Richard and Wendy Bingham SCTM#1000-6-4-2 PROPERTY LOCATION: 3973 Central Avenue(adj. to Fishers Island Sound)Fishers Island,NY SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 30, 2014, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated Oct. 24, 2014 of INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP because a.) "The FEMA Flood Zone is not shown on the survey" and b.) because a storm water test hole had not been yet been dug with the results submitted, and c.) Although a new bathroom is shown on the proposed plan "the septic area shown on the property does not conform to Town of Southold regulations due to insufficient setback to Fishers Island Sound.....". However, based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, and information submitted by CME Associates, Engineering, Land Surveying & Architecture, PLLC, dated Oct. 28, 2014, showing that the property is located within a VE13 flood zone, and that the proposed addition is located approximately 80 feet landward at a ground elevation of 22 feet, and the first floor will be at elevation of 24 feet, as well as the fact that the applicant must comply with Chapter 236 of the Town's Storm Water Management Code and all other applicable regulations with regard to a compliant septic system, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards, and is therefore CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The applicant's property is an irregularly shaped, .58+/- acre waterfront parcel in the R-80 zone. The northerly lot line borders Fishers Island Sound. The westerly lot line borders another residential parcel. The southerly lot line borders Central Ave, and the westerly lot line borders another small parcel also owned by the applicant. The property is improved with a single family dwelling, and a shed, (proposed to be removed) that is located in a nonconforming front yard area, as shown, with proposed new construction, on the survey drawn by CME Associated Engineering, Land Surveying & Architecture, PLLC, latest revision dated Oct. 16, 2014,and the Site Plan Page 5 drawn by BD Design Group, date Oct. 14, 2014. Page 2 of 3—November 20,2014 ZBA#6802—Bingham SCTM#1000-6-4-2 BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and Article XXII Section 280-116A(1)and the Building Inspector's September 17, 2014 Notice of Disapproval based on an application for building permit for additions and alterations to an existing single family dwelling, at; 1)less than the code required front yard setback of 40 feet, 2)more than the code permitted maximum lot coverage of 20%, 3) less than the code required bluff setback of 100 feet. RELIEF REQUESTED: The applicants requests variances to construct a proposed addition with a front yard setback of 1 foot where 40 feet is required by Code, lot coverage of 22.2%where 20% is allowed, and setback from the bluff of 54.8 feet where 100 feet is required. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on Nov. 6, 2014 submitted a site plan reducing the proposed lot coverage from 24.4% to 22.2% and increasing the bluff setback to 54.8 feet from the 41.5 feet as originally proposed, bringing the plan into more conformity with the codes. On Nov. 17, 2014 the applicant's architect submitted another revision to the site plan, as shown on site plan dated 14 October 2014 and stamped REVISED 11/13/14 that increased the proposed front yard setback from one (1) to two (2) feet at the closest point and three (3) feet at the next closest point, thereby bringing the plan into more conformity with the codes. The applicant's revised site plan also shows a new design for the proposed addition that presents a profile that has less visual impact and more front yard setback in relation to Central Ave. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 6,2014, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This single family dwelling was constructed in 1903, before the introducton of zoning code, as one of three almost identical dwellings known as the "three sisters". Additions and alterations have been made to the other two "sisters." The closest neighboring dwelling in view of the proposed new addition is located approximately 175 feet away, diagonally across Central Ave. A second neighboring dwelling with a possible view of the applicant's new addition is located approximately 200 feet away, also diagonally across Central Ave. The waterfront views of these neighboring properties are not impacted by the applicant's proposed construction. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant can or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's dwelling was constructed before zoning code, with an existing front yard setback of approximated 10 feet, and a bluff setback of approximately 30 feet. The proposed addition cannot be built without the grant of variances. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for a front yard setback is mathematically substantial, representing+/- 95% relief from the code. However, dwelling was built prior to zoning code with an existing front yard setback of 10 feet, and because of the irregular shape of the applicant's parcel, and the proximity to Central Ave.,the proposed addition cannot be constructed without a further reduction to the front yard setback. There is an approximate 7-8 feet of existing hedgerow providing a vegetative buffer between the property line and the asphalt of Central Ave. The variance granted herein for lot coverage of 22.2% is not mathematically substantial, representing approximately 11% relief from the 20% allowed by code. The variance granted herein for setback from the top of the bluff of 80 feet for the proposed addition is substantial representing 20%reduction from the 100 feet required by code. However the existing dwelling has a 55 feet bluff setback, and the proposed addition is setback another 25 feet further from the bluff. Town Law X267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and all other applicable regulations. 