Adoption of Meeting Minutes:  Acceptance of LPC meeting minutes from October 28, 2014 MOTION made by Sam McCullough, seconded by Maureen Cullinane, to accept the October 28, 2014 LPC meeting minutes. Motion carried: 4/0 (Eric Keil and Anne Murray not present at time of vote.) Land Preservation Applications and Inquiries:  SCTM #1000-97.-1-12.7 (CALABRESE) Status Update re: NYS Dept of Ag & Markets grant award Review access proposal Melissa Spiro, Land Preservation Coordinator, met with John Calabrese and Richard Pugliesi along with Planning staff concerning access to the Calabrese residential home on the subject property. Mr. Calabrese suggested that he could give an easement to Pugliese over his property within the 50± foot wide area to Main Road in exchange for an easement over the 80,000 square foot area of the Pugliese property fronting on Bridge Lane. LPC favorable to proposed easements.  SCTM #1000-20.-3-6.2 (EDWARDS) Review application status PLT is facilitating preservation as landowner desires to sell entire property, not just development rights. Tim Caufield and Luke McKay of PLT presented proposal for PLT to purchase restricted land with Town purchasing development rights easement. PLT would hold land for 5-10 year timeframe, if necessary, to try to work with adjacent landowner also in order to keep existing farmed property in agriculture. MOTION made by Maureen Cullinane, seconded by Peggy Dickerson, to recommend to the Town Board that a purchase offer be made to the landowners, Elbert & Heddie Edwards, for the purchase of a development rights easement on property identified as SCTM #1000-20.-3-6.2. A discussion concerning possible scenic and ag structure placement restrictions will be held at a later date. Motion carried: 4/0/1 (Sam McCullough abstained; Eric Keil not present at time of vote.)  SCTM #1000-73.-1-1 & 73.-2-4 (N&L PROPERTIES aka Subdivision Map of The Vines) Review application status Status update re: NYS Dept of Ag & Mkts grant award The Committee discussed ordering an appraisal to establish the appraised value of the proposed development rights easement as shown in the current design (basically the five proposed residential lots on the west parcel and one residential lot proposed on the east parcel and the agricultural “winery” area) to assist the LPC in determining whether or not to proceed with the application proposed for the Town to purchase a development rights easement. The LPC decided to proceed; however, asked Melissa to make it clear to the landowner that ordering an appraisal does not mean that the Committee/Town is committed to making an offer to purchase the development rights easement as proposed, or at the appraised value. Once the committee receives and reviews the appraisal, a determination will be made as to whether or not the Committee/Town wishes to pursue preservation of the subject property, whether or not there is funding available, and if so, what the purchase offer should be. Melissa gave overview of NYS Dept of Agriculture and Markets grant award status. It is unlikely, due to proposed subdivision design, that this project will meet the requirement for the grant funding. MOTION made by Sam McCullough, seconded by Maureen Cullinane, to direct Melissa Spiro, as Land Preservation Coordinator, to commission an appraisal to determine value of the proposed development rights easement, identified as SCTM #1000-73.-1-1 and #1000-73.-2-4. Motion carried: 5/0 (Eric Keil not present at time of vote.)  SCTM #1000-35.-2-1; 11; 12; 17.1 (ISLAND’S END GOLF CLUB & KING TRUST) Review information presented by applicant Not discussed due to time constraints.  SCTM #1000-75.-6-6.1 & 6.2 (LITTLE BEAR REALTY) Review application status Melissa Spiro recently learned from Randy Parsons of TNC that the property is currently under contract for sale to a private party.  SCTM #1000-101.-2-19.1 (MALKASIAN) Inquiry re: potential acquisition Not discussed due to time constraints. Applications & Inquiries for Uses or Structures on Preserved Property:  SHOWALTER (f/k/a Pindar Vineyards, Mattituck) Review request to revise Manure Plan Melissa explained that the ZBA recently granted Special Exception Permit with several conditions, one which referenced Land Preservation Committee approval and another which referenced horse manure removal as per a plan submitted by Showalter Farms, LLC, to the LPC dated November 21, 2013. After the ZBA approval, the LPC received an e-mail request from Joanne Showalter to revise the Manure Plan to reflect a change from manure removal every 2 days to at least once per week assuming no severe adverse conditions. The LPC reviewed the request and the original LPC approval dated January 7, 2014 (letter dated January 8, 2014) and decided not to amend the Manure Plan, but rather to eliminate the reference to the Horse Farm Grazing and Pasture Management Plan, and thus the Manure Plan, as it had not been the LPC’s intent to review or require manure management or some of the other items in the referenced Plan. MOTION made by Anne Murray, seconded by Maureen Cullinane as follows: Whereas, the Land Preservation Committee Members, in accordance with Section 70-5 C. (2) (a) \[3\] of the Town Code and the recorded easement for the subject property, reviewed a proposal with additional supporting information in 2013; and Whereas, the Land Preservation Committee passed a motion approving the proposal on January 7, 2014, and this motion was documented in a letter dated January 8, 2014, from Melissa Spiro, Land Preservation