Jim? Eight,
nine. months? The one we have now.
COMMUNITY DEVELOPMENT DIRECTOR McMAHON: For almost a year.
SUPERVISOR MURPHY: For almost a year, and the man is buying it back, the'
firm is buying it back at the exact price we paid for it.
COUNCILMAN TOWNSEND: I'm talking about three months rental, is that --
SUPERVISOR MURPHY: It's on both of them, either way you want to go.
COUNCILMAN TOWNSEND: We own the other one, how can we rent it?
SUPERVISOR MURPHY: Wait a second. We're not renting it. Okay, what the
story is, there's a serious safety hazard ---
COUNCILMAN TOWNSEND: No clutch.

SUPERVISOR MURPHY: Okay, the new machine --the same machine we have, built
with a clutch, would cost $51,000.00, "x" number of dollars. He's giving us back,
as a trade-in of our machine, on a new machine, or a demonstrator, with less hours
than ours has, and he's giving us the actual purchase price that we bought our
machine for, and we are paying then for use of the machine for three months instead
of a year. It's costing us $8,000-00 to own the machine for the year, basically what
it is. We can buy a demonstrator with less hours than ours has for $8,000-00,
approximately, or we could buy a brand new machine, a brand new machine, for the
actual cost, less our trade-in, plus the $8,000.00.
COUNCILMAN TOWNSEND: The three months rental is for the machine we presently
have then?
SUPERVISOR MURPHY: Which we've used for a year.
.COUNCILMAN TOWNSEND: Okay. Why can't we just say it's an unsafe machine
and give us a new one?
SUPERVISOR MURPHY: Well, that's why we have an emergency resolution. Any
other questions on it?
COUNCILMAN STOUTENBURGH: Has anybody seen this machine? This used one?
SUPERVISOR MURPHY: No. They're a very honorable firm. Want to go out to
Michigan?
COUNCILMAN STOUTENBURGH: No, no, I just---_ .
SUPERVISOR MURPHY: It's a completely factory reconditioned machine that they're
taking in, they're repainting it, redoing everything so that it will look just like a
brand new machine. When they take ours back in trade-in, they will do the same
thing with our machine and then sell it.
COUNCILMAN TOWNSEND: Sell it to some other sucker or what?
SUPERVISOR MURPHY: They probably will adapt it to a clutch.
COUNCILMAN SCHONDEBARE: Put a clutch in?
SUPERVISOR MURPHY: Yes.

Because it was recommended early on that we, have a clutch, and that we do have a

This resolution -was declared duly ADOPTED.
SUPERVISOR MURPHY: Number 21 to approve a bond.
21. Moved by Councilwoman Cochran, seconded by Councilman Schondebare, it was
RESOLVED that the Town Board of the Town of Southold hereby approves the
bond in the amoutn of $9,130.00 submitted by Leon Marcus in connection with
the installation of a water main in the Minor Subdivision entitled, "Leon Marcus,"
located at Greenport, New York.
SUPERVISOR MURPHY: Any questions?
COUNCILMAN TOWNSEND: Yes, where is this located? I was trying to figure
it out on here.
SUPERVISOR MURPHY: Where is the subdivision?
COUNCILMAN SCHONDEBARE: You can't figure it out from here, this is a" bond.
COUNCILMAN TOWNSEND: Well, I'll withdraw the question.
SUPERVISOR MURPHY: I've no idea.
COUNCILMAN TOWNSEND: It's just for the installation of a water main.

The undersigned declares that he has carefully examined and fully understands
the attached "Notice to Bidders", the "Information and Instructions to Bidders,"
"Specifications" and form of "Contract", and this bid form, and that the undersigned
hereby proposes to sell to the Town of Southold the landfill equipment(wood chipper) set
forth below in accordance with the Information and Instruction to Bidders, the Specifications,
Form of Contract and Notice to Bidders, all of which are a part hereof, to such an extent
as they relate so to govern the obligations herein proposed to be assumed at the following

Furnish and deliver one Morbark Super Beever Chipper (or Equal), all in

on June 7, 1983 accepted your bid in the amount of
$53,475.00 for supplying the Town with one Morbark Super
Beever Chipper, together with a spare parts kit including
ten (10) spare knives and Michigan Knife Model 40" knife
grinder.
Enclosed herewith is the contract for the above-
mentioned piece of equipment. Please execute both

