Box 1179 Southold,NY 11971 Re: Joseph Brantuk and Patricia Brantuk Dear Chairman and Members of the Board: I would ask that you promptly re-notice the dock application for my clients, Joseph and Patricia Brantuk. As I have indicated at the last attended Trustees Work Session meeting,my clients have appeared before the Town's Planning Board and have reached an agreement with the other lot owners,including Doctor Nancy Pearson,to proceed with an application process based upon a plan prepared by Young & Young providing a 40 foot width at the water's edge. The agreement would require an alteration of boundary line approval from the Planning Board and the Trustees waiver of a provision that calls for a minimum clearance of 15 feet of the seaward extension of any property line from all vessels tied to the proposed dock. Ultimately,the existing 50 foot right of way,which provides more than 100 feet of width at the water's edge,would be modified consistent with the Young & Young survey plan showing a reduction of the 50 foot right of way to 25 feet for a distance and expansion of 40 feet as the property gets closer to the water's edge. Deeds would ultimately be passed extinguishing any rights of way over part of the now 50 foot right of way and in return Dr. Nancy Pearson will deed over fee title to the remaining right of way to my clients,the Brantuks. I have made several appearances before the Planning Board and cannot reasonably submit the alteration of boundary line map until I know that the Trustees would approve the location of the dock with a 40 foot restriction at the water's edge as now requested by Dr. Pearson. Pearson, Timothy Coffey, and Stanley and Doreen Freedner, the parties have agreed to decrease the width of an existing right of way and to alter the boundary of the properties of Brantuk and Pearson. The Planning Board had previously listened to a discussion of this issue with Dr. Pearson and Mr. Brantuk in attendance. i believe this matter can be internally handled by the Planning Board with a simple resolution of approval, inasmuch as we will only be transferring a small piece of property from one property owner to the other. Please advise if anything further is required. As you may know, a dock application filed with the Board of Trustees by the Brantuks has not moved forward as my clients, the Brantuks, have attempted to work out an agreement with Dr. Pearson regarding the existing right of way. Brantuk and Patricia A. Brantuk dated January 3, 2005, as well as a copy of the original recorded deed into the Brantuks. You will notice the description providing the right of way to Richmond Creek. I also provide a copy of the deed out of the original developer, Mohring Enterprises, Inc. to a predecessor in interest, the Scopazes, with regard to the same Lot No. 2. Note the language as highlighted, "The right of way to Richmond Creek set forth above shall include the right to construct a dock in common with others who use said right of way". Those lot owners on the Mohring subdivision were provided access from the main road to Richmond Creek, and the descriptions on the deeds should be similar, in that they are together with and subject to the access right of way. In an effort conserve waterfront space our client is proposing a single dock to be used by multiple property owners. This will eliminate the future proposal/construction of additional docks in this area. During the initial construction there will be a disturbance to the ecosystem but this area will easily re-establish itself within one season. This is a waterfront piece of property. With the addition of this dock facility the property owner will be able to access his boat to engage in water-dependent activities such as kayacking, fishing, site seeing, water-skiing and swimming. Policy 11 Promote sustainable use of living marine resources in the Town of Southold. Our proposal is minimal in size so there won't be much impact on the living marine resources. The dock will be only be 4'wide minimizing the shading of the existing vegetation. The structure will also be constructed a minimum of 3 1/2 feet over grade allowing for significant sunlight penetration. With adequate sunlight penetration, the wetlands will continue to thrive allowing them to maintain their function of providing food and shelter for small fish. Deeds would ultimately be passed extinguishing any rights of way over part of the now 50 foot right of way and in return Dr. Nancy Pearson will deed over fee title to the remaining right of way to my clients,the Brantuks.
