That the said Board of Trustees and the Town of Southold are released from any and all damages,or claims for damages,of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties,and the said Pennittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. The other item is at John Bredemeyer's request. He has requested a "look down" (like the planting view submitted) view of the project with both the wall and the proposed stones along the wall. Mr. Bredemeyer is recommending for the 1 sturdiness of your wall to have the stones wrap around the easterly return (road side)with a 45 degree angle or curve of stone-work may fail. By doing this it should add to the strength of the wall if a future storm occurs. He also recommended to which is not at this time a requirement that you incorporate filter fabric with small stone in spaces to lock in the larger stones in their place. It has been noticed after Super-Storm Sandy that properties that just lay large stone down had them moved around more than stone that was on top of the filter fabric and small stone. Your neighbor the Allecia's have this incorporated into their revetment. I suspect that the minimum cost of such a survey from scratch would be in the neighborhood of$2,000. 1 suspect the engineering design would cost somewhere in the neighborhood of$3,000 to$4,000. Our fee to seek all necessary agency approvals, including a NYSDEC Tidal Wetlands Permit(including assisting with whatever Notice of Violation may result once the DEC becomes aware of the unpermitted structure), Town of Southold Wetlands Permit, Town of Southold Coastal Erosion Management Permit, and Town of Southold LWRP/Waterfront Consistency Concurrence, would cost approximately $7,500 plus agency application fees, which will range around $1,200, including the doubling of the Trustees usual fees for having constructed the existing structure without a permit. The cost of constructing a toe armor structure is several hundred dollars per linear foot plus the expense of backfill, revegetation, etc. As I understand that these costs associated with such a process are not insignificant, you may want to explore the possibility of seeking the services of a firm who could deal with one or more of the above described services as part of one package. Costello Marine, for example, who has decades of expertise in engineering the design of and installing such structures, also provides in house permit services for a fee if you contract them to undertake the work. You could also contact Young and Young, who could do the survey work if you have not been able to work with Ehlers, and I believe they might also design the structure. These options might reduce your overall cost of the project versus hiring a surveyor, my firm, an engineer, and a contractor, all under separate contract. Do you have any idea how that's possible? Should I get a new survey? I would have to see your survey but depending on property line angles it can be hard to tell with the naked eye. If the contractor did not have your land staked out prior to building the wall there's no way of knowing how accurately the wall reflects your property. The updated survey you will need to obtain for this process will have to depict the current structure regardless so you will see whats what when that is done. 6) MOST IMPORTANT: how long do you think this process will take? Same answer as#3 above. Keep in mind that you will also have other agencies to contend with and that the state DEC will also issue you a violation and likely fine you quite a bit more than the Town did. They will also have a say in what the remedy is. This is going to be a very long and very expensive process for you, as it is a very rare thing that someone manages to complete the construction of a shoreline hardening structure on the beach without permits and it is going to take a significant effort to correct the situation. 7) 1 ultimately have considered raising my house and adding a garage. Is this the time to put that permit in and do you think that is at all possible? This would be something for the engineer to consider as you explore the shoreline solution. Permit wise, you probably ought to focus on this right now.
