SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance. Thank you.
Alright, we have a couple of public hearings scheduled for tonight and we are going to take
public comment on those a little bit later. In the meantime, would anybody like to comment on
any of the other agenda items?
Jill Franke
JILL FRANKE: Hi, Jill Franke Southold. I see Bill Zebroski is retiring. I think that is a loss for
the town. I worked with him for 5 years at the rec center. He is a nice man. He would do
anything that you asked him to do. He was an asset to the town I felt. The other agenda item is
2014-830 and I would like to ask Justice Evans since the other two judges aren't here, do you
completely understand all of the paperwork that the girls do in the back prior to it getting to you
and after it goes to you? How all the paperwork is done and completed?
JUSTICE EVANS: Yes. But this is about an unpaid court intern.
MS. FRANKE: Yes, I understand that. But who is going to train this girl?
JUSTICE EVANS: The justice clerks are the one who gave us the request to have her come in.
MS. FRANKE: But nobody has a supervisory position in there, so who is going to train her the
job or teach her the job and supervise her?
SUPERVISOR RUSSELL: It's an internship.
TOWN ATTORNEY FINNEGAN: It's an internship, it's not a job. It is just an internship. She
is just there for experience.

MS. FRANKE: It is an unpaid position...
TOWN ATTORNEY FINNEGAN: There's no specific job description. She is just going to
gather experience in how the justice court operates.
MS. FRANKE: But who is going to teach her how the court operates?
TOWN ATTORNEY FINNEGAN: She is going to observe and she is going to learn by
observing.
SUPERVISOR RUSSELL: As someone who was an intern once, generally you learn by
working alongside other people. That is the whole intent of the intern program. We are not
going to take her in and put her through a training process because she is not going to be a paid
employee, she is not going to be a long term employee. She is going to be an intern.
MS. FRANKE: Right. And it's probably for a college credit.
SUPERVISOR RUSSELL: That's right.
MS. FRANKE: For a program that she is enrolled in. but I was just wondering where you have
nobody back there to supervise, were the judges going to supervise?
SUPERVISOR RUSSELL: supervise an intern? She will be working alongside the other hard
working ladies that work there and she will be learning from them.
MS. FRANKE: So basically they will be teaching her?
SUPERVISOR RUSSELL: I would think she would be more than capable of learning by
watching.
MS. FRANKE: Okay. Thank you.

Authorize Supervisor to Execute a Municipal Advisory Services Agreement with Munistat Services Inc.
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Scott A. Russell to execute an agreement with Munistat Services Inc. for 2015
municipal advisory services in connection with the Town's Statement of Annual Financial and
Operating Information in accordance with SEC Rule 15C12-12 and the Town's Continuing
Disclosure Undertaking at a fee not to exceed $3000, as well as other advisory services which
may be required in connection with bond financings during 2015 at the fee levels enumerated in

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The Town Board of the Town of Southold has determined that variances which are not
acted upon within a reasonable time may become stale and incompatible with the
surrounding community due to changed conditions. Therefore, the Town Board, upon
the recommendation of the Board of Appeals, in order to protect the health, safety and
welfare of the community, requires that variances have a limited duration of three (3)
years, with the possibility of three (3) consecutive one (1) year extensions at the
discretion of the Board of Appeals.
II. Chapter 280 of the Code of the Town of Southold is hereby amended as follows:
§280-146. Powers and duties.
B. Variances: Where there are practical difficulties or unnecessary hardships in the
way of carrying out the strict letter of these regulations, the Board of Appeals
shall have the power to vary or modify the application of such regulations so that
the spirit of this chapter shall be observed,public safety and welfare secured and
substantial justice done. Effective as of January 1, 2015, any variance granted by
the Board of Appeals shall become null and void where a Certificate of
Occupancy has not been procured, and/or a subdivision map has not been filed
with the Suffolk County Clerk, within three (3) years from the date such variance
was granted, unless the Board of Appeals, upon written request prior to the date of
expiration, grants an extension not to exceed three (3) consecutive one (1) year
terms.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

WHEREAS,on October 6, 2014,the Southold Town Planning Board granted Sketch Approval
on the Sketch Plat prepared by prepared by Fox Land Surveying, dated February 19, 2014, for an
Open Development Area pursuant to 240-26(A) of the Town Code; and
WHEREAS,the Town Board has received a petition from Esseks, Hefter&Angel, LLP to
establish an Open Development Area pursuant to Chapter 240 of the Town Code on the property
identified as part of SCTM#1000-100-4-4 and located in the A-C Zoning District; and
WHEREAS,the requested Open Development Area is located on 7.2 acres of the 61.1 acre

SUPERVISOR RUSSELL: Before we get to the next public hearing, I want to thank the Sidor
family. Actually, this program does not work without your cooperation, the cooperation of land
owners, who are certainly doing everything they can to save Southold Town in the eternity.