AGREEMENT made this 13th day of June , 1983, between
MORBARK INDUSTRIES, INC.
with its principal office and place of business at P. 0. Box 1000, Winn,
Michigan 48896 hereinafter called the Seller, and
the TOWN OF SOUTHOLD, a municipal corporation of the State of New York with
offices at Main Road, Southold, Suffolk County, New York, hereinafter called the
Town.
WITNESSETH, that the Seller has agreed to sell and hereby does sell, and
the Town has agreed to purchase and does hereby purchase from the Seller, the
following: One Morbark Super Beever Chipper, together with a spare
parts kit including ten (10) spare knives and Michigan Knife
Model 40" knifegrinder.
Purchase price: Fifty-three thousand four hundred seventy-five
and no/100 dollars ($53,475.00).
The above specified equipment shall be fully equipped and delivered to the
Town at the Southold Town Highway Department at Peconic in said Town on or before
this 15th day of July 1 1983.
This contract has been awarded to the aforesaid Seller who was the lowest
responsible bidder complying with the specifications determined by receipt of sealed
bids received by the Town pursuant to public advertisement pursuant to the provisions
of Article 5A of the General Municipal Law.
A resolution authorizing the purchase of the above specified equipment was
adopted by the Town Board of the Town of Southold at a meeting held on the 7th
day of June , 1983.
Within ten (10) days of the delivery of the above specified equipment and
its acceptance by the Town of Southold, the Supervisor of the Town of Southold
shall pay the total price for each item of the equipment as set forth in the bid.
The seller warrants the above described equipment against defective workman-
ship and material in accordance with the provisions of paragraph 9 of the Instructions
to Bidders, and the Seller further agrees that it will supply to the Town, free of
charge, one parts book, one service and repair manual, and one operator's manual,
and will also, upon the delivery of the aforesaid equipment, provide qualified persons
to instruct the Town employees designated by the Highway Superintendent of the
Town with respect to complete instructions for the operation and maintenance of
said equipment.
The Seller hereby agrees not to assign, transfer, convey or otherwise dispose
of this contract or its right, title or interest therein or its power to execute the
same to any person or corporation without the previous consent, in writing, of the
Purchaser.
Risk of loss or damage of said equipment by any cause whatsoever until
the same is delivered to the Town as hereinbefore provided, shall be upon the Seller,
and in the event of any such loss or damage, this contract shall be deemed rescinded.
**A PARTS BOOK WILL BE SHIPPED WITH THE UNIT. THE OPERATORS MANUAL IS NOT COMPLETED,

The Seller hereby certifies that there are no Federal or State taxes included
in the above purchase price.
It is further agreed between the parties hereto that in the event that the
Seller fails to deliver said equipment on the date hereinbefore provided, a penalty
of twenty-five dollars ($25.00) for each day shall be imposed, which amount shall
be deducted by the Town from the purchase price hereinbefore set forth.
This contract comprises the entire contract between the parties and super-
sedes any and all other agreements respecting the equipment herein described.

until 10:00 A.M. on the 27th
day of May, 1983, at which,
time and place they will be
publicly opened and read
aloud. Specifications, bid

Bids must be open and in

prepared by the Town which

INFORMATION AND
INSTRUCTIONS TO BIDDERS
FOR LANDFILL EQUIPMENT
1. It is the intention of these specifications to request bids for the purchase of
a Morbark Super Beever Chipper (or equal) , together with a spare parts kit including
ten (10) spare knives and Michigan knife Model 40" knife grinder (or equal) .
2. Bidders are to furnish all items and perform all work not specifically set forth
in the specifications, but which is essential to the proper operation of the new equipment
intended to be furnished to the Town.
3. Where a particular item of equipment is specified by name, it is the intention
of having that particular item supplied, or its equal.
4. Items that are not detailed specifically are left to the discretion of the bidder.
5. Each bidder must furnish details of the complete new equipment to be furnished
whether or not such detail items are specified herein.
6. Any exceptions to or deviations from the specifications must be specified in writing
in detail with reference to the page and section. Any such exceptions or deviations
may be considered by the Town Board and accepted if deemed by the Board to be
in the best interest of the Town of Southold.
7. Each bidder shall furnish a statement setting forth its service facilities and the
location thereof.
8. Each bid must be accompanied with photographs and plans showing dimensions
and overall construction of equipment.
9. The entire equipment including engine, body, chassis, and all component parts
shall be guaranteed by the bidder for a period of not less than one year from the
date of delivery to and acceptance by the Town of Southold. Such guarantee shall

