PO Box 2003 Bridgehampton, NY 11932 RE: GEORGE HALKIDIS 1600 GREENWAY EAST, ORIENT SCTM# 15-2-7 Dear Mr. Anderson: The Southold Town Board of Trustees reviewed the site plan, supplemental materials supplied by the applicant consisting of a copy of the approved subdivision map for "Green Acres of Orient," a construction photo of the adjacent pond at the Board's 12/10/14 work session and a field inspection performed by the entire Board of Trustees, and determined the proposed construction of a single-family, two-story dwelling with a 2,800sq.ft. footprint, attached 720sq.ft. deck, new sanitary system and new driveway are out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. We find that the activity proposed is exempt from the provisions of Chapter 275 of the Town Code pursuant to 275-4(g) in that a man-made pond exists on the adjacent parcel as defined by 275-2. The water body's history and dedication as a subdivision "leaching area" and the straight-sided steeply sloped embankment shoreline noted at the field inspection was devoid of any emergent freshwater wetland vegetation Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees 2 pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. Request for a Letter of Non Jurisdiction is hereby made based upon the information and evidence that determinesthe adjacent surface water area to be a constructed, manmade pond or recharge basin., as that tease is defined in Section 272-2 of the Town Code (Man-made fond). '� n support of our request for a Letter of Non Jurisdiction, please find an aerial photograph taken in 1962, which depicts the initial construction of the subdivision road (Greenway East), the constructed,man-made pond,which depicts the linear,,straight-line,configuration of the 'shoreline/pond edge and, spoil deposition area adjacent to the leaching area. Also enclosed herewith,please find a copy of the subdivision map, Gmen Acres of O lent,filed April 13, 1962 (file number 3540; abstract number 3939). The subdivision map depicts the pond' and leaching area. As a final matter, field inspection revealed the straightened shoreline of pond/leaching area to be vertical due to its prior construction and a substantial storm-water culvert installed at the road shoulder extending into the pond/leaching area/recharge area. The culvert directs stormwater from the paved surface of Greenway East to the pond/leaching area. It is apparent that the culvert was installed in connection with the construction of the subdivision road.. Based upon the foregoing(aerial photograph depicting unnatural shoreline and spoil deposition area, subdivision map which depicts pond and leaching area, and field conditions, installation of culvert and lack of natural shoreline), it is our contention that the surface water area adjacent to subject premises is a'constructed,' man-made pond, constructed stormwater retention pond or recharge area, not subject to Section 272 of the'Town Code.
