Family, LLC. SCTM#1000-99-1-38.2 PROPERTY LOCATION: 450 Sound Beach Drive(adj.to Long Island Sound)Mattituck,NY SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 30, 2014, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated October 31, 2014. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. However, the applicant's AMENDED survey shows a proposed dwelling located several feet landward of the Coastal Erosion Hazard Line, and although the structure will be located within with the AE EL 12' and El 13' flood zones, it will be constructed on pilings with a finished floor elevation of 15 feet. The AMENDED survey also shows lot coverage reduced from what was originally proposed. Therefore, in consideration of these mitigating factors, as well as the fact that the applicant must comply with Chapter 236 of the Town's Storm Water Management Code and all other applicable regulations including regarding installation of a compliant septic system, it is our recommendation that the proposed action as shown in the applicant's AMENDED survey and architectural plan is CONSISTENT with LWRP policy standards, and is therefore CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 25,496 sq. ft. waterfront parcel in the R-40 Zone. The northerly lot line measures +/- 76 feet along Long Island Sound. The easterly lot line measures +/- 346 feet along an adjacent residential parcel. The southerly lot line measures 75 feet along Sound Beach Drive and the westerly lot line measures +/- 333 feet along another residential parcel. Because a portion of land is situated seaward of The CEHL, and is within VE flood zones,the parcel has a buildable area of 5263 sq. ft. The property is improved with a pre-existing single family dwelling, as shown,with proposed new construction, on the survey drawn by John T. Metzger, Licensed Surveyor, latest revision dated Nov. 12, 2014. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's April 25, 2014,renewed August 29, 2014 Notice of Disapproval based on an application for building permit for demolition of an existing single family dwelling and construction of a new single family dwelling, at; 1) Page 2 of 3—December 4,2014 ZBA#6798—PMV Family,LLC SCTM#1000-99-1-38.2 less than the code required single side yard setback of 15 feet, 2) less than the code required combined side yard setback of 35 feet, 3)more than the code permitted maximum lot coverage of 20%. RELIEF REQUESTED: The applicant requests three variances in order to demolish an existing structure, and to construct a proposed new single family dwelling with a single side yard setback of 10 feet where 15 feet is required by Code, a combined side yard setback of 25 feet where 35 feet is required, and a total lot coverage of 43.6% where 20% is permitted by Code. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on November 10, 2014 submitted a plan increasing one proposed single yard setback from 10 feet to 15 feet, eliminating one variance request, increasing the combined side yard setback to 30 feet, and decreasing the proposed lot coverage from 43.6%to 39%, bringing the plan into more conformity with the code. ADDITIONAL INFORMATION: The applicant submitted documentation of variances for side yard and lot coverage relief that had been granted within the neighborhood. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 6, 2014, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the relief as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The long-established neighborhood consists of numerous non-conforming sized parcels with various structures located with non-conforming setbacks and non- conforming lot coverages. The existing structure on this property has a nonconforming lot coverage and a non- conforming side yard setback. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant, for the relief as amended, cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant's property is a non- conforming sized parcel, and because a portion of land is situated seaward of The CEHL and is within VE flood zones,the parcel has a buildable area of only 5263 sq. ft. with an existing lot coverage is 20.8%. 3. Town Law 4267-b(3)(b)(3). The variance granted by the relief as amended for a combined side yard setback of 30 feet where 35 feet is required is not mathematically substantial, representing +14% relief from the code. The variance granted by the relief as amended for lot coverage of 39% where 20% is allowed is mathematically substantial, representing 95% relief from the code. However, because a portion of land is situated seaward of the CEHL and within several flood zones,the parcel has a buildable area of only 5263 sq. ft. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and requirements for the installation of a certified septic system. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the relief as amended, is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new single family dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that; The proposed construction of a new single family dwelling with a nonconforming side yard is EXEMPT from LWRP Coastal Consistency Review. The proposed construction of a new single family dwelling more than the code permitted maximum lot coverage of 20% is INCONSISTENT with the LWRP policies and therefore INCONSISTENT with the LWRP. The proposed action does not meet Policy 4.1. Minimize losses of human life and structures from flooding and erosion hazards; 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. d. sites where relocation of an existing structure is not practical. The residential structure does not functionally require a location on the coast. The majority of the subject parcel is located within the FEMA flood zone VE (beach) and the Coastal Erosion Hazard Area and the remainder(developed area) is located within the AE Flood Zone (see Figure 1. below). The VE zone is a coastal hazard area with velocity hazard (wave action) and AE flood zones pose a high flood risk due to storms. f 4 20'4 i� 9 �. A portion of the structure is located within the AE EI 13' Flood Zone with the remaining floor area located in the AE EI 12' Flood Zone (2009). The finished floor elevation is proposed at 14', however the portion of the house that is proposed within the AE EI 13' Flood Zone does not conform to Chapter 148 Flood Damage Prevention of the Southold Town Code. The limit of moderate wave action line is located landward of the proposed structures. The VE and AE flood zones pose a high flood risk due to storms. However, based on the location and size of the parcel there is no ability to relocate the single family dwelling outside of the AE flood zones. The applicant is requesting a variance for 43.6% lot coverage, more than the code permitted maximum lot coverage of 20%. The large variance request is due to the amount of unbuildable lands (Beach) that comprises the total parcel acreage. Unbuildable lands are excluded from the percent cover calculation used to determine parcel coverage. Since the majority of the parcel is unbuildable lands, development is forced to be clustered to the southeast against Sound Beach Drive. The clustering of development against Sound Beach Drive is the prevailing development pattern in the community, however, the build-out of this parcel with larger structures increases the risk of loss due to storms. The expansion of structures in these areas should be minimized. If the action is approved, the first floor elevation of the structure must be designed to conform to Chapter 148 Flood Damage Prevention of the Southold Town Code. The following conditions are also proposed to be considered by the Board to further the below policies. