Malley PROPERTY LOCATION: 1330 Gillette Drive East Marion,NY SCTM#1000-38-2-14 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 30, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject parcel is a non-conforming 10,000 sq. ft. lot located in the R40 zone. It is improved with a one story single family dwelling. It has 100.00 feet of frontage on Gillette Drive, 100.00 feet along the northern property line, 100.00 feet on the western property line and 100.00 feet along the southern property line, as shown on the site plan prepared by Nancy Dwyer, Design Consulting, Inc. dated 9.10.2014. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's September 25, 2014 Notice of Disapproval based on an application for building permit for additions and alterations to an existing single family dwelling, at; 1) less than the code required front yard setback of 35 feet, 2)more than the maximum code permitted lot coverage of 20%. RELIEF REQUESTED: The applicant requests a variance to construct an addition to the existing front porch with a setback of 27'3 '/2" from the front property line where the code requires 35 feet and lot coverage of 24.7%where the code permitted maximum lot coverage is 20%. ADDITIONAL INFORMATION: At the hearing the agent for the applicant was asked to give the Board information regarding prior variances in the immediate subdivision. The Board received a copy of 1. Appeal #6513 dated Nov. 3, 2011 which granted an area variance for a front porch addition at 29 feet from the front property line on Gillette Drive, where code requires 35 feet. This is very similar to the present application. 2. In Appeal #6566 dated July 5, 2012 the ZBA granted, alternative relief for an area variance for lot coverage at 26.8% and a rear yard setback at 19.5 feet where code requires 35 feet , also similar to the subject application of lot Page 2 of 3—November 20,2014 ZBA#6805—Malley SCTM#1000-38-2-14 coverage of 24.7% . 3. Under Appeal 4814 dated May 4, 2000, an area variance for an addition and new deck with lot coverage of 23.8%was granted on this subject parcel. Additionally the Board requested the front yard setbacks of the adjoining parcels on Gillette Drive. On November 12, 2014 the agent provided the setbacks of the property on the north side at 29'4"and the south side at 35.3'. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 6,2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The home lies on the west side of Gillette Drive midway between SR25 and the Bay. The entire subdivision consists of non-conforming lots that are significantly smaller than present code requirements. As a result, the Board has seen many requests for similar area variances in this neighborhood. The proposed front porch is similar to others in the neighborhood and will improve the appearance of the subject dwelling. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because of the non-conforming size of the parcel and the placement of the home on the site. It is not feasible for the applicant to move the dwelling with the proposed porch addition to a conforming front yard location, which would only result in a further reduction in the setback in the rear yard. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 20% relief from the code for the setback and approximately the same for the lot coverage. However, a prior variance granted to this property permitted lot coverage of 23.8%, so the proposed lot coverage is an increase of less than I%. The existing front yard setback is non-conforming at 32'3 ''/2", and the proposed front porch addition will result in an increase of 5 feet from the step to the front property line. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will not have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the variance for the front yard setback and lot coverage on this non-conforming parcel is the minimum action necessary while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Dantes, and duly carried,to GRANT, the variances as applied for, and shown on the site plan, plans and drawings produced by Nancy Dwyer, pages one through three, dated 9/10/2014. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The lot is improved with a single-family dwelling as shown on the September 29, 1966 survey. BASIS OF APPLICATION: Building Inspector's January 20, 2000 Notice of Disapproval for the reason that the proposed additions will exceed the lot coverage limitation of the Zoning Code. The Code requirement is 20% for building area (exclusive of ground level patios). The Notice of Disapproval states that the existing area is 1,960 sq. ft. (porch, garage and sun room included)and the proposed is 23.80%. AREA VARIANCE RELIEF REOU EJ STED: Applicants are proposing: (1) a 15' x 22' addition over an existing slate patio, and (2) 10'x 10' open deck at the rear of the dwelling. ADDITIONAL INFORMATION: Applicants have furnished an updated survey prepared by Joseph A. Ingegno dated February 18., 2000 which shows a proposed total lot coverage at 23.92% and an existing lot coverage of 2,133 sq. ft. (or 21.3%). The Board has reviewed the existing and proposed lot coverage estimates calculated by the Building Department and