5. Town Law X267-b(30)0). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Horning, seconded by Member Weisman (Chairperson), and duly carried,to DENY, as applied for, and GRANT, the variance relief AS AMENDED and shown on the survey drawn by CME Associated Engineering, Land Surveying & Architecture, PLLC, latest revision dated Oct. 16, 2014, and the Site Plan Page 5 drawn by BD Design Group, date Oct. 14, 2014 and stamped REVISED 11/13/14. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The curvature of Central Avenue to the northwest at this point makes our options for modifying the plan very limited, but I was able to readjust the configuration of the proposed addition so that now the closest point to the front property will be two feet instead of one foot, and three feet at the next closest point. The majority of the addition will still be much farther away from the property line, but these are the closest points. I am enclosing a drawing for the board to consider. The limits of the flood zone are near the top of the bank approximately 80 feet from the proposed addition. Ground elevations in the area of the proposed addition are 22 and the first floor of the house is at elevation 24.05. 2. Test well- A test hole would be dug as part of the Stormwater Management site plan and would be reviewed by the Town engineer as part of the Building Permit application. I would expect soils in this area to be coarse grained soils, poorly graded sands with little or no fines (SP) or sands with fines (SM). Either of these soil types would be acceptable. I would expect groundwater would be at a depth of approximately 15 feet. The design of the Stormwater system could easily be modified if soil conditions proved to be different. 3. Septic System- A determination is typically made during the Building Permit process if a permit from the Suffolk County Department of Health Services is necessary. If it is a system upgrade or certification that the existing system complies with their current standards would be required. The front yard request for a variance of one foot from the property line in reality is a 9 foot deviation from the existing setbacks for the subject premises and the neighboring properties. It is noted that this is a 12 foot setback from the traveled portion of the roadway known as Central Avenue as this 12 foot strip has plantings and mature trees which have been maintained by the applicant. It is submitted that the proposed addition will have no impact on the public use of Central Avenue. The existing house on the subject property is 30.1 feet from the top of the bluff. The distance from the top of the bluff to the proposed new addition will be 41.4 feet which is 10.3 feet further back from the top of the bluff. Therefore, the proposed addition will not increase the non-conformity of the bluff setback. The property is zoned R-80 requiring 80,000 sq. ft. of lot area. The actual deeded lot area is .58+/- acres or 25,265 sq. ft. The buildable lot area calculation under the current zoning ordinance is .28+/- acres or 12,230 sq. ft. The lot coverage for an R-80 District is 20%, but the existing lot coverage is 18.2%. As noted on the attached surrey map of CME Associates Engineer, Land Surveying & Architecture, PLLC dated 9/19/14, the lot area coverage with the proposed addition will be increased by 6.2% to 24.4%which is 4% over the requirement of 20%. Proposed Construction Description (Alterations or Structural Changes) : one-story, 752 sq. ft. frame addition to existing two-story frame single family residence on Fishers Island Sound. The addition includes an open roofed porch of 108 sq. ft. The house is one of the Three Sisters -- three identical houses built in 1903 as part of the Munnatawket Hotel complex, the "Coney Island of the East." The hotel was razed in the mid-1920's, but the Three Sisters remain and are iconic on Fishers Island as the most visible reminder of a much different chapter in the island's history. The applicant owns the westernmost of the Three Sisters. Given the size and shape of the applicant's lot, there is no legally buildable area on the property. Without being able to conform to any of the required setbacks, our guidance in locating the addition was to follow the precedent set by the neighbors. The Three Sisters have very shallow front yards, averaging about 10' deep between them. All of the Three Sisters have been added onto over the years, and all of the additions have been small, one-story, and as tight up against the front property lines as possible -- leaving the iconic view of the houses from the Sound as intact as possible. This is our intention with the currently proposed addition: keep it close to the road to match the neighbors, and as far as possible from the shoreline. In our case, however, unlike the two other lots, the applicant's front property line angles sharply to the northwest, and because of this the addition also has to be angled, but still trying to keep it as close to the front as possible. The owner of the property, Richard Bingham, suffered a debilitating stroke last year. He is wheelchair bound and needs a full-time nurse. The addition will house a bedroom suite for Mr. Bingham that is handicapped accessible.
