Please note that the new pathway through the buffer,,which was proposed for the purpose of providing a walking path from the rear yard to the top of the bluff, has been eliminated from the site plan without prejudice, as the applicant plans to again seek the Board's approval for the new pathway when and if we are able to secure the Planning Board's approval to establish such a pathway. Although I trust submission of this revised plan will enable the Board to issue the pending Wetlands and Coastal Erosion Management Permits accordingly, please let me know if you require anything further. En-Consultants on behalf of.CUTCHOGUE 6213, LLC, c/o STEPHANIE GUILPIN requests a Wetland Permit and a Coastal Erosion Permit to implement buffer restoration and landscape re- vegetation plan within 100' of bluff crest as follows: between 10' and 50' bluff crest setbacks (within existing 50' buffer area), selectively remove dead trees and noxious vegetation (e.g., Japanese bittersweet and Japanese knotwood) and re-vegetate removal areas with native vegetation (e.g., Northern Bayberry and Low-bush Blueberry); between 50' and 100' bluff crest setbacks (outside buffer area), remove dead trees and noxious vegetation, prune dead wood from existing healthy trees to remain, and re-vegetate understory with native vegetation; clear and maintain a 4' wide access path to beach; install 5' high x 5' wide angled deer fencing with gate landward of 50' buffer, and 8' high deer fencing along westerly property line. Located: 6213 Oregon Road, Cutchogue. SCTM#82-2-3.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the Policy Standards (Policy 6.3) and therefore are CONSISTENT with LWRP provided the following. A 4' wide path is proposed through the 50' buffer. Note, that the installation of stairs or stairways to access the beach from Lot 1 SCTM#82.-2-3.1 is prohibited pursuant to the Planning Board covenant and restrictions. The purpose of the 10' wide access easement on the eastern property boundary of SCTM 1000-82-2-3.2 was to establish a common access that would minimize disturbance to soil stabilizing vegetation and prevent stairways on individual lots down the severely eroding bluff. To that end,for the purpose of noticing the applications, please add the following sentence to the end of both project descriptions, as I would have done on the"General Data"form had I anticipated filing CEMP applications: "All activities proposed landward of the 50' bluff setback are located landward of the Coastal Erosion Hazard Area and therefore a subject of the Wetlands Permit application only." In the alternative, you could say"All activities proposed landward of the 50' bluff setback are located landward of the Coastal Erosion Hazard Area and therefore not a subject of the Coastal Erosion Management Permit application." Not sure which way you prefer but it's important to point out that the more extensive clearing/revegetation plan that is proposed outside the 50' buffer is also located outside the CEHA and therefore not a subject of that application. Specifically, the selective removal of dead trees and noxious vegetation and replacement with native vegetation will help to ensure the long term health and ecological quality and function of the buffer by preventing the smothering and outcompeting of the buffer's inhabitant diverse, native vegetation by a small handful of nonnative, invasive vegetation, such as Japanese bittersweet and Japanese knotweed, which can result in the long term degradation and loss of ecological quality(e.g.,loss of diversity, habitat, and forage areas),all contrary to the purpose and value associated with establishing such buffer areas in the first place. Because the loss of native woody vegetation to invasive vines, for example, can in turn also lead to the destabilization of soils and soil erosion adjacent to the bluff, the managed and controlled removal of existing dead trees and invasive vegetation can also reduce the risk of bluff erosion. Therefore, the potential effects of the project on the natural resource areas regulated by Chapter 275 are beneficial. 0 • Board of Trustees Application COASTAL EROSION APPLICATION DATA Purposes of proposed activity. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation criteria. ❑Yes ❑ No M Not Applicable Attach additional sheets if necessary Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III - Policies Pages 3 through 6 for evaluation criteria ❑ Yes ❑ No ® Not Applicable Attach additional sheets if necessary Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III - Policies Pages 6 through 7 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The proposed restoration and enhancement of the existing 50'buffer through the removal of dead trees and noxious vegetation will help to ensure the long term health and ecological function and quality of the buffer by preventing the smothering and outcompeting of the buffer's inhabitant diverse, native vegetation by a small handful of nonnative and invasive vegetation, such as Japanese bittersweet and Japanese knotweed thus resulting in the preservation of existing indigenous and enhancing scenic quality adjacent to the bluff and shoreline, consistent with Policy 3. The use of native vegetation throughout the proposed landscape revegetation of the area located within 100 feet of the bluff but outside the 50'buffer is similarly consistent with these Policy 3 goals. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The project is consistent with Policy 4 to the extent that the unmanaged loss of dead trees and other native vegetation adjacent to the bluff, particularly as a result of the potentially widespread impacts of invasive vegetation, can in turn lead to the destabilization of soils and soil erosion adjacent to and ultimately on the bluff. Therefore, the managed and controlled removal of existing dead trees and the invasive vegetation that can lead to future loss of vegetation and associated soil destabilization will reduce the risk of erosion damage. Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ❑Yes ❑ No ® Not Applicable Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable The proposed restoration and enhancement Auffer through the selective removal of dead trees anxious vegetation and replacement with native vegetation will help to ensure the long term health and ecological quality and function of the buffer by preventing the smothering and outcompeting of the buffer's inhabitant diverse, native vegetation by a small handful of nonnative and invasive vegetation, such as such as Japanese bittersweet and Japanese knotweed, which can result in the long term degradation and loss of ecological quality(e.g.,loss of diversity, habitat, and forage areas),all contrary to the goals of Policy 6 and the purpose and value associated with establishing such buffer areas in the first place. Therefore, the project is consistent with the Policy 6 goal of protecting and restoring ecological quality, particularly through the retention and addition of indigenous plants to maintain and restore the values of the natural ecological community, both inside and outside the buffer area. Attach additional sheets if necessary Policy 7. Protect and improve air quality in the Town of Southold.
