WITNESSETH, that the party of the first part, in consideration of Ten Dollars, and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of the second
part, the heirs or successors and assigns of the part of the second pan forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk and State of New York, described as Lot No. 5, on
a certain map entitled "MAP OF FAIRVIEW PARK", made by Otto W. Van Tuyl & Son, dated April 5, 1961,
and filed in the Suffolk County Clerk's Office on August 9, 1961, as Map No. 3388 and being more particularly
bounded and described as follows:
BEGINNING at a point on the northerly side of Custer Avenue distant 110 feet westerly from the comer formed
by the intersection of the northerly side of Custer Avenue with the westerly side of Bennett Lane;
RUNNING THENCE along northerly side of Custer Avenue North 78 degrees 22 minutes 50 seconds West a
distance of 115.00 feet;
THENCE North 11 degrees 37 minutes 10 seconds East a distance of 179.24 feet;
THENCE South 83 degrees 47 minutes 01 seconds East a distance of 115.51 feet;
THENCE South 11 degrees 37 minutes 10 seconds West a distance of 190.12 feet to the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed
dated September 7, 1993 recorded in the Office of the Clerk of the County of Suffolk on September 15,
1993 in Liber 11644 page 304.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
AND the party of the first part covenants as follows: that said party of the first part is seized of the said premises
in fee simple,and has good right to convey the same; that the party of the second part shall quietly enjoy the said
premises; that the said premises are free from incumbrances, except as aforesaid; that the party of the first part
will execute or procure any further necessary assurance of the title to said premises; and that said party of the
first part will forever warrant the title to said premises.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
