WITNESSETH,that the party of the first part,to whom letters testamentary were issued
by the Surrogate's Court of the State of New York for the County of Suffolk on
January 31, 2014,
and by virtue of the power and authority given in and by said last will and testament,and in consideration of
THREE HUNDRED NINETY-NINE THOUSAND and 00/100---($399,000.00) dollars,
paid by the party of the second part,does hereby grant and
release unto the party of the second part,the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land,with the buildings and improvements thereon erected,situate,
lyingandbeing at Cutchogue, Town of Southold, County of Suffolk and State of
New York, being known and designated as Lot 2 on a certain map entitled,
"Setoff Map for Robert A. Graeb and Phylis A. Graeb" and filed in the
Suffolk County Clerk's Office on June 2, 1995 as Map No. 9689, being more
particularly bounded and described as follows:
BEGINNING at a point on the westerly side of Middle Road (C.R. 48)
distant 900 feet, more or less, northeasterly from the extreme
northeasterly end of a curve which connects the westerly side of Middle
Road (C.R. 48) and the northerly side of Cox's Lane; running thence North
47° 30' 30" West 1502.65 feet; thence South 42° 29' 30" West 240.43 feet;
thence North 47° 15' 00" West 385.20 feet; thence North 70° 26' 20" East
287.18 feet; thence South 470 30' 30" East 1761.56 feet to the westerly
side of Middle Road (C.R. 48) ; thence South 71° 30' 00" West along the
westerly side of Middle Road (C.R. 48) 17.15 feet to the point or place
of BEGINNING.
SUBJECT TO a fifteen (15) foot right-of-way which is more
particularly bounded and described as follows:
BEGINNING at a point on the northerly side of Middle Road (C.R.
48) ; which point marks the point where the westerly side of land now or
formerly of Stanley Mokus intersects the said northerly side of Middle
Road (C.R. 48) ; running thence from said point of beginning along the
northerly side of Middle Road (C.R. 48) South 710 30' 00" West 17.35 feet
to land of De Art of Nature LLC; thence along land of De Art of Nature
LLC and land now or formerly of Thomas R. Graeb and Diane Graeb North 470
30' 30" West 1502.65 feet to a point; running thence North 42° 29' 30"
East 15+ feet to land now or formerly of T. & E. Shalvey; running thence
along said land now or formerly of T. & E. Shalvey and land now or
formerly of Stanley Mokus South 47° 30' 30" East a distance of 1516+ feet
to the northerly side of Middle Road (C.R. 48) and the point or place of
BEGINNING.
BEING AND INTENDED TO BE part of the same premises as conveyed to
Robert A. Graeb and Phylis A. Graeb, his wife, by deed recorded in Liber
10289 Page 198; Phylis A. Graeb being the surviving tenant by the
entirety of Robert A. Graeb, late of Suffolk County, New York, who died
on August 31, 2004.

TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof;
TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of
decedent's death in said premises, and also the estate therein, which the party of the first part has or has
power to convey or dispose of,whether individually,or by virtue of said will or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the
same for any other purpose.
The word"party'shall be construed as if it read"parties"whenever the sense of this indenture so requires.