WHEREAS, the Town Board of the Town of Southold held a public hearing on the 21St day of
October, 2014, on the question of adding a parcel owned by Richard Sinatra and Camille Sinatra
to the Town's Community Preservation Fund Eligible Parcel List and for accepting a land
donation of fee title to said parcel for open space and passive recreational purposes, pursuant to
the provisions of Chapter 17 (Community Preservation Fund) and Chapter 185 (Open Space
Preservation) of the Town Code of the Town of Southold, at which time all interested parties
were given the opportunity to be heard; and
WHEREAS, said property is identified as SCTM 41000-22.-3-5.1 and No # Kayleigh's Court,
East Marion, New York, and is located at the end of Kayleigh's Court starting with a dirt access
which is a part of the property in East Marion in the R-80 zoning district; and
WHEREAS,the open space acquisition is for fee title of the±10 acre property; and
WHEREAS, the property includes existing Subdivision Open Space and a two (2) acre
development area. The Town's database incorrectly coded this property as entirely Subdivision
Open Space when in fact it includes a two (2) acre development area. The database error resulted
in the property being included on the list of Preserved Lands instead of included on the list of
Eligible Parcels. The Town is adding the property to the list of Eligible Parcels for purposes of
open space preservation, similar to the criteria listed for the properties in the vicinity of the
subject property which are on the current Eligible Parcel List; and
WHEREAS, the subject property will be added to the Community Preservation Project Plan
Eligible Parcel List and its acquisition costs associated with the transfer of fee title will be
funded by the Community Preservation Fund. The purpose of the acquisition is for the
preservation of open space and passive recreation; and
WHEREAS,the acquisition of this property is in conformance with the provisions of Chapter 17
(Community Preservation Fund) and Chapter 185 (Open Space Preservation) of the Town Code
of the Town of Southold; and
WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and the Local Waterfront Revitalization Program

(LWRP) and the LWRP Coordinator has determined that this action is consistent with the
LWRP; and
WHEREAS, as per Chapter 117 (Transfer of Development Rights) of the Code of the Town of

the acquisition and have determined that one (1) sanitary flow credit is available upon the
Town's acquisition of the property. The transfer of the Sanitary Flow Credit into the Town TDR
Bank will not be finalized, and shall not occur, until the Town closes on the property, and the
Town Board passes a resolution allowing the transfer into the Town TDR Bank; and
WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition
and recommends that the Town Board acquire the property; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
accept the land donation of fee title to the subject property for the purpose of the preservation of
open space and passive recreation; and
WHEREAS, the Town Board of the Town of Southold classifies this action as an Unlisted
Action pursuant to the SEQRA Rules and Regulations 6NYCRR 617.1 et SeQ • and
WHEREAS, the Town of Southold is the only involved agency pursuant to SEQRA Rules and
Regulations; and,
WHEREAS, the Town Board of the Town of Southold accepted the Short Environmental Form
for this project that is attached hereto; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby finds no significant impact
on the environment and declares a negative declaration pursuant to SEQRA Rules and
Regulations for this action; and, be it further
RESOLVED that the subject property is hereby added to the Community Preservation Project

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The Town Board has determined that in order to promote the affordability of home ownership
within the Town for first-time homebuyers, certain first-time homebuyers may be exempt from

