All that certain plot, piece or parel of land, with the
buildings and improvements thereon erected, situate, lying
and being at Indian Neck, near Peconic, Town of Southold,
County of Suffolk, State of New York, bounded and described i
as follows: BEGINNING at the corner formed by the
intersection of the Southerly side of Indian Neck Road with
the. westerly side of said Indian Neck Road;
RUNNING THENCE South 26 degrees 28 minutes 50 seconds East
along the westerly side of Indian Neck Road, 128 feet;
THENCE South 63 degrees 31 minutes 10 seconds West, 190 feet;
THENCE North 86 degrees 47 minutes 10 seconds West, 121 feet;
THENCE North 21 degrees 20 minutes 50 seconds West, 225. 05
feet to the Southerly side of Indian Neck Road;
THENCE South 73 degrees 37 minutes 0 seconds East along the
Southerly side of Indian Neck Road, 68 feet;
THENCE North 89 degrees 31 minutes 30 seconds East still
along the southerly side of Indian Neck Road, 250.50 feet to
the corner, the point or place of BEGINNING.
SUBJECT to a 12 1/2 foot wide right-of-way over the westerly
line of the subject premises for ingress and egress and
utility service to and from other lands owned by the party
of the first part, which right of way is more particularly
shown on a minor subdivision known as High House Woods,
approved by the Southold Town Planning Board on August 20,
1980, as mapped by Roderick Van Tuyl, licensed land
surveyor. The Subject premises are known and designated as
Lot # 3 on the above referenced minor subdivision.
Together with a right-of-way to Peconic Bay for bathing
purposes, over other lands of the grantors herein designated
as Parcel I on a minor subdivision known as High House
Woods, prepared by Roderick Van Tuyl amended March 18, 1980
which subdivision was approved by the Southold Town Planning
Board on August 18, 1980. Said right-of-way is more
particularly shown on a survey which is annexed hereto and
made a part hereof. Said right-of-way shall be for
pedestrian use only and no trees shall be removed by the
grantee within the confines of the right-of-way, nor shall
any lights be installed. The grantees also agree to pay
their pro-rata share of that portion of the bulkhead repair
which fronts on the right-of-way along with owners of
parcels 1 & 4 on the above referenced subdivision. The
right-of-way to Peconic Bay for bathing purposes shall
include the right to use the 25 foot strip of beach for sun
bathing, the beaching of small water craft, and the right to
construct steps to the beach.
