PROPERTY FACTS/DESCRIPTION: The property is a 23,396 square foot lot located in a B District. The lot runs 100 feet along the Main Road (S.R. 25). The lot runs 306.59 feet on the East Side, 50 feet on the North side, and 325.51 feet on the West side. The property is improved with a 1 '/2 story brick building, a garage, and a play house. All is shown on a survey by John T. Metzger L.L.S. dated March 18, 2014 and updated April 9, 2014. BASIS OF APPLICATION: Request for Variance from Article IX Section 280-49 (Bulk Schedule) and the Building Inspector's April 24, 2014 Notice of Disapproval based on an application for building permit to construct additions and alterations to an existing business building, at; 1) less than the code required side yard setback of 25 feet. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to an existing building with a side yard setback at +/- 3.9 feet. ADDITIONAL INFORMATION: During the hearing testimony was taken that the applicant plans on raising the ridge on the roof of the work shop 4 feet to a height of 22 feet 6 inches. The higher ridge will provide the applicant with more storage space. The Zoning Board requested comments from the Planning Board, and in a memo dated June 3, 2014, the Planning Board stated, "since the existing footprint of the building is not increasing, they generally have no objection". FINDINGS OF FACT/ REASONS FOR BOARD ACTION: a Page 2 of 3 — June 19, 2014 ZBA#6755 — VonEiff SCTM# 1000-45-4-5.1 The Zoning Board of Appeals held a public hearing on this application on June 5, 2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of residential and commercial buildings. The existing work shop is in its current location. The raising of the work shop's existing roof ridge will not increase the existing non -conformity. The new height of the work shop's roof ridge is lower than the roof ridge on other parts of the existing building. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the side yard setback is existing and the proposed additions and alterations will not change the foot print of the existing building. The existing non -conforming side yard setback causes any proposed additions and alterations to require an area variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 84% relief from the code. However, the alteration of the roof line will not change the nonconformity of the existing structure. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install leaders and gutters. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a higher ceiling in the work shop while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, and shown on the survey by John T. Metzger L.L.S. dated March 18, 2014 and last updated April 9, 2014 and Architectural plans prepared by Nancy Dwyer Design Consulting Inc. pages 1-6 and dated April 9, 2014. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals.