the Peconic Bay Region Community Preservation Fund transfer tax in accordance with the recent
amendment to New York State §1449-ee(4).
II. Chapter 17 of the Code of the Town of Southold is hereby amended as follows:
§17-4. Definitions.
As used in this w4iele, the following werds and tefms shall have the meanings indieated-Unless otherwise expressly stated the following terms shall for the purpose of this Chapter,
have the meanings as herein defined. Any word or term not noted below shall be used with a
meaning as defined in Webster's Third New International Dictionary of the English Language
unabridged (or latest edition
FIRST TIME HOMEBUYER -A person who has not owned a primary residential property and
is not married to a person who has owned a residential property during the three-year period
prior to his or her purchase of the primary residential property, and who does not own a vacation
or investment home.
PRIMARY RESIDENTIAL PROPERTY—Any one or two family house townhouse or
condominium located in the Town of Southold which is to be owner occupied by such
homebuyer.
§17-25. Additional exemptions.
A. There shall be allowed an exemption of$150,000 on the consideration of the conveyance
of improved real property or an interest therein.
B. There shall be an exemption of$75,000 on the consideration of the conveyance of
unimproved real property or an interest therein.
C. There shall be allowed an exemption for a first time homebuyer where the purchase price
of the primary residential property is within sixty percent of the purchase price limits
defined by the State of New York Mortgage Agency Low Interest Rate Mortgage
Program (SONYMA) in the non-target one-family categories for Suffolk County in effect
on the contract date for the sale of such property and the homebuyer's household income
does not exceed the income limits defined by SONYMA's Low Interest Rate Mortgage
Program in the non-target, one and two person household category for Suffolk County in
effect on the contract date for the sale of such property.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

Esseks, Hefter and Angel. I am here on behalf of the Sidor family, the applicants herein. And as
noted, Planning Board gave approval, sketch approval on October 6 for this open development
area application. This application would result in 53.9 acres of preserved farmland and it has
long been recognized that the preservation of farmland is in the public interest, particularly in an
area with such a long agricultural heritage as the Southold area. And we respectfully submit that
all of the requirements of Chapter 240 of the town code have been complied with and that this
application would be in the public interest and we respectfully request that this open area, open
development area, be established.

SUPERVISOR RUSSELL: Would anyone like to address the Town Board on this? Yes,
Melissa?
MELISSA SPIRO: Melissa Spiro, Land Preservation Coordinator. This hearing involves the
donation of land. I personally would like to take this opportunity to thank the landowners for
offering this important donation to the town and for helping in furthering our preservation efforts
in this area. As you can see, on the map in the front, a lot of preservation has occurred in this
area surrounding and around Dam Pond in East Marion. Over the last 15 years, the town and
county jointly purchased the land that now make up the Ruth Oliva Preserve at Dam Pond. The
preserve is open and has hiking trails. Also during the 15 year time frame, easements which
extinguished development potential in the area was donated at different times from the Peconic
Land Trust and lands adjacent to and in the vicinity of the preserve. Recently the Sinatra's
contacted the Nature Conservancy inquiring about making a donation, the Nature Conservancy
referred them to the town and now the Sinatra's have offered the 10 acre piece to the town for
preservation. This area showcases how preservation can involve both governmental partnership
and also private conservation. Private conservation is very important. One part of tonight's
hearing involves adding the Sinatra property to the towns' community preservation plan eligible
list as noted in the public hearing it would have been on there if we didn't have that error, it is a
developable parcel, it has a two acre development area and similar to other properties in the
vicinity, it would have been on our list of eligible parcels. Once the town accepts the donation
and the title is transferred to the town, any potential for residential development is extinguished,
the property will remain as open space. It will be there for open space and passive recreational
purposes. The Land Preservation Committee reviewed this, they reviewed the donation offer and
they support the town proceeding with the offer and accepting it.

A Local Law entitled, "A Local Law in relation to Amendments to Chapter 17, Community
Preservation Fund, in connection with First Time Homebuyer Exemption".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The Town Board has determined that in order to promote the affordability of home ownership
within the Town for first-time homebuyers, certain first-time homebuyers may be exempt from
the Peconic Bay Region Community Preservation Fund transfer tax in accordance with the recent
amendment to New York State §1449-ee(4).
II. Chapter 17 of the Code of the Town of Southold is hereby amended as follows:
§17-4. Definitions.
As used in this 7 the jj words and tefms shall hm,ethe meanings
Unless otherwise expressly stated, the following terms shall for the purpose of this Chapter,
have the meanings as herein defined. Any word or term not noted below shall be used with a
meaning as defined in Webster's Third New International Dictionary of the English Language,
unabridged (or latest edition).
FIRST TIME HOMEBUYER - A person who has not owned a primary residential property and
is not married to a person who has owned a residential property during the three-year period
prior to his or her purchase of the primary residential property, and who does not own a vacation
or investment home.
PRIMARY RESIDENTIAL PROPERTY-Any one or two family house townhouse or
condominium located in the Town of Southold which is to be owner occupied by such
homebuyer.
§17-25. Additional exemptions.
A. There shall be allowed an exemption of$150,000 on the consideration of the conveyance
of improved real property or an interest therein.
B. There shall be an exemption of$75,000 on the consideration of the conveyance of
unimproved real property or an interest therein.
C. There shall be allowed an exemption for a first time homebuyer where the purchase price
of the primary residential_property is within sixty percent of the purchase price limits
defined by the State of New York Mortgage Agency Low Interest Rate Mortgage
Program (SONYMA) in the non-target one-family categories for Suffolk County in effect
on the contract date for the sale of such property and the homebuyer's household income
does not exceed the income limits defined by SONYMA's Low Interest Rate Mortgage

