RESOLVED that the Town Board of the Town of Southold hereby ENACT the proposed Local Law entitled, "A Local Law in relation to Amendments to Chapter 280, Zoning, in connection with Time Limits on Variances" reads as follows: I LOCAL LAW NO. 2014 A Local Law entitled, "A Local Law in relation to Amendments to Chapter 280, Zoning, in connection with Time Limits on Variances". BE IT ENACTED by the Town Board of the Town of Southold as follows: 1. Purpose. The Town Board of the Town of Southold has determined that variances which are not acted upon within a reasonable time may become stale and incompatible with the surrounding community due to changed conditions. Therefore, the Town Board,upon the recommendation of the Board of Appeals, in order to protect the health, safety and welfare of the community, requires that variances have a limited duration of three (3) years, with the possibility of three (3) consecutive one (1) year extensions at the discretion of the Board of Appeals. 11. Chapter 280 of the Code of the Town of Southold is hereby amended as follows: §280-146. Powers and duties. B. Variances: Where there are practical difficulties or unnecessary hardships in the Southold Town Board Meeting 8 December 2, 2014 way of carrying out,the strict letter of these regulations,the Board of Appeals shall have the power to vary or modify the application of such regulations so that the spirit of this chapter shall be observed, public safety and welfare secured and substantial justice done. Effective as of January 1, 2015, @Lny variance granted by the Board of Appeals shall become null and void where a Certificate of Occppancy has not been procured, and/or a subdivision mqP has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals mqy, upon written request prior to the date,of expiration, grant an extension not to exceed three (3) consecutive one (1) ye terms. 111. SEVERABILITY If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. EFFECTIVE DATE This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law. She says, I did not see the girls name on the civil service list. She is referring to the designated appointee. This is Southold Town Board Meeting 11 December 2, 2014 in reference to Justice Court Director, we have an objection from someone who couldn't make it tonight and I would just like to read her statement. She references I did not see the girls name on the civil service list�, the Town Board and the Town Justices are not being fair to Kendra. She is an employee of the Justice Court. I think you should rethink this decision. Also, you might - want to look into how many people of color work for the Town. Kendra has been there for 14 years. She has requested to be promoted and when my mom retired and was not, she has been doing this job for years not being recognized and would be glad to have it for$63,000 per year. Conrad Flower, Cutchogue Southold Town Board Meeting 24 December 2, 2014 CONRAD FLOWER: Conrad Flower, Cutchogue. Good evening Board. I was here two months ago about the short term housing business that is getting larger by the moment. At that time the Board was going to review the East Hampton's laws that whatever, do you have any findings or any progress or whatever? SUPERVISOR RUSSELL: We've actually met several times to discuss it. We just had a Code Committee meeting about a week ago. We certainly have looked at the codes from other towns, we are trying to be thoughtful,,and deliberately understand these issues need to be resolved soon, we also want to make sure that we pass a code that is not just enforceable but that's fair. We are certainly well aware of it. MR. FLOWER: Okay. Are there any other Board's I should address? SUPERVISOR RUSSELL: Well,this Board would be the decision makers. MR. FLOWER: Okay. 'The house next to me (inaudible) but the-house next to me has bookings already for next July and August. We need the legislation done this winter, hopefully it doesn't drag on and I feel for the residents around Vineyard 48, we are in the same situation but on a much smaller scale. We don't have busloads of people coming in but we do have four or five cars showing up and you know, it's a party atmosphere with these short term renters. Unfortunately the police do not deem,this a high priority, I do call the police in the middle of the night. It takes them an hour to show up and the damage is already done because now I am aIr eady awake for two hours or whatever, my quality of life and other people's I am sure that even the Board or whatever, it is affecting our quality of life. If and when you do pass these laws or regulations, whatever penalty you attach to these laws, I hope you make it at least $300. If an individual is renting a house and getting $600 for the weekend and you give them a $50 'fine, well, $550 is still a good profit, it is not good for me but it's good for them. I am just thinking of it too, if you let people do this kind of thing where these party people just come out for the weekend, right, you are going to have to put on more police, increase your budget because there is going to be more nonsense going on. Thank you. SUPERVISOR RUSSELL: Yes, thank you. Actually,just a couple of things. We are aware of some of the businesses that are already taking reservations for next year. The code needs to act. How we are going to act that's part of the discussion now but we clearly know something needs to be done. But anybody that is taking bookings now or reservations now, they are still going to be encumbered by any new code. That doesn't exclude them from any code that comes. The new code would apply to them just like anybody. Thank you. COUNCILMAN RULAND: I would just like to say that part of this process is that we have had, as the Supervisor said, we had several meetings with the Town Attorney's office and other interested parties and drafting a code and there is going to be a point in the, I hope, not that distant future, where we will have a final draft, we probably have one more code committee meeting and then we will have a draft that we are going to present for public hearing. Most important process and I li�ve stated that and I feel strongly about this, is that any draft that we put forward, I am most interested to hear the public comment at the public hearing because that Southold Town Board Meeting 25 December 2, 2014 is the most important time and this will be properly advertised so that people will know that on a certain day, at a certain Town Board meeting that we are going to have a public hearing on the proposed draft code that we have and I will say that it is to me just a draft, we will do our best to present something but I feel strongly that if enough people have strong, strong comments, that we might have to go back and redraft something