Article III, Section. 100-31, Bulk Schedule of the Zoning Code requires a minimum sid'eyard setbackat the 'easter'ly side ~"at 15 feet (and minimum at. th.e west side at_10".feet), a minimum total sideyard area at 25 feet, and a maximum of 20% lot coverage for all structures. 4. Article XI, Section 100-119.2 of the Zoning Code requires "...all buildings located on. lots ,adjacent to tidal. water bodies...shall be set back not. less than seventy-five' (75') feet from the ordinary highwater mark of such tidal water body or not less than seventy-five (75' ) ,feet from the landward edge of the tidal wetland, whichever is greater.. . 5. It is the opinion of •this board that the practical difficulties demonstrated are not sufficient to warrant a grant- ing. of all the variancesrequested; however, a reducti.on of the square footage to 500 sq. ft. over the 20% maximum-permitted of _ the zoning code (or 431.2 _sq. ft. total ), 'and a reduction of the east sideyard setback to 16` 8" at the northeast corner of :the existing deck (allowing a.: 3' deck) and 71 at the southeast corner of the existing deck (as exists), 'and a straight. line drawn on an angle connecting these two points' (to allow a walk- way from the east side of .the dwelling to the pool and deck area in .question), would not be unreasonable under the circum- stances. In considering this appeal, the board finds and determines: (a) that the relief as requested. is substantial in relation to the zoning requirements, being a variance of 20% over the requirement for total lot coverage; being more than' 35% of 'a variance 'from the sideyard requi.rements;_ and being a variance of more than 40% of the wetland-setback requirements; ' (b) that a reduction as decided herein is not Unreasonable under the circumstances; . (c) that there is no other method feasible for appellant to pursue other than a variance; ' (d) that the public health_, welfare, :safety, 'order and convenience of the town i'll best be served by. allowing.the variances as amended by this board; (e) that by all the variances as amended by. this board, a substantial than a would not be created in the character ofthis neighborhood; (f) that the spirit of the zoning ordinance- and the interests of .justice will best be. served by _granting the variances as amended and noted below. Box 1179 Southold,NY 11971 RE: 1250 Blue Marlin Drive Southold,NY To whom it may concern: At the request of Mario Malerba, I had looked into a complaint made by a prospective buyer regarding mold on some surfaces in the above referenced address. It was reported by the owner that the home has not been occupied for several years and has been closed the entire time. He also stated the building department would like a letter from an architect stating that" I do not find mold to be of any significance". I notified Mr. Malerba that I am not qualified to test or determine significance of mold present, but would look at the issue at hand. Below are my findings: 1. Upon entering the home, visible was a black growth on the walls of the living room up to approximately 14"above the floor. Since the room is"sunken", below the rest of the house, I directed a probe be opened up along the affected areas on the west wall, which coincides with the floor elevation of the rest of the home. There was no such growth on the inner faces of the gypsum wall board on any interior wood surfaces. The growth appeared to be limited to the painted surface of the gypsum wall board. 2. The existing foundation wall extends above the finished floor of the living room approximately 14",and the sole plate rests directly upon the foundation wall. The fumed out wall cavity over the foundation wall in this area was dry and clean of any growth,as wall all of the wood Beaming in this area. No insulation existed in this cavity. 3. In my opinion, the absence of insulation in this area could contribute to the growth of mold and mildew since the temperature difference from the unheated foundation wall and a heated room could cause condensation to form on the surface of the gypsum wall board. This may have contributed to the black growth on the wall surfaces. i 4. I witnessed the removal of the black growth with a household cleaner claiming to remove mold and mildew. This was done throughout the entire living room area to a point of approximately 24"above the floor. There were also suspect areas in the living room,where the wall covering was removed. The same cleaner described above was applied to these areas as well. 5. A recommendation was made,and executed to remove the drywall along the west wall of the living room above the sole plate down above the radiator,and install new insulation in the wall cavity. '/2"moisture resistant gypsum wall board was then installed,and taped and sparkled. This area was chosen as it appeared to be the worst locations. Other areas were superficial compared to the west wall. 6. Suspected growth was also identified in the boiler room along the ceiling and areas surrounding the existing fresh air vent in the ceiling. The temperature differences between the cold attic and warm moist air may also contribute to this problem. I had also witnessed the cleaning of this black growth with the same house hold cleaner described above. 7. The lack of an active ventilation system working in the building over the last several years may have contributed to the conditions presented above. At the time I left the home the suspected black growth had been cleaned in the areas listed above. I had found no evidence of any growth in any areas other than described. No other destructive probes were made anywhere else in the home. I make no warranty or guarantee that this home is free from mold,mildew,or any other harmful substances, and limit my observations and opinions to those listed above. The carpeting was removed,exposing concrete floors below, for a distance greater than 18" from any opening from the fireplace on both sides of the fireplace. 2. The boiler room was cleaned up of any debris and dust on top of the boiler and floor. 3. A layer of 5/8" Fire Rated gypsum wall board was installed,and taped over all exposed combustible materials behind the boiler. 4. A grill providing greater than the fresh air required by the unit was installed into the attic cavity. S. The existing drywall in the garage appears to be adequate for the necessary fire rating. 5/8"Fire rated gypsum wall board was installed in the closet open into the garage thereby providing the necessary rating between the garage and the remaining building.