Program in the non-target, one and two person household category for Suffolk County in
effect on the contract date for the sale of such property.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
I do have a copy of the signed and notarized document for the public hearing advertisement in
the Suffolk Times, also an affidavit that it was posted on the Town Clerk's bulletin board. And
that is everything.

site plans with you and you said if it became a problem, that we were going to come to you and
you would help us again.

MR. SHIPMAN: So the Planning Board shared the information with you that I presented to
them?

TOWN ATTORNEY FINNEGAN: The Planning Board didn't share anything with the Town
Board because it's for the Planning Board to review that. What's your question with it?
MR. SHIPMAN: Well, Ms. Lanza, when I presented her with the information thought that she
was going to share with the Town Attorney and the Town Board.
TOWN ATTORNEY FINNEGAN: Okay. When were the videos taken sir? Probably this
weekend?
MR. SHIPMAN: October 11 th and October 18th.
TOWN ATTORNEY FINNEGAN: Okay. I am aware of the incident that occurred over the
weekend, we have been provided with incident reports by the police department and we have
passed them on to our counsel and to the SLA's attorneys as well.
MR. SHIPMAN: Okay. This refers right back to that movie Groundhog Day. Because we are
waking up to the same stuff. We presented videos of the Hampton Jitney size buses making a
left hand turn into the Zuhoski's driveway. I think I am back in 2012 and 2013 here because I
have been saying the same stuff. Backing up across the east bound lanes of traffic, blocking the
traffic. So the only way that this gets addressed is when one of us in the neighborhood call and
we say something. There's bound and determined that there is going to be something that is
going to happen. They have limo's doing the same things. And I know you instituted the no
parking, no standing zones, is that correct?
SUPERVISOR RUSSELL: Yes.
MR. SHIPMAN: How should they be enforced?
SUPERVISOR RUSSELL: The Southold Town police department.
MR. SHIPMAN: Okay.
SUPERVISOR RUSSELL: Is it no parking or no standing or both?
MR. SHIPMAN: I believe it is no parking, no standing. So on both sides from Depot Lane to
Zuhoski's private road. On both sides of the road, you instituted that as a solution to part of our
problem.
TOWN ATTORNEY FINNEGAN: Actually, I think it's just that side of the road.
SUPERVISOR RUSSELL: That's what I thought.

MR. SHIPMAN: Both sides.
TOWN ATTORNEY FINNEGAN: Is it?
SUPERVISOR RUSSELL: On the north and the south?
MR. SHIPMAN: I have signs on my property borderline and signs on the ex-Helinski property
borderline. So what we are running into is the Hampton Jitney bus size party buses parking there
again.
SUPERVISOR RUSSELL: Okay. We were aware of the problems this weekend, we responded
to the problems and steps are being taken to address those. The police department was out this
weekend, so if somebody was violating the requirements of that sign, I assume they would have
addressed it.
MR. SHIPMAN: Yes. By move on. So what's the sense of having them there? You put them
there because that was, as the Zoning Board said, a very negative effect on the neighborhood
over the last three years. So we went through you, then we went to the Planning Board, then we
went to the ZBA and now it's another circle and I am back to you. You sent me to the Planning
Board and I will share that answer and see how this goes along because that was an interesting
answer. So that's happening now. My wife took pictures of over 60 some odd vehicles on site.
That was also documented with the police department. The last time I documented that was in
September of 2013, so up until September of 2013, they were still doing these violations. And
then all of a sudden in the spring, they were violating their site plan again and then somehow,
they got tent permits. So that is an interesting aspect of it. then in my neighbor's yard, who his
property borders the thing, he makes a police report and I am sure he can share that with you
very shortly, that several women were squatting and urinating in his backyard. So they left a
gift. They left their rolled up toilet paper, some in his trees, the apple trees and some on the
lawn. So, I have young children, he has young grandchildren, I know the majority of you have
either young children or grandchildren because your children attend the same elementary school
that mine do. So once again, we are being subjected to this. And then I went and did an inquiry
on the liquor authority thing and I know Scott is going to roll his eyes because I say the same
thing every time, but now it is updated. So effective October 1, 2011, they were operating under
SABA, that expired on September 30, 2014. So I am sure that is just going to be renewed during
their appeals process which is working on 10 months, so I somehow think along the lines
somewhere there is a little of political play, not saying here, a little bit of political play going on
and they are just stalling to get another season out. The same thing that we have heard. And
then, in the same inquiry, I went to the whole Board meeting with the SLA which was on
December 17th and during that hearing, Chief Flatley was there because he testified countless
hours throughout Nassau Supreme court, Suffolk Supreme court and then back to Harlem for the
full board meeting, it clearly says that their liquor license is revoked. With a bond claim of
$1,000 and then they moved onto appeals. So, in 2014, we are revisiting the same problems we
were having in 2012 and 2013, so on October 18th, there were over 41 cars parked in the parking
lot that's not approved on their site plan which I would like to sit down with hopefully the
Planning Board and obviously the legal interpretation of it and find out which items are being

