TASKER, being duly sworn deposes and says; That I am an attorney at law duly admitted as such in the State of New York and maintain~offices at 425 Main Street, Greenport, New York, and am the attorney for Elizabeth T. Albertson, Frances T. Svihra, Margaret T. Deale and Jean T. Dawson, the owners of a parcel of land located on the north side of North Road near the Village of Greenport, and shown and designated on the Suffolk County Tax Map as District 1000, Section 033, Block 5, Lot 15. Said premises has an area of approx- imately 1½ acres; has a frontage on the north side of North Road of approximately 140 feet; a depth of 470 feet along its westerly boundary line; a depth of 490 feet along its easterly boundary line and a distance along the rear line of approximately 150 feet. The premises, prior to 1942, were owned by Frederick H. Tasker, deponent's grandfather. Frederick H. Tasker died testate on December 16, 1942. That the Last Will and Testament of Frederick H. Tasker was duly admitted to probate on March 29, 1942 (Suffolk County File 517 T 1942). That by paragraph Third of said Last Will and Testament, the testator devised the above mentioned premises to his grandchildren Elizabeth T. Albertson, Frances T. Svihra, Margaret T. Deale, Virginia T. Corrazzini and Jean T. Dawson, as joint tenants. Thereafter, Virginia T. Corrazzini died and as a result thereof title to said premises passed to the remaining four sisters above mentioned. By deed dated November 10, 1983, Elizabeth T. Albertson, Frances T. Svihra, Margaret T. Deale and Jean T. Dawson executed a deed to Elizabeth T. Albertson, Frances T. Svihra, Margaret T. Deale and Jean T. Dawson as tenants in common of the above described premises which said deed was re~orded in the Suffolk County Clerk's Office on December 13, 1983 in Liber 9474 of deeds at page 472. By reason of the foregoing, the premises is presently owned by Elizabeth T. Albertson, Frances T. Svihra, Margaret T. Deale and Jean T. Dawson as tenants in common. That your deponent is familiar with the said premises by reason of the fact that he is the grandson of Frederick H. Tasker and the brother of the present owners. That your deponent resided at the dwelling house on said premises from 1938 until approximately 1980. That the dwelling house on said premises is a 2½ story wood frame dwelling containing a kitchen, living room, dining room and library on the first floor and 3 bedrooms and 2 baths on the second floor and a storage attic above the second floor. That to the best of deponent's knowledge, the dwelling on said premises was constructed around 1880 and has never been structurally altered since its original construction. That there is a two car wood frame garage located on the premises which was constructed in 1946 and has never been thereafter structurally altered. That from the foregoing, it is apparent that the premises and the structure thereon pre-existed the adoption of the first zoning ordinance in the Town of Southold in 1957, and to the extent that the premises may not conform to the present zoning code area and/or bulk requirements, the same are pre-existing, non-conforming uses and structures. To deponent's knowledge, the premises have never been surveyed by a surveyor. The premises are now under contract for sale and the purchasers have ordered a survey of the property. If it is determined necessary that such survey be provided before a certificate of occupancy can be issued, then such survey will be provided when the same has been completed.
