LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property is located in the R40 zone district and is non -conforming with 8,750 sq. ft. It is improved with a two story frame dwelling with attached deck, accessory above ground pool and accessory one story frame garage. It has 50.00 feet of frontage on Pequash Avenue, 175.00 feet along the. northern property line, 50.00 feet along the western property line and 175.00 feet along the southern property line as shown on the survey of the property prepared by John T. Metzger, L.S. dated November 10, 2014. BASIS OF APPLICATION: Request for Variance from Article III Section 280-15 and the Building Inspector's February 11, 2014, Updated September 29, 2014 Notice of Disapproval based on an application for building permit to re -construct with second story addition an'accessory garage, at; 1) less than the minimum side yard setback of 5 feet. RELIEF REQUESTED: The applicant requests a variance to construct a second story addition to a pre-existing accessory garage having a 2.9 foot side yard setback where the Code requires a minimum 5 foot side yard setback. ADDITIONAL INFORMATION: The "Notice of Disapproval" refers to the re -construction of the subject pre- existing accessory garage with a proposed second story addition, however, from the public hearing, it was learned that the pre-existing subject accessory garage will not be re -constructed and that the proposed second story addition. would be constructed utilizing the pre-existing accessory garage's walls and foundation. At the public hearing the adjoining property owner to the south expressed opposition to the proposed second story addition because it would affect his view. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 4, 2014, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property Page 2 of 3 - January 8, 2015 ZBA#6803 — Zambrelli SCTM#1000-110-3-27 and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1)... Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There was some evidence presented and testimony given by the adjoining property owner to the south (in opposition to the variance) that the accessory structures in this neighborhood do not have second stories and that a granting of the variance would produce an undesirable change to this neighborhood. The Board finds that a second story addition to an existing accessory garage will not produce an undesirable change .to the character of the neighborhood because two story accessory structures in residential zoned districts, when in conformance with the code, are permitted "by right" whether there exists other two story accessory structures or not in its neighborhood. The existing accessory garage with the proposed second story addition is in the required rear yard location and will be partially screened from the road by the principal dwelling. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method; feasible for the applicant to pursue, other than an area variance. The pre-existing accessory garage is at a non-conforming 2.9 foot side yard setback and it would not be economically feasible to relocate the existing accessory garage and foundation to a conforming 5 foot side yard setback. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 42% relief from the code. However, upon personal inspection of the surrounding neighborhood, it appears that other parcels have non-conforming side yard setbacks similar to-that of the subject accessory garage. 4. Town .Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing a second story addition to a pre-existing accessory garage having a 2.9 foot side yard setback, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Dantes, and duly carried, to GRANT, the variance as applied for, and shown on the survey of the property prepared by John T. Metzger, L.S. dated November 10, 2014, and the architectural drawings prepared by Mark Schwartz, Architect and dated 01/20/2014 pages 1-4. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan andlor survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize 'or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. The foundation as it existed and the existing framing on the back part of the garage was not sufficient to hold the proposed build. It was crumbling, compromised and rotted. The new foundation replaced the old existing, with one suitable to support the new proposed structure. Enclosed please find pictures of the rotted wood (sills) and crumbling foundation. This damage was discovered in the back 8' by 14' part of the area of the garage. Additionally, the building department permit, expires this year on the 19th of December, I mistakenly assumed that was also the expiration date of the variance. It was brought to my attention that the variance expired 9/15/2023. 1 am respectfully,asking for an extension, so that the de minimis can be approved. The work is complete. We have passed all of the required inspections with the exception of the C/O. The stated modifications were necessary for viable build. Thank you for your consideration. I live at 4910 Pequash Ave. Cutchogue NY and have resided here since 1995. In 2015. We were approved for a variance. My health was not good, I had recently been diagnosed with Multiple Sclerosis and we needed more storage, so that my husband could work from home to help care for me. We were slow to get started as we were dealing with many things. Then, in 2017, 1 had a Sub arachnoid brain hemorrhage. This, again, put our plans on hold. Then COVID hit and it seemed it would never happen. At the time my variance was granted, I was told it was forever, so we were not worried about when we began. I believe back then, variances, once granted, were forever, but that year, things changed. Anyway, when I contacted the building dept to ask how we should proceed. We found out we needed to start over. This is overwhelming to us. Ive have felt with so much. I have begun the process with the building dept, but was hoping, based on all of the medical emergencies, you could consider granting an extension? I know it has been a while: I am finally healthy enough to move forward. I can provided medical documentation for everything stated above. Please take this into consideration. Going through the process again seems like an enormity. The footprint of the build has not changed. My neighbors are all supportive and ok with the build. Please let me know. The new construction will not extend beyond the existing nonconforming side yards which have existed for over 40 years. 4. The difficulty was self-created when the dwelling was built many years ago close to the property lines. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of second -story additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