enforced on the site plan so that we can work with that. they are parking over 10 buses at
Shulman's barn, they are parking there again. they are parking between the vines so now they
have probably around 60 vehicles on site. So who do I ask, who do I touch base with to find out
if there is going to be any action taken on the Supreme court injunction that the town currently
holds? And I hate to be a pain in the neck....
SUPERVISOR RUSSELL: I know, Bill.
MR. SHIPMAN: Because I left mad last month....
SUPERVISOR RUSSELL: Well, the reality is, this is only become a real problem over the last
two weeks. We became aware of it, we have taken steps to address it. The process is slow, it is
as frustrating for us as it is for you. The State liquor authority is very frustrated by this process
because this whole case is sitting before some judge in New York County that is letting it
languish. That is not serving anybody's interest but for the operators interest. They are trying to,
the SLA is trying to shake it loose, so are we. But you know, the reality is that there has to be a
scope and scale issue here. Now they are going beyond the scope and scale of what's
reasonable. Prior to that, they weren't. They are now, so we are stepping in now. And I told
you that a month ago when your concern was what happens if they start doing what they are
doing, I said if that takes place, we will take action. That's what happened, they started doing it
again, we have taken action.
MR. SHIPMAN: But the only reason you are taking action is because I am complaining again.
There's no random patrol of okay, they are violating their site plan or okay, Scott, and I hate to
talk bad about our police department because they do a wonderful job, an outstanding job. So
when the buses are parked on the side of the road and the sector cars are driving by and I am
calling, it's a parking violation. I think you hired a new dispatcher because the lady was actually
nice to talk to. And I am not trying to be sarcastic. It was, we have two vehicles over there now,
we are doing our best to control the situation. Well, how I am feeling is you, not maliciously,
you gave them the tent permits, right, so it gave them an opportunity, okay, they gave them to us,
zinger. You got another one. They did the same thing in May of 2012. They shot everything
down for May, June and then July 4th weekend it kicked off all the up until November because
they knew that there was going to be no action taken by the town. All minimal action. What can
they do? So you gave them something trying to be decent about it and they turned around and
they kicked you. I knew that was going to happen. So instead of being nice, instead of being
accommodating to these people, take a harder stand. I don't like coming here.
SUPERVISOR RUSSELL: We have taken a very hard stand. We have committed a lot of
resources trying to address it, I will agree with you that what looked to be a global resolution of
the case turned out not to be. I think we negotiated in good faith, I don't believe they have and
that is something we are going to address as a Board legally and otherwise.
MR. SHIPMAN: Okay. So this is the point that I am at. Is the same things are happening again.
So now we are documenting it by pictures. We are documenting by videos, okay, so when
actions or minimal action is taken or you step out and you let them, negotiated in good faith,

