COUNTY OF SUFFOLK ) John C. Harrison,being duly sworn,deposes and says: 1. I am the Secretary to the Mattituck Fire District and am fully familiar with the facts and circumstances hereinafter set forth. 2. The Mattituck Fire District owns the property located at 1000 Pike Street, Mattituck,NY 11952(the"Premises'). 3. The Mattituck Fire District maintains a communications facility at the Premises 4. The Mattituck Fire District is licensed by the Federal Communications Commission to operate and maintain its communication system. 5. The Mattituck Fire District needs to replace the existing communications tower with a new tower,so that the Mattituck Fire District antennas supporting the communications system can be located at a greater height. 6. Southold Code § 280-70D provides a priority listing for applicants seeking approvals to establish a public utility wireless telecommunications within the Town:the first priority is to locate a facility on an existing antenna support siructure or other structure on Town-owned properties,including the right-of way ("Priority 1"proposals);the second priority is to locate a facility on an existing antenna support structure or other structure on other property in the Town ("Priority 2" proposals); the third priority is to erect a new antenna support structure on Town-owned properties("Priority 3"proposals);the fourth priority is to erect a new antenna support structure on properties in the LI or LIO Zoning Districts("Priority 4"proposals);the fifth priority is to erect a new antenna support structure on properties in the MI, MU, B or HB Zoning Districts {"Priority 5"proposals);and the sixth priority is to erect a new antenna support structure on properties in the AC,R40,R-80,R-120,R-200,R400,LB,RO,RR,HD or AHD Zoning Districts("Priority 6"proposals). 7. I also note that Southold Code § 280-70D(4) provides that "the Planning Board may, if satisfied with the explanation provided by the applicant,approve any site located within an area in the above list of priorities, provided that the Planning Board finds that the proposed site is in the best interest of the health,safety and welfare of the Town and its inhabitants and will not have a deleterious effect on the nature and character of the community and neighborhood." 8. The instant proposal calls for the removal and replacement of the existing communications tower.The Mattituck Fire District respectfully submits that the removal and replacement proposed is akin to collocating on,and extending,an existing tower(Priority 2). 9. The Mattituck Fire District's consulting radio frequency engineers have determined that the proposed antenna heights are the minimum heights needed to improve the communications system throughout the District. 10. In accord with Southold Code §§ 280-70D(1)and 280-74D(2), the Mattituck Fire District submits that there are no existing structures on Town property (Priority 1), or privately owned property (Priority 2),upon which the Mattituck Fire District could locate its communications system and improve same as is currently required.Moreover,the communications tower must remain at the Premises for security reasons. 11. Additionally, in accord with Southold Code § 280-741)(2), the proposed replacement communications tower will be capable of accommodating colocation of additional antennas for future user(s).
