Y. and subject to the Terms and Conditions listed on the reverse side hereof, of Southold Town Trustees authorizes and permits the following: A grandfather permit for the bulkhead on property at Bayview Road, Southold. all in accordance with the detailed specifications as presented in the originating application. IN WITNESS WHEREOF, The said Board of Trustees here- by causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said BoarcLas of this date. - U Trustees TERMS and CONDITIONS The Permk~ee Wilbert Boily residing at Bayveiw Road. Sn~thold N.Y., as part of the consideration for the itm,-ce of the Permit does understand and prescribe to the fol- lowing: 1. That the said Board of Trustees and the Town of Southold are ~eleased from any and ali damages, or clulms for damages, of suits arising dirtily or indirectly as a result of any oput- atioa performed pursuant to this permit, and the said Permit~ will, at his or her own expeme, defend any and all such mits initiated by third parties, and ~ said Pe~mktee assumes full lial~ty with respect thereto, so the complete exclusion of the Board of Tn~stees of the Town of Sonthold 2. That this Permit should be retained indefinitely, or as long as the said Permi~cee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that auth. otization was originally obtaine~L 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by tesulution of the said Board. 5. That there will be no .nreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Sonthold reclaire the removal and/ur alterations in the location of the work herein authorized, or if, in the opinion of the Board of Tntstees, tl~ work shall cause unreasonable obstracnon to free navigation, the said Permittee wili be requl~l, upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold. ~. Boily Bayview Road Southold, NY 11971 RE: Grandfather Application Dear Mr.Boily: The following action was taken by the Board of Town Trustees during its regular meeting held on April 4, 1991: RESOLVED that the Town Trustees APPROVE the request for a grandfather application for your bulkhead. RESOLVED that the Town Trustees APPROVE the request to replace inkind/inplace 35' of the section of bulkhead shown in application. Please return to the Building Department for a determination on the need for any other permits which may be required for this project, as this approval is only from the Board of Trustees.