those provided on the applicant's survey prepared by Joseph A. Ingegno dated February 18, 2000. The Hoard finds that the existing dwelling and lot coverage is 21.3% (2,133 sq. ft.) and that the proposed 22 x 15 ft. dwelling addition would add 330 sq. ft. and the 10 x 10 ft. deck addition would add 100 sq. ft. for a total of 430 sq. ft.,or proposed lot coverage of 23.92% (2,392 sq. ft.). REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's lot is small at 10,000 sq. ft. but similar in size to neighboring properties in this subdivision created in 1966. The proposed addition and deck would follow the established line of the back porch and square off the southwest back comer of the house. The requested additional lot coverage to add 440 sq. ft. to the single-family dwelling is in keeping with the size of other houses and lot coverage in this neighborhood. 2. The benefit sought by applicant cannot be achieved by some method,feasible for appellant to pursue other than an area variance because the applicant's property is only 10,000 sq. ft., and the existing dwelling occupies 21.3%of the 20%allowable coverage. At the Special Meeting of the Board of Appeals held June 21, 2012, a resolution to re-open this hearing to address the additional lot coverage variance was passed by a unanimous vote. The existing lot coverage is 24.4%,which was allowable at the time the dwelling was constructed, FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on June 7,2012 and July 5,2012 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties, This area of Gillette Drive is a subdivision of quarter acre lots. Most additions and alterations into the rear yard area would require relief from the present zoning code. The rear yards of all of the lots on the easterly side of Gillette Drive in this subdivision are adjacent to tillable farmland which will remain in the Suffolk County agricultural land bank, which renders the farmland unbuildable. The proposed deck is not visible from the street. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant for the setback can be achieved by some method, feasible for the applicant to pursue, other than an area variance, The applicant could create a 6.7 foot deep deck along the portion of the dwelling that is 41.7 feet from the rear property line. However, the placement of a raised deck in that location is not logical or convenient to the layout of the interior of the house and an outside cellar entrance in that area makes it an impractical location.Because the applicant's house is 35.7 feet from the rear of the property line where the raised deck is proposed, a variance is required.The applicant must obtain a variance for excessive lot coverage because the existing lot coverage is already beyond what the code permits, so any addition to the subject dwelling will require a variance. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 39% relief from the code in regards to the rear yard setback. However, the variance is mitigated by the small size of the lot, the existing location and interior layout of the dwelling, and the adjacency of the rear yard to property that will remain in agricultural use in perpetuity. The variance granted herein for the lot coverage is mathematically substantial, representing 33% relief from the code. However, a review of the immediate area indicates that this Board has granted variances for lot coverage on several improved properties. The excessive lot coverage is based upon the non-conforming size of most of the lots in this subdivision,which average 10,000 square feet in size. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. All run off will be retained on site per Chapter 236 of the code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. The dwelling was constructed in the middle of the lot with conforming front and rear yard setbacks. So any additions to the front or rear will require the need for a variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is not substantial in regards to the front yard setback, it represents a 17% relaxation of the code required 35 feet. This impact is lessened further by the proposed porch being open on the sides and only extending across half of the front elevation with the rest of the house retaining its conforming front yard setback. The existing rear yard setback is substantial representing a 26% relaxation of the code required 35 feet setback. However,the rear deck was constructed sometime after 1974 but prior to 1982, which was before the code change for non-conforming lots in 1995 and it is very well screened from neighbors views by mature vegetation. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Many homes in the area have similar front and rear yard setbacks. 5. Town Law 6267-b(3)(b)(5). The difficulty has been self-created. The applicant's desire to have a front porch necessitates the need for a front yard variance and the need to obtain a certificate of occupancy for the rear yard deck or remove the deck,which the board determines is an undo hardship. The applicant purchased the parcel after the Zoning Code was in effect and it's presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6, Town Law 6267-b.
