The DEC resolved the issue as follows: 1. Removal requirements: None 2. Restoration Requirements: Respondent shall submit to the Department an approvable restoration plan and a time schedule for implementation of said plan: a) Plantings in disturbed area b) Specifications: Recommend that the disturbed area be reseeded and planted with native vegetation. Upon written approval by the Department, Respondent shall implement the approved restoration plan in accordance with the approved time schedule. Said maintenance shall ensure a success ration of at least 85%for a 5 year time frame from completion I have a restoration plan underway. I will submit the restoration plan to the Trustees upon approval by the DEC. I am not sure of the timeframe, but the resolution was received yesterday and I have already had a meeting regarding the plan. From: Robert Herrmann [mailto:rherrmann(a)-enconsultants.coml Sent: Monday, August 19, 2013 1:52 PM To: 'Lisa' Subject: RE: bulkhead permit Lisa, with respect to an accounting of the time I've attended to your case, I have physically inspected the property (at which time I met with Ian Crowley, a marine contractor, to consider possible construction designs in place of the retaining wall); had several telephone conversations with Lori Hulse, Assistant Town Attorney, for the purpose of facilitating the settling of your violation without the need for an attorney; had both telephone and in-person communications with the Trustees with respect to your permanent rectification of the illegally constructed retaining wall; had a telephone conversation with John Ehlers regarding the updating of your survey; researched any available historical documentation by searching the Town website and reviewing the old permit and other paperwork you sent me as well as the permit issued to your neighbor; and of course had various email and telephone exchanges with you regarding both the initial violation and what plan you might pursue to permanently rectify your situation. The amount of time I have spent attending to your case has thus exceeded the 2 hour retainer but I would consider us square with respect to billable time for efforts spent to date. I previously alluded to what you would need to do to pursue the construction of a stone toe armoring structure that would tie into your neighbor's structure (see copy of my 3-14-13 email response to you, which I've copied below), which would first require preparation of an updated land survey depicting the location of the existing retaining wall; elevation contours from mean high water to your house; and other existing features that would present a complete depiction of existing conditions and provide the information needed for an engineer to design an appropriate structure. I suspect that the minimum cost of such a survey from scratch would be in the neighborhood of$2,000. 1 suspect the engineering design would cost somewhere in the neighborhood of$3,000 to$4,000. Our fee to seek all necessary agency approvals, including a NYSDEC Tidal Wetlands Permit(including assisting with whatever Notice of Violation may result once the DEC becomes aware of the unpermitted structure), Town of Southold Wetlands Permit, Town of Southold Coastal Erosion Management Permit, and Town of Southold LWRP/Waterfront Consistency Concurrence, would cost approximately $7,500 plus agency application fees, which will range around $1,200, including the doubling of the Trustees usual fees for having constructed the existing structure without a permit. The cost of constructing a toe armor structure is several hundred dollars per linear foot plus the expense of backfill, revegetation, etc. 4 As I understand that these costs associated with such a process are not insignificant, you may want to explore the possibility of seeking the services of a firm who could deal with one or more of the above described services as part of one package. Costello Marine, for example, who has decades of expertise in engineering the design of and installing such structures, also provides in house permit services for a fee if you contract them to undertake the work. You could also contact Young and Young, who could do the survey work if you have not been able to work with Ehlers, and I believe they might also design the structure. These options might reduce your overall cost of the project versus hiring a surveyor, my firm, an engineer, and a contractor, all under separate contract. I am leaving for vacation later this week through Labor Day and am thus jammed up for the next few days, but if you'd like to discuss the above further when I return in early September, I am happy to try to provide you with the best guidance that I can. First, thank you for calming me down and explaining the situation in such a clear and concise way. I need to know what the next steps are. Here are my questions: 1)Did you find my application from 2007. Perhaps you have everything there that you need to submit/renew an application for the rock revetment. I've requested a copy of the 2007 file from the Trustees office. There will be little there that will assist your current process but I'd like to see where that process ended. 2) Is the rock revetment the only option at this point or is a"vinyl" bulkhead possible? It is likely the rock is the only option but you will need to retain the services of a professional engineer to consider your options and design the structure. 3) How long do you think it will take from beginning to end? The process could take the better part of a year or more. 4) 1 need to replace my fence around the pool that was damaged in the storm. Do I need to get a permit for that? Can I move it back a few feet? You need a Trustees permit if it is located within 100 feet of the beach but a fence replacement should qualify for an administrative permit. Not sure they will grant you anything with this other issue outstanding though. 5 0 9 5) In preparation for the town's arrival yesterday, I measured the wall (in essence my beach frontage). My survey says I have 103 feet and my wall is 79 feet. If you walk 24 feet of the end of the wall you end up in the middle of the town guardrail at the end of the street. Do you have any idea how that's possible? Should I get a new survey? I would have to see your survey but depending on property line angles it can be hard to tell with the naked eye. If the contractor did not have your land staked out prior to building the wall there's no way of knowing how accurately the wall reflects your property. The updated survey you will need to obtain for this process will have to depict the current structure regardless so you will see whats what when that is done. 6) MOST IMPORTANT: how long do you think this process will take? Same answer as#3 above. Keep in mind that you will also have other agencies to contend with and that the state DEC will also issue you a violation and likely fine you quite a bit more than the Town did. They will also have a say in what the remedy is. This is going to be a very long and very expensive process for you, as it is a very rare thing that someone manages to complete the construction of a shoreline hardening structure on the beach without permits and it is going to take a significant effort to correct the situation. 7) 1 ultimately have considered raising my house and adding a garage. Is this the time to put that permit in and do you think that is at all possible? This would be something for the engineer to consider as you explore the shoreline solution. Permit wise, you probably ought to focus on this right now. Once I have a chance to review the 2007 paperwork and can speak to the Trustees I can give you some idea of what our fees would be to represent you going forward. You will also need proposals from a surveyor and engineer.
