shape; with the condition that a vessel no lon�er than 24 ft.in length be pernutted at the dock and that

Transfer of Wetland Permit#1680 from Robert Bleimiller to Carrie Tintle, and for an
Amendment to Wetland Permit#1680 under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated January 15, 2016, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization-Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 6 and 9.3 of the Local
Waterfront Revitalization Program to the greatest extent possible through the imposition
of the following Best Management Practice requirements: that a vessel no longer than
24 ft. in length be permitted at the dock; and that when replacement of the two floating
docks is necessary same must be replaced with one floating dock not to exceed 120
-square feet, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 17, 2016 and on March 23, 2016, at which time all interested
persons were given an opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management �
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local WaterFront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,

and as depicted on the site plan prepared by Joseph T. Matthews Architect, P.C.,

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed actions are
INCONSISTENT with the below listed LWRP policies 6 and 9.3 and therefore is INCONSISTENT with
the LWRP:
A Wetland Permit(1680)was issued in 1983 for a dock structure on the property.
Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem.
Policy 9.3 Preserve the public interest in and use of lands and waters held in public trust by the
state and the Town of Southold.
A. Limit grants, leases, easements, permits or lesser interest in lands
underwater in accordance with an assessment of potential adverse impacts
of the proposed use, structure, or facility on public interest in public lands
under water. ('Jse the following factors in assessing potential adverse impact:

The applicant fails to prove that the action meets the following requirements
§ 275-11 Construction and operation standards C. 2 (d) of the Southold
, Town Code:
(d) Review and approval of dock applications. Before issuing a permit for a
dock structure, the Trustees shall consider whether the dock will have any of
the following harmful effects:
(1] Whether the dock will impair navigation or be located in areas of high
vessel traffic or vessel congestion;
1. In addition, Chapter 275 requires that the determination of the lenqth of
the dock must include the dimensions of the vessel. The dimensions of
a vessel are not specified.
2. An assessment to whether the expansion is consistent with the existinq
dock line cannot be made.
�2] Whether the dock will unduly interfere with the public use of waterways
. for swimming, boating, fishing, shellfishing, waterskiing and other water-
dependant activities;
The proposed, permanent, private, dock structure will further extend into
public waters resultinq in a net decrease in public access to public