require the bidder to furnish to the Town, without cost, including transporation,
parts to replace parts that have failed under normal use, and said failure found
to be attributable to defective material or inferior workmanship. The foregoing guaran-
tee shall be in addition to any warranties which may be furnished by the manufacturer
and/or supplier of any component assemblies incorporated into the complete equipment.
10. Each bidder must specify and guarantee a delivery date.
11. The bid price shall be F.O.B. Peconic, New York and shall include delivery
to Peconic, New York and also shall include the services of qualified personnel to
perform two (2) days start-up and to instruct in the operation and maintenance of
the equipment to the complete satisfaction of the Superintendent of Highways of
the Town of Southold.
12. Non -collusion Statement. Each bidder must execute a "Non -collusion Bidding
Certificate" in the form attached hereto and attach the same to his bid form.
13. All bids must be in duplicate, enclosed in a sealed envelope plainly marked "Bid
for Landfill Equipment" and addressed to Judith T. Terry, Town Clerk, Main Road,
Southold, New York.
14. Each bid must be accompanied by a certified check made payable to the order
of the Town of Southold in an amount equal to 5% of the total bid price conditioned
that if the bid is accepted, the successful bidder will enter into a written contract
in the form attached hereto, to furnish said equipment within ten (10) days from
the date of the acceptance of his bid. If the successful bidder fails to enter into
a contract within the time limit herein, then the check deposited with the bid and
the moneys standing to the credit of the same shall be forfeited to the Town of Southold

the TOWN OF SOUTHOLD, a municipal corporation of the State of New York with
offices at Main Road, Southold, Suffolk County, New York, hereinafter called the
Town.
WITNESSETH, that the Seller has agreed to sell and hereby does sell, and
the Town has agreed to purchase and does hereby purchase from the Seller, the
following:
The above specified equipment shall be fully equipped and delivered to the
Town at the Southold Town Highway Department at Peconic in said Town on or before
this day of 1983.

This contract has been awarded to the aforesaid Seller who was the lowest
responsible bidder complying with the specifications determined by receipt of sealed
bids received by the Town pursuant to public advertisement pursuant to the provisions
of Article 5A of the General Municipal Law.
A resolution authorizing the purchase of the above specified equipment was
adopted by the Town Board of the Town of Southold at a meeting held on the
day of , 1983.
Within ten (10) days of the delivery of the above specified equipment and
its acceptance by the Town of Southold, the Supervisor of the Town of Southold
shall pay the total price for each item of the equipment as set forth in the bid.
The seller warrants the above described equipment against defective workman-
ship and material in accordance with the provisions of paragraph 9 of the Instructions
to Bidders, and the Seller further agrees that it will supply to the Town, free of
charge, one parts book, one service and repair manual, and one operator's manual,
and will also, upon the delivery of the aforesaid equipment, provide qualified persons
to instruct the Town employees designated by the Highway Superintendent of the
Town with respect to complete instructions for the operation and maintenance of
said equipment.
The Seller hereby agrees not to assign, transfer, convey or otherwise dispose
of this contract or its right, title or interest therein or its power to execute the
same to any person or corporation without the previous consent, in writing, of the
Purchaser.
Risk of loss or damage of said equipment by any cause whatsoever until
the same is delivered to the Town as hereinbefore provided, shall be upon the Seller,
and in the event of any such loss or damage, this contract shall be deemed rescinded.

The Seller hereby certifies that there are no Federal or State taxes included
in the above purchase price.
It is further agreed between the parties hereto that in the event that the
Seller fails to deliver said equipment on the date hereinbefore provided, a penalty
of twenty-five dollars ($25.00) for each day shall be imposed, which amount shall
be deducted by the Town from the purchase price hereinbefore set forth.
This contract comprises the entire contract between the parties and super-
sedes any and all other agreements respecting the equipment herein described.

In 1980 the Department began to experiment with equipment that would chip the. brush
we collect, The equipment utilized in 1980 proved to be inappropriate. The equip-
ment utilized in 1981 proved appropriate and ultimately'we purchased the Morbark
Model 12 for a cost ,of $54,826.30. We received the `;.equipment 'in June, 1981. All
brush in 1981 was chipped ,either through the rented machine,or.through our own
machine. 1981 proved to be a break-in period for the operation and maintenance of
the chipper. Costs in 1981 were less than costs in 1982. We have `kept accurate
records of all costs in.1982.
In 1982 the Department collected 32,135 cubic yards of brush, utilized 720 hours
to chip the brush, and 75 hours to haul the chips to various locations. The chipper
used 1,420 gallons of fuel. In tabular form these costs _plus maintenance are as
follows:
