SUFFOLK COUNTY ADMINISTRATWE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 31, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 10,078 square foot lot located in an R-40 Zone. The parcel runs 70 feet along Sound Road. The parcel runs 144.15 feet on the South side, 70 feet on the East side, and 143.80 feet on the North side. The parcel is developed with a 1 'h story house and a 2 story garage. The existing house is set back 19.8 feet off of Sound Road. All is shown on a survey prepared by John T. Metzger L.L.S. dated September 25, 2014. BASIS OF APPLICATION: Request for a variance from Art. XXIII Section 280-124 and the Building Inspector's July 16, 2014 Notice of Disapproval based on an application for a building permit for a deck addition to existing single family dwelling, at 1) less than code required front yard setback of 35 feet. RELIEF REQUESTED: The applicant requests a variance to construct a 10' by 10' deck with gazebo set on top of it to serve as a front entrance to his house, set back 9.8 feet from sound road where 35 feet is required. ADDITIONAL INFORMATION: A letter of support was received from a neighbor. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 4,2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 2 of 3—December 18,2014 ZBA#6812—Herman SCTM#1000-35-1-17 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of smaller lots with homes that have non-conforming setbacks. The gazebo deck is a front entranceway to an existing home. This new front entranceway will be consistent with the front yard setbacks of the homes on either side of the applicant's property. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing home has a non-conforming front yard setback. Any modifications to the front entranceway will require variance relief. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 72%relief from the code. However, the new front entrance gazebo deck will remain open and is not a conditioned space. Additionally, there is a ten foot +/- distance from the property line to the edge of the paved road which makes the setback appear to be about 20 feet from the proposed gazebo/deck entry. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered front entranceway while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Schneider, and duly carried,to GRANT, the variances as applied for, and shown on the building plan by Donald A. Dale and the Survey prepared by John T. Metzger L.L.S. and dated September 25, 2014. Subject to the following condition; CONDITION: 1)The gazebo deck must remain open and cannot be enclosed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. It is our understanding that this"porch"would be situated less than the 35 feet required by the town code as a front yard setback and thus requires a variance. While we understand and respect that codes serve as a necessary societal construct there are, of course, provisions for variances exactly so that individual needs, desires and styles may also be accounted for— especially if there is no harm to society. We hope that Mr. Herman will be given a variance for this project, which honestly will have no negative effect on the neighborhood as it will not interfere with access for city plows, mail delivery vehicles, spring or fall clean-up pick-ups, or any other town service delivery as the distance of setback will still be a good distance from the town road. Additionally, we note that the yard is beautifully landscaped and that the requested construction plan still allows room for trees, shrubs and flowers! We appreciate the board's consideration of our appeal on our neighbor's behalf and thank you for your work on behalf of the town. I reviewed your letter and the Zoning Board of Appeals determination No. 6812,dated December 18,2014, in which the applicant was granted relief for less than the code required minimum front yard setback in order to construct a 10 foot by 10 foot deck with a gazebo set upon the deck at 9.8 feet from the front yard property line. You now request a de minimum determination for an"as built deck and gazebo"that were constructed with a 6.8 foot front yard setback, instead of the 9.8 foot setback that was granted by the Board of Appeals.