because it might not be deemed strong enough or it might be deemed too strong but I think that the public's input into this is maybe far more important in this issue than for us to tell the public. We want to hear from the public because they are the ones affected by this. This came, this problem came from the public, we didn't really initiate it. people came forward and said we have a problem and at this point, we have spent a fair amount of time doing the research, the Town Attorney's office has spent a fair amount of time doing the drafting, looking at the things and saying what will work for Southold and I am confident that when we come forward and I emphasize the word draft because it is kind of unusual that the public hearing part comes at the end of the process, in many ways it should probably be at the beginning of the process but I think that in this case, as controversial as it is, that the public comment will be extremely important and while some people would say well, I want you to have the public hearing and adopt it that night, I won't be naYve enough to say that I might have to say that we are going to take a little more time because those comments are justified and we may need to alter what we have presented. But I think I am flexible enough to know that I want to hear from you people in the official setting of the public hearing. Because it goes into the record and it is permanent forever. And whatever we do, it may be the right thing. Six months down the-road, it may have to be changed but I am open minded enough to say we are going to start somewhere and if that doesn't work, we are going to have to do something else. SUPERVISOR RUSSELL: I would just want to comment as a general comment on violation fees, the one lesson we have learned over the years is that you can't set fees or violations so low that it gets absorbed in the cost of doing business. Generally what we have been doing in the past few years when we legislate, we put in a graduated scale, first offense, second offense, third offense, to make it more of an enforceable item. Would anybody else like to address the Town Board on any issue? Benja Schwartz, Cutchogue BENJA SCHWARTZ: Well, if nobody else, I would like to talk a bit tonight. How are you doing? SCHWARTZ: Well, you know, I was a little late tonight, I was thinking about not coming. Pretty damn cold and rainy out there but it's according to the computer on my dash board, it says 42 degrees, so I guess it's not going to snow. Anyway, what, the meeting went very fast today and I was a little late, I apologize, I didn't get here in time for the resolution on the appointment of the Justice Court director, was there any discussion on that? Southold Town Board Meeting 26 December 2, 2014 SUPERVISOR RUSSELL: I read a comment from someone from the public who couldn't make it this evening, so I read her comment for the record. That would be Jill Franke. MR. SCHWARTZ: But did you have any comments? Because I feel that's a major step for Southold Town to appoint a Justice Court director. SUPERVISOR RUSSELL: As do we. MR. SCHWARTZ: And is there anybody on the Town Board that would like to discuss that? you had a discussion this morning I understand. SUPERVISOR RUSSELL: Work session, yes. Again, interviews and then the discussion this morning but we did interview candidates first. MR. SCHWARTZ: But but you don't have anything to help the public understand why the Justice Court is now being you know, this is a big change in the organizational structure of the town to administer the Justice Court via a separate administrative director rather than have the judges do it themselves as part of their responsibilities. COUNCILMAN RULAND: I certainly don't disagree with you but by the same token, given the events of the last six or eight months, given the size and the amount of volume in our Justice Court today versus three or five years ago, given the fact that many villages way smaller than us have Justice Court directors, the successful candidate comes from a village justice court with a lot of experience and I think that it's important for Southold, it's important that Councilman Dinizio and I sat in on all the interviews of all the candidates and there was a great cross section of people who were qualified either on a civil service list or serving as justice court director in another jurisdiction and in some ways, it was a difficult decision to come down to a candidate but in the end, the most qualified candidate came forward and there is no question in my mind that in this case, it's the right decision and the right person for Southold. We could be wrong, the Town Board, as the Supervisor has said, has every indication to follow the progress from day one because the Justice Court director will report directly to the Town Board. MR. SCHWARTZ: Well, I wish, I hope that it's a successful move. COUNCILMAN RULAND: As do 1. MR. SCHWARTZ: I don't want to take a long time but I have in the past have talked about how we don't really have an organizational chart of the town government and despite my efforts to develop such a chart and make the operation of town government more according to a plan rather than many different people and I can understand why different people would be having a lot of different voices and different authorities involved and it's another way to do it, that's the way it was always done but we are moving now towards a world in which I think the individual is less important and in order for the public to understand how government works and to work with government, I think we need to coordinate our activities with plans rather than just have individuals out there. And this is a step in that direction, having a justice court director, would Southold Town Board Meeting 27 December 2, 2014 certainly be more accessible and more transparent than having the judges themselves do it. In addition tonight, you appointed a town engineer and I am not sure I understand exactly what the story is there, I always got the impression that Jamie Richter was the town engineer, was he the previous town engineer? SUPERVISOR RUSSELL: We have two. Jamie Richter and Michael Collins. The resolution that was on the agenda is actually a promotion for Michael Collins. It is not a new position, it's merely a promotion to a new title. MR. SCHWARTZ: So now he and Jamie are at an equal level? SUPERVISOR RUSSELL: They work very well together as a team. MR. SCHWARTZ: Are they both getting the same amount of pay? SUPERVISOR RUSSELL: The pay scales differ based on the salary schedules over the years. COUNCILMAN RULAND: Each of the gentlemen, Benja, have different professional credentials. One is an architect and one is an engineer. MR. SCHWARTZ: Well, it is getting late. It's almost 8:00.