Coordinator; and Whereas, the Land Preservation Committee’s January 7, 2014 motion and January 8, 2014 letter made reference to both a November 21, 2013 Horse Farm Grazing and Pasture Management Plan and a December 27, 2014 Natural Resources Conservation Service (NRCS) Prescribed Grazing Plan; and Whereas, it was the Land Preservation Committee’s intent to refer to the December 27, 2014 NRCS only as supporting Prescribed Grazing Plan for purposes documentation that the subject property contained sufficient land to handle the number of proposed horses; and Whereas, the November 21, 2013 Horse Farm Grazing and Pasture Management Plan was a did separate document prepared by Showalter Farms, LLC, and the Land Preservation Committee not intendrequired for the items listed within this document to be referenced as by the Land Preservation Committee; and did Whereas, the Land Preservation Committee intend to approve the items listed as Numbers 1 – 8 in the January 8, 2014 letter as repeated here without change: 1. Four (4) separate Stall Stables; a. Two with 2 stalls each, each 10’ by 24’ in area. b. Two with 4 stalls each, one 15’ x 48’ and another 24’ x 30’. The 4 stall barns are located on the southwest corner of the Easement Area as shown on the survey dated 11/20/2013. 2. A courtyard as shown (handwritten) on the survey which will include cement walkways between the buildings. 3. An area for sacrifice paddocks, as shown (handwritten) on the survey, to the east of the proposed barn stalls. 4. A grass training area of approximately 156.5’ by 70 feet, as shown in the southeast section of the property. 5. Thirteen (13) paddock areas, some with run-in sheds. It is understood that this is an estimated number and more may be installed in the future. 6. Electric and water trenching to improvements and to paddock areas. These improvements are not shown on the survey, but are proposed. 7. A manure dump trailer, shown (handwritten) west of the northern most stall. 8. Your proposal includes a Horse Farm Grazing and Pasture Management Plan and a NRCS Prescribed Grazing Plan. In a NRCS letter dated December 27, 2013 it is noted that the Prescribed Grazing Plan indicates that there is sufficient land to handle the stocking rate of 30 horses. RESOLVED Be it therefore , that the Land Preservation Committee revise the January 7, 2014 motion to read as follows: The Land Preservation Committee approves the use of the property for boarding, breeding, raising and training of approximately 30 horses and for the proposed improvements and uses as noted above. The Land Preservation Committee is not limiting the property to the above mentioned improvements; however, any proposed changes or additional improvements proposed for the property are subject to Land Preservation Committee review and approval. This property is subject to a recorded Development Rights Easement. All uses and improvements must be consistent with the terms of the Easement and are subject to inspection by the Grantee (Town of Southold) as per the terms of the Easement. Motion carried: 6/0  DOWNS FARM PRESERVE Group for East End /TOTC Mile-a-Minute pull LPC is favorable to request of Group for East End/TOTC Mile-a-Minute pull at Downs Farm Preserve. Stewardship and Management: th  TOWN BOARD NOV 5 WORK SESSION ITEM: MANAGEMENT PLANS FOR TOWN PROPERTIES Update from John Sepenoski, LPC Chairman o LPC Chairman John Sepenoski gave report on 11/5/2014 Town Board work session discussion concerning Management Plans for Town-owned properties as the DEC has requested a more formal deer management plan. Management Plans for each of the Town- owned properties will go into further detail relating to an overall deer management plan, typical trails, and updating plans that have already been adopted by the Town Board. John Sepenoski has volunteered his time and service to prepare these plans/updates. Detailed projects for Town-owned properties are to be reviewed and Jim McMahon (DPW) will oversee the approved projects. NFEC correspondence o Melissa Spiro responded via telephone to William Toedter, President of North Fork Environmental Council, concerning his letter dated November 10, 2014, as his letter incorrectly stated that deer management will not be allowed on Sinatra property. Acquisition has not occurred yet; however, nothing in the manner by which the Town intends to acquire property prohibits deer management should the Town wish to include the property in its program. General Land Preservation Items:  FINANCIAL UPDATE \[executive session\] Melissa Spiro, Land Preservation Coordinator, gave LPC financial update on LPC applications and CPF funding availability.  REVIEW PROCEDURES FOR POTENTIAL RANKING OF PENDING APPLICATONS Not discussed due to time constraints. Addition to Agenda:  TRANSPORTATION COMMISSION INTERPRETIVE SIGNS (per Supervisor Russell) Supervisor Russell explained the grant that that Transportation Commission received years ago for the placement of several interpretive signs throughout Southold Town, which included 7 signs and 3 kiosks. Three signs slated for Town preserves were found to have inaccurate information, or preserve names have since changed. The Supervisor suggested meeting with Neb Brashich (and others) of the Transportation Commission to discuss relocation of kiosk signs. LPC Chairman John Sepenoski will serve as liaison for preserves. Next Regular Meeting: Tuesday, December 9, 2014. The next regular meeting will be on Lillian Ball and Sam McCullough will be unable to attend this upcoming meeting.