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided.- 1. voided.1. Maintain buffers to achieve a high filtration efficiency of surface runoff. 2. Avoid permanent or unnecessary disturbance within buffer areas. 3. Maintain existing indigenous vegetation within buffer areas. It is recommended that the Board require the perpetual preservation of all natural vegetation seaward of the Coastal Erosion Hazard Line. The width, composition and maintenance activities should be memorialized within a covenant and restriction. A sample definition of a natural vegetated buffer is included for your use. NATURAL VEGETATED BUFFER -- a land area of a certain length and width where existing vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation shall be maintained to achieve a minimum percent ground cover of ninety-five (95) percent. To achieve the percent ground cover indigenous, drought tolerant vegetation shall be planted. Survival of planted vegetation shall be (ninety) 90 percent for a period of three (3) years. Maintenance activities within the buffer are limited to removing vegetation which are hazardous to life and property, replanting of vegetation and establishing a four foot (4') wide access path constructed of pervious material to access the water-body. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. BASIS OF APPLICATION: Request for Variance from Article XXIII Code Section 280-124 and the Building Inspector's June 22, 2010, Updated June 13, 2011 Notice of Disapproval based on an application for a building permit to construct additions and alterations to existing single family dwelling at, 1)front yard setback of less than the code required 35 feet 2) total side yard setbacks of less than the code required 25 feet, 3) lot coverage of more than the code required 20%. RELIEF REQUESTED: The applicant proposes to construct a 7 ft. x 28.4 ft open front porch addition with roof deck above with a front yard setback of 31 feet where the code requires 35 feet and a 7.5 ft. x 28.4 ft second floor addition in the rear yard of the dwelling requesting, total side yard setbacks of 15 feet where the code requires 25 and lot coverage of 23.9%where the code permits a maximum lot coverage of 20%. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application September 1,2011,at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: t � 44 Page 2 of 3—September 15,2011 ZBA File00-99-Kapetanos CTM: 1000-99-1-Z 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Several properties in this neighborhood have nonconforming setbacks similar to this application. The adjacent dwelling to the west of the subject property has a front elevation and front yard setback that is identical to the proposed addition and setback. The front porch roof deck will allow the applicant to enjoy a water view which is a common amenity in this neighborhood. The proposed rear yard second story addition will not be visible from the street. 2. Town Law 6267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling is situated at 36 feet from the front property line and any addition that would be functional would require a variance. The total side yards are existing at 15 feet which the proposed additions will maintain.The second floor addition to the rear of the dwelling is above the existing first floor and will not create additional lot coverage which is already non-conforming at 21%. 3. Town Law 5267-b(3)(b)(3). The variances granted herein for the proposed lot coverage and total side yard setbacks are mathematically substantial requiring a 20% and 40% relaxation from the code, respectively. The variance for the front yard setback is not substantial requiring an 11% relaxation from the code. However,the total side yards are existing at 15 feet which the proposed additions will maintain and the existing non-conforming lot coverage of 21%will be increased by only 2.9%on this small 7,500 sq, ft. non-conforming property 4. Town Law 6267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The subject property is relatively flat and contains no naturally regulated features. 5, Town Law 6267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 5267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a front and rear additions while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The second-story addition at the front is proposed over the existing first floor area of the applicant's home is proposed to meet the code required 35 ft. front yard, and the side yards will maintain the existing nonconforming setbacks at 6 feet on each side at its closest measurements, and 10.5 feet and 15.5 feet for the rear two story addition. The new construction will be utilizing a major portion of the property which has already been developed, and which is the most economic and efficient manner for the applicant in expanding living space without covering a large percentage of the lot. 2. The amount of front yard setback relief is for a reduction of two feet from the code requirement, in permitting the addition of a 6—foot covered (two-story deck construction) at 33 feet, instead of the code required 35 feet. 3. The amount of lot coverage relief requested for the new additions provides for a lot coverage of 21.4 per cent, which is not substantial. The applicant is removing the shed existing in the rear yard, and adjusts for allowance resulting in the requested 1.4% increase over the code limitation of 20% lot coverage for the proposed front yard two- story deck and rear addition. The applicant is also reducing the elevation of the rear addition to one-story instead of two-story, based on the conditions of the nearby bluff area which did not appear to be completely stabilized. 4. The increase in the degree of nonconformity with respect to the existing non- conforming side yard setbacks will not be substantial, as there will be no change in the established setbacks. 5. The additions, with modification to the rear addition for one-story construction instead of two-story, will provide substantial benefits to the owner, without impact or change affecting the immediate site area. 6. Grant of the variance relief is the minimum action necessary adequate to enable the applicant to enjoy the benefit of his property while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
