SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 31, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject parcel is located in the A-C zoned district and is conforming with 9.5 acres. The parcel contains the following improvements: one and a half story home with a covered porch, two accessory barns one with attached pool house, an accessory garage, an accessory in-ground swimming pool, accessory raised solar panels, and an accessory two story building with attached carport. It is an irregular shaped parcel with 108.00 feet of frontage on Bridge Lane, 1063.48 along the southern property lines, 665.43 feet along the western property lines and 758.33 feet along the northern property line as shown on the survey dated April 15, 2014 prepared by John T. Metzger, LS. BASIS OF APPLICATION: Request for Variances from Art. III, Sections 280-14 and 280-15 and Article XXIII Section 280-122A and the Building Inspector's September 8, 2014 Notice of Disapproval based upon an application for a building permit for "as built" additions and alternations to existing single family and accessory structures, at 1) (dwelling) less than the code required single side yard setback of 20 feet, 2) (pool house) location other than the rear yard, 3, (garage) location other than required rear yard. RELIEF REQUESTED: Applicant requests variances for `as built' additions to the existing dwelling with a single side yard setback of 6.7 feet where the code requires 20 feet. Due to the addition on the dwelling, it placed the accessory `as built' barn/pool house in the side yard where the code requires accessory structures to be located in the rear yard. The `as built' addition to the existing accessory garage is non-conforming because it is located in the side yard, where the code states no alterations that create new non-conformance. Page 2 of 3—December 18,2014 ZBA#6813—McGuire SCTM#1000-85-2-3 ADDITIONAL INFORMATION: The subject owner of the 9.5 acre parcel was represented at the hearing by an Architect, who indicated that the applicant is a collector of antiques, and that is the reason for all of the storage buildings existing and the new two story building with carport. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 4, 2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b M. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The immediate neighborhood is comprised of older homes which lie on smaller one family building lots. The subject property is 9.5 acres in an AC District with significant screening around the entire parcel. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling and accessory buildings have existed in their current location since prior to zoning. The buildings are located on the property where any additions would require a variance. Moving them would be costly. The subject property was a prior farm with much natural screening from all property line locations. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 66% relief for the side yard setback and 100 % for accessory structures not permitted in the side yard. However, the property is well screened and the structures have existed without complaints since prior to zoning. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The applicant should have filed for a building permit and subsequent C of O for each addition or improvement made to the primary and accessory structures at this premises. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an improved dwelling and legal accessory structures while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variances as applied for, and shown on the survey prepared by John T. Metzger, LS dated April 15, 2014 and the architectural drawings prepared by Keri Kazel, Architect dated June 23, 2014, sheets Al-A11. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when Page 3 of 3—December 18,2014 ZBA#6813—McGuire 5CTM#1000-85-2-3 involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. I admitted myself to dwelling with key provided by Richard Poster and began this inspection at approximately 1:15 P.M. The building is in the process of being renovated, but the room consistency amounts to four total rooms, one of which is a bathroom which is completed with all the required plumbing fixtures. One of the rooms is suitable for use as a bedroom. There are kitchen cabinets, a sink, and a gas range in the building which have not yet been installed. The building does not have a central heating system; however, there is a furnace in a carton located in the cellar. The building is constructed on a stone and masonry foundation with a partial full cellar. There are four additional buildings on the property which are used for farm use. One large building was constructed under Building Permit #33002, dated Novem- ber 2, 1966, to which Certificate of Occupancy #22647 was issued on January 31, 1967. The following violations of the Housing Code, Chapter 52, Town of Southold, New York, were found: Cellar - electric panel box, new circuits added to box, no connectors and ground wire not connected, Article V, Section 52-56 A (1) . Gas fired, hot water heater, vent pipe connection at chimney requires seal, Article V, Section 52--54 A (1) . Accessory building - north end of property, opening in roof, ceiling weak and sagging, opening at the east side of building, and sill and floor• joists on east side of building deteriorating, Article III, Section 52-31 B & C, Section 52-32 A.