alright. So the only ones that are suffering are myself and my neighbors. So they are making a
ton of money, the stuff that they are doing there, yes on a smaller scale, yes reduced impact
however you want to put it but they are doing the same things with the pails of sangria okay?
The SLA doesn't find out about that unless the local law enforcement makes a referral. The SLA
on that Board meeting, I printed out two pages, there was something like 20 something pages of
disciplinary actions. So unless the information is given, literally given to the SLA and I have
been bothering them to use their own investigative unit, so if the information isn't related to
them, then I am the guy that is standing up here....
SUPERVISOR RUSSELL: It is.
TOWN ATTORNEY FINNEGAN: Mr. Shipman, the information has been related to the SLA,
okay? Everything you have said tonight we are aware of, they are aware of. You have done
your job to report it, we appreciate that. That's what you can do at this point, is to pass on the
information to Heather in the Planning Board and to the police department and let it take its
course. I understand that it is frustrating to you and it is not happening as quickly as you want
but I assure you that a day doesn't go by in my office that we don't discuss it and things are
happening daily to address it. So I can't make a court issue an order any faster than the court is
going to issue the order. That is the way it is. I know you know Mike Ammirati at the SLA, I
know you have talked to him. He is working very hard on this, he is, you know, I just got a copy
of the letter from the Administrative judge of the New York Supreme Court who is looking into
the issue. They are not sitting back doing nothing, things are happening, things are being done
and the issue is being addressed. Everything that occurred this weekend inside there was
documented and the SLA is well aware of it. I assure you of that. So we have to, we have to let
them do their job. As you know, do not have jurisdiction over what goes on inside of there with
respect to the alcohol consumption, that is for the SLA to deal with. I had a conversation with
them this week and they are addressing it. So you know, as to the traffic issue, I have copies of
the incident reports. There were some minor traffic stops that occurred, there were some
violations issued over the weekend. Everything that was reported by you, by Mr. Zuhoski was
followed up and there are reports reflecting that the police responded. So action is being taken
and it is the season, there is a lot of activity all over the town right now. You look at one thing,
there are 40 others that are very active right now. There's a lot going on and the police
departments resources are called to all those sights for what is going on. And farmstands as well.
So it is a busy time right now, there is going to be more activity at those sites but everybody is
aware of what is going on there and it is being addressed.
MR. SHIPMAN: I understand that activity is high. I have lived here all my life but I am talking
about this in 2014 because I started it in 2011.
TOWN ATTORNEY FINNEGAN: So did I. So did I.
MR. SHIPMAN: I understand that. We are suffering together. Trust me, prior to that, I never
came here unless it was Boy Scouts. Because you are doing an outstanding job but when you
come to this thing here, this particular problem because, I don't want to put it harshly, because

you are trying to be the nice guys or you are trying to be cautious so Ms. Moore doesn't come
back and sue you....
TOWN ATTORNEY FINNEGAN: I would disagree with you on that, okay? Because that is
not what's happening. The Planning Board is taking this very seriously, they are not being
pushed around at all by anything. We are actively discussing things with their attorneys, they
know what the town's concerns are and I can't discuss that any further with you but rest assured,
that all of the issues you observed and that you are complaining about, the town is aware of we
are dealing with it. I know it is not going to happen as quickly as you want it to happen, sir, but
it is being addressed.
MR. SHIPMAN: Technically it's already happened because their liquor license is revoked.
TOWN ATTORNEY FINNEGAN: And there is a court order that allows them to operate and
stay the revocation. So we can't do anything about that.
MR. SHIPMAN: In a limited capacity.
TOWN ATTORNEY FINNEGAN: Absolutely. And they are operating, I would agree with
you, beyond what that order says. And the SLA is aware of that and they are taking that matter
up with the court.
MR. SHIPMAN: Inaudible.
TOWN ATTORNEY FINNEGAN: But unfortunately, it's the same court that isn't quick to
respond, so that's what we are stuck with.
MR. SHIPMAN: Okay. Very nice. Thank you for your time.
SUPERVISOR RUSSELL: Who else would like to address the Town Board on any issue?
Joe Zuhoski
JOE ZUHOSKI: Joe Zuhoski, Middle Road Cutchogue. I just happened to be the individual that
the two young, well, I wouldn't call them ladies, girls or people, decided to use my apple trees as
a bathroom. Called the cops, they came. Unfortunately, I was pressed for time, I was going to a
fireman of the year dinner. I called the cops, Billy was there, we discussed everything and I even
went over and talked to the owners and all was well and good. I left. Well, yesterday morning I
woke up, I was looking out my bathroom window and what the heck, Sunday I decided to take
my old car over to the big dump, to the car show, well, somebody used my steps as a park.
There were two partial glasses of wine sitting on the steps of my deck. That put the icing on the
cake. If I was home, somebody would have been hurt. I mean, they seem to be using my, I am
just fed up with it. it is just up to here, you know, Billy, he is trying to do his best. They are not
playing by the rules.
SUPERVISOR RUSSELL: I just want you to really understand, that I understand Bill is fed up.
We are fed up, too. And over the past couple of weeks it has just been, we are back to the same

