SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 30, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 20,000 square foot developed lot located in an R-80 district. The property has 100 feet of frontage on cedar beach road. The North side of the property is 200 feet long. The East side of the property is 100 feet long, and the South side of the property is 200 feet long. There is a stockade fence along the South line of the property. There is an existing dwelling on the property which coversl248 square feet. The dwelling's septic system is located towards the Southeast corner of the property. The Southeast section of the property has irregular terrain and slopes from an elevation of 3 feet up to an elevation of 10 feet. All is shown on a survey by Kenneth M. Woychuk L.L.S. dated December 20,2013 and submitted to the Zoning Board of Appeals on February 27,2014, BASIS OF APPLICATION: Request for Variance from Article III Section 280-15 and the Building Inspector's September 24, 2013 Notice of Disapproval based on an application for building permit for an accessory in-ground swimming pool and shed,at; 1)proposed location other than the code required rear yard. RELIEF REQUESTED: The applicant requests a variances to place a swimming pool and a shed in a side yard where the code requires that accessory swimming pools and sheds be placed in a rear yard location. AMENDED APPLICATION: During the hearing,the applicant was asked to bring the plan into more conformity with the code. The applicant on February 27, 2014 submitted a revised application showing a smaller 12 ft. wide by 12 ft. long by 12 ft. high shed located in the front yard in place of the proposed 16 ft. wide by 16 ft. long by 16 ft.high shed,and an in ground pool in the side yard. Page 2 of 3—March 20,2014 ZBA#6710—Bdkin SCrM#1000-89-2-4 ADDITIONAL INFORMATION: During the hearing testimony was taken that that shed and swimming pool could not be located in the rear yard as required by code because of the location of the existing septic system and because the terrain has a steep slope which is too steep for the construction of a shed and swimming pool. On February 27, 2014 the applicant's agent/architect submitted an updated survey showing the contour intervals and septic location, as requested by the Board of Appeals,confirming same. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on February Oh and March 6,2014 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 6267-b(3)(b)(1). Grant of the amended application will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes several of which have pools. The Zoning Board of Appeals has previously granted relief for swimming pools to be in other than the rear yard locations in this neighborhood. 2. Town Law 6267-b(3)(b)(2).The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The rear yard of the property has a steep slope making it difficult to construct a swimming pool and a shed in this location. The existing septic system is also located in the existing rear yard and its placement does not leave room for the applicant to construct a swimming pool and a shed. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code. However, the terrain and the septic system do not allow for the placement of the pool and the shed in a conforming location. Further, the applicant does not have a neighbor on the North side of the house, who would be most affected by the swimming pool in the side yard. The proposed shed will be located behind several trees making it difficult to see from the road and therefore will have a minimal effect on the character of the neighborhood. 4. Town Law 6267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 8267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 6267-b. Grant of amended relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool and a shed while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Goehringer,and duly carried,to GRANT AMENDED RELIEF, as follows; according to the survey by Kenneth M. The proposed swimming pool is located as far from those wetlands as practicable and more than 50 feet from the tidal wetlands boundary,as required by Chapter 275. The proposed outdoor shower and shed are located farther from wetlands and in line with the existing patio and dwelling. The pool is proposed to be raised to avoid interference with the water table,and the fill required to raise the pool will be contained inside proposed retaining walls to prevent the potential for altering drainage patterns or creating the increased potential for stormwater runoff. A temporary project limiting silt fence will be set in place between the work site and roadway to control and contain site disturbance and potential runoff during construction;and a new drywell and pool drywell will be permanently installed to capture site runoff and pool backwash,respectively. And although the establishment of a nonturf buffer adjacent to the offsite wetlands is not possible,approximately 1,677 square feet of plantings are proposed in place of existing lawn areas, including between the pool and roadway. A temporary project limiting silt fence will be set in place between the work site and roadway to control and contain site disturbance and potential runoff during construction;and a new drywell and pool drywell will be permanently installed upon completion of construction to capture site runoff and pool backwash,respectively. Also upon the completion of construction,approximately 1,677 square feet of plantings are proposed to be established in place of existing lawn areas to provide additional soil stabilization and filtering capacity between the proposed structures and the roadway and wetlands,all consistent with Policy 5. The proposed swimming pool is located as far from those wetlands as practicable and more than 50 feet from the tidal wetlands boundary,as required by Chapter 275. The proposed outdoor shower and shed are located farther from wetlands and in line with the existing patio and dwelling. The pool is proposed to be raised to avoid interference with the water table, and the fill required to raise the pool will be contained inside proposed retaining walls to prevent the potential for altering drainage patterns or creating the increased potential for stormwater runoff.
