(Ratsey Construction) PROPERTY LOCATION: 170 Moores Lane, Greenport,NY SCTM#1000-45-7-3 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 30, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject Parcel is located in a B Zone and is improved with a 16,061 sq. ft. one story metal building. The parcel has 170.33 feet of frontage on Moore's Lane, 305.73 feet on the southerly side, 302.39 feet on the northerly side, and 169.49 feet on the easterly side. As shown on the survey provided by Nathan Taft Corwin, III, Land Surveyor, dated January 28, 2014 last revised October 14,2014. BASIS OF APPLICATION: Request for Variances from Article XI, Sections 280-50A and 280-49 and the Building Inspector's May 30, 2014, renewed July 30, 2014, Amended October 6, 2014 Notice of Disapproval based on an application for building permit for addition and alterations to an existing commercial building, at; 1) less than the code required front yard setback of 100 feet, 2) more than the code permitted maximum lot coverage of 30%. RELIEF REQUESTED: The applicant requests variances to construct a one story office addition to the front of the existing metal building with a front yard setback of 26.6' where the code requires 100 feet and lot coverage of 33.4%where the code allows a maximum of 30% lot coverage. ADDITIONAL INFORMATION: This parcel has had several variance applications before the Zoning Board. File # 353 in 1961 granted temporary amusement use. File #399 in 1961 granted to construct a bowling alley. In 1962 file #434 granted a reduced front yard setback for a cooling tower. Under file #653 in 1964 denied permission to paint the words BOWL and RESTAURANT on the southern roof. File#1513 in 1972 granted permission to rebuild a non-conforming business building. SCTM#1000-45-7-3 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 6,2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property is zoned business and is surrounded by other businesses, a school, park, Public Utility Company and a few residential properties. The property has historically been used for business. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. This is because of the size of the building which has been in existence for more than 40 years, and is currently used as a moving and storage company which is a conforming use in the B zone. The present applicant wishes to construct an attached office to a portion of the front of the building. Any other location for the proposed office would either obstruct circulation around two sides of the building and would still require a variance, or if added to the rear would reduce parking flow for vehicles 3. Town Law 4267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 11% relief from the code for the lot coverage. The variance granted herein for the front yard setback is mathematically substantial, representing 73% relief from the code. However, the applicant submitted documentation showing the average front yard setback for the road to be 24.1 feet and the proposed addition will be setback further than the average. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will not have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an office addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried,to GRANT, the variances as applied for, and shown on the survey prepared by Nathan Taft Corwin, III Land Surveyor dated January 28, 2014 last revised October 14, 2014. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Located at 170 Moores Lane N, ±130' n/o Rt. 25 & Moores La., Greenport SCTM#1000-45-7-3 ZBA#6801 The Planning Board has reviewed the requested variances to construct a 1,140 sq. ft. office addition at a location less than the required 100' front yard setback (±26'4") and exceeding the maximum lot coverage of 30% (33.4%) in the Light Industrial Zone; and generally has no objections to the requested variances. This site was developed long ago and prior to site plan requirements. The proposed office addition will be constructed within the footprint of an existing concrete block foundation from a previous building. The site is currently developed at 31.2% lot coverage (4% over the Code requirement). The additional lot coverage (11% over the Code requirement) is acceptable to the Planning Board in this case due to the industrial zoning, the development history of the parcel, and the fact that it will not reduce the existing landscaping or parking on site.
