a/ka Edward T. Berkoski,deceased,(Suffolk County Surrogate Court File No. 2014-1838),
Edward Berkoski, being the surviving tenant by the entirety of Tesse Berkoski a/k/a Tess Berkoski,
who died a resident of Suffolk County on December 31, 2002,residing at 1715 Pike Street,
Mattituck,New York 11952, party of the first part;and
SUSAN K.BERKOSKI,residing at 1715 Pike Street,Mattituck, New York 11952,party of the
second part,
WITNESSETH,that the party of the first part, in consideration of Ten and 00/100--($10.00)--Dollars,
and to effect the distribution of the decedent's estate, and other good and valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second
part,the heirs or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land,with the buildings and improvements thereon erected,
situate, lying and being at Mattituck, in the Town of Southold, County of Suffolk and State of New
York, bounded and described as follows:
BEGINNING at a point at the intersection of the westerly side of Mary's Road and the northerly side
of Pike Street,which point is distant easterly 320.45 feet along the northerly side of Pike Street from
the land now or formerly of C. H.Wickham; thence from said point of beginning running along the
northerly side of Pike Street a distance of 70.45 feet to other lands now or formerly of Conklin;
thence running along other lands now or formerly of Conklin in a generally northwesterly direction a
distance of 150 feet to other lands now or formerly of Conklin; thence running in a generally easterly
direction of lands now or formerly of Conklin a distance of 73.05 feet to the westerly side of Mary's
Road; thence running in a generally southerly direction along the westerly side of Mary's Road a
distance of 150.02 feet to the point or place of BEGINNING.
SUBJECT TO Covenants and Restrictions of record.
BEING AND INTENDED TO BE the same premises as described in and as were conveyed to
Edward Berkoski and Tesse Berkoski by deed dated March 25, 1947, recorded in Liber 2689, Page
403.
TOGETHER with all right, title and interest,if any,of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the parry of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read"parties"when ever the sense of this indenture so
requires.