old thing. We don't want to have to keep re-visiting this thing anymore than you do. We are as
fed up as you are. We are constrained by a legal process that we are trying to do the best we can
to bring a resolution to that process. We are being held up by the same judge as the SLA and
unfortunately, that's the landscape. But we are doing the best we can, we really are. I know it
seems like we are not but we are.
MR. ZUHOSKI: Okay, thank you.
SUPERVISOR RUSSELL: I will go to you after, Carl.
Joe Zuhoski, Sr
JOE ZUHOSKI, SR: I am Joe Zuhoski, Sr. They are trespassing on my property. I am an ex-
farmer. When I had cattle, we fenced them in. these people are roaming around from hell's
creation. From one end of the vineyard to the other. Is there any way that they can stop from
doing this?
SUPERVISOR RUSSELL: We are trying. We are trying.
MR. ZUHOSKI, SR.: I mean this is, like my son said, this is getting out of hand. People are
going to think all we do is listen and somebody is going to be suffering in the long run. This has
got to be stopped. Gentlemen, it has got to be stopped. It has gone too far.
SUPERVISOR RUSSELL: Carl.
Carl Deliteris
CARL DELITERIS: I am back. I had a couple of issues and I just want to talk about, one was
the vineyards. The reason for these vineyards, these doctors and lawyers and psychiatrists all of
a sudden didn't love wine, this is a tax shelter. And it is, according to small farm act, because
their income is sheltered as they put funds into the small farm. So they have no income tax.
That's the reason for all of this. These are people, not love of wine. You are not getting an old
Italian from there coming in putting up a winery to actually sell wine to make a profit. It has
nothing to do with that. President Clinton came up with the small farm act at one time because
the inheritance tax was so great we were losing all the small farms. They couldn't, when the
farmer died and passed it to his children, they could not pay the inheritance tax at that time. so
the small farm act came in view, which shelters their income to the farm. That is what this is
about. It is not about wine. And I find that the town is almost a coconspirator in evading taxes.
So I am a little bit, well, I have always been (inaudible)to be honest with you.
SUPERVISOR RUSSELL: Look, wineries regardless of the motives of people that invest in
them, they are protected agriculture in the State of New York. The state actually has changed ag
and markets law to accommodate those needs that are a little bit unique to wineries and to these
beer facilities. They are protected. They are agriculture. The town doesn't have the right to say
we are going to allow wineries or we are not. We....
MR. DELITERIS: I understand that. And I am not trying to put that on the town that you
shouldn't. But it is something that should be aware of for the actual motivation for these

wineries that are going up. That is the motivation. Is the small farm act that helps, as you know,
all of them are doctors, lawyers etc., shelters the income. So, I don't know, maybe you want to
look at it differently, if you didn't know that or you did or whatever. But that's, I was just
sympathizing with these guys, to tell you the truth. But what I am here about again is the same
thing as I had before, which is the Memorial Day parade and I had something here which I will
give you which was the $600 prize winning, 1St, 2nd and 3rd place, $300, $200 and $100. And I
believe that we can get it done if we just leave it to seniors.
SUPERVISOR RUSSELL: Yes, I wanted to touch base with you on that because we have had
some discussions with the schools, myself and Phillip. The, we actual had looked for a little
while at a poster contest because it is visual, kids love to participate and you could hang them up
here. The problem we had was, we are already engaging the schools with two different poster
contests. One is through the Anti-Bias Task Force and then one is through the Tree Committee.
There's only so many posters you can expect to sponsor through the schools. Also, the schools
are a little bit in flux right now because of the changes to education. I think it is something the
town is going to have to sponsor if we are going to move forward and then maybe offer it to the
schools. We have a town website, we have channel 22, we have an ad in the papers. Maybe do
it as something that is going to be sponsored through the town. We actually are crafting a couple
of different options. We can't do anything until I bring it back to the Town Board and the Town
Board says yes we want to do that or no, we don't.
MR. DELITERIS: Okay. I was thinking of more of an essay on any war and limiting, because it
would be very hard to be able to figure out who the actual winner is, if you limit it to the seniors,
all of the schools, that that might work. I also got with George Sullivan and we have dress
uniforms that we probably will get for free, you can have my dress uniform and his marine dress
uniform and we would get the other dress uniforms for the mannequins, I don't know if
everybody if familiar with what I am talking about, for the Memorial Day parade and the Legion
has a 7x10 flatbed trailer that we could use. The only problems that I really see if where to keep
it and like I said, I talked to Mr. Orlando and he would certainly be willing to keep it in the town
with the trailer. So I hope we can go forward with something. Give me a call, what you guys are
thinking about.
SUPERVISOR RUSSELL: Absolutely. We had envisioned an essay contest. We had, you
know, one of the things, you came up with the idea of seniors. The one thing we had thought
about because we were trying to make it as inclusive as possible but then we would really need
to segment it by age groups. Because of the, but I would hate to, not to sound like I am trying to
take on more work, just to limit it to seniors. We were hoping to do it a little bit farther and
wider than that. a lot of the youth, a lot of the elementary kids and frankly even juniors who
might like to create some credentials for college, colleges they will be applying for a year later.
Should probably have a great deal of interest in participating in something like this.
COUNCILWOMAN DOHERTY: I was going to say the seniors by that time, I have a senior
right now and we are working on college essays for college, so the junior year would be better
because that serves as their community service.

MR. DELITERIS: I think you need to limit it somehow because...
SUPERVISOR RUSSELL: You are right. It becomes too unwieldy.
MR. DELITERIS: Exactly. Too big of a burden to take on.
SUPERVISOR RUSSELL: I just want to say for the record, I don't have a senior yet because I
am not old enough.
COUNCILWOMAN DOHERTY: Wait a minute. You are older than me by a month.
MR. DELITERIS: So that's where I think I am at now. like I said, I think that the Legion will
put out in its bulletin, if and when the time should come I hope it does, for the rest of the
uniforms. If not, we would have to purchase the uniforms. Uniforms are running, dress
uniforms, around $600. Very expensive for a complete uniform. So that's why I thought, I
spoke with George Sullivan about this and he said whatever you need, I will help you with.
SUPERVISOR RUSSELL: Good.
MR. DELITERIS: So I think we can get more than, maybe all the uniforms, I don't know. And
the mannequins are $140-$150 each, which is not a big deal. And we are looking for some green
turf to put down and a flagpole. And mannequins around the flatbed trailer for the Memorial
Day parade.
SUPERVISOR RUSSELL: That sounds good. I know Vinnie has been certainly as supportive
as he can be to help you however we can get this done.
MR. DELITERIS: Okay. You have my number.

MS. FRANKE: Major Grigonis from Southold school.
SUPERVISOR RUSSELL: Jill had suggested we reach out to Bill Grigonis, which is an
excellent idea. He runs the ROTC program for Southold, Mattituck and Greenport.

MR. DELITERIS: I also spoke to a couple of recruits who (inaudible), something like that. This
can expand and become something a little bit different than usual.
MS. FRANKE: The other thing was at the October 7 meeting, you passed a resolution 815 and it
was for coir logs. I don't know if there was a typo on there or what but it says with a minimum
bid of$1,500. Wouldn't that be a maximum bid?
SUPERVISOR RUSSELL: I can't, I don't have the resolution in front of me. Can I see that?
COUNCILWOMAN DOHERTY: That's the minimum bid for the 75 coir logs.
SUPERVISOR RUSSELL: Okay, these were, they were offered out to bid and we established a
minimum value on what we are going to accept on them.
MS. FRANKE: You are selling them?
COUNCILWOMAN DOHERTY: Yes, we are selling them.
MS. FRANKE: Oh, I thought you wanted a bid for someone, to purchase them.
TOWN ATTORNEY FINNEGAN: No, no. We have them.
MS. FRANKE: Okay. That makes sense. And also the deer issue, with the ticks. What's going
on with that?
SUPERVISOR RUSSELL: We actually recently had another meeting with the east end deer tick
task force and local environmental groups to get them on board. I mean, I certainly understand
the devastating effects of deer on our eco-system. We are trying to touch all bases, there's three
key components here. There is the economic, the environmental and the public health risk.
MS. FRANKE: I attended the meeting up at Riverhead, they had, like two Tuesday's ago. You
may want to contact, I know the guys out here are real territorial and whatnot but Mike Tessitore
for Hunters for Deer, they are doing a pilot program with Remsenburg. There is no cost to the
taxpayers, it is all arranged, everything is all worked out. If somebody doesn't want a specific
hunter for whatever reason on their property, he will arrange that that hunter doesn't go there,
they send somebody else. It is just a matter of opening space to people. Within the first week of
hunting they had already taken down 60-65 deer. They have now purchased a refrigerator and
the guys are also donating some of the deer, like if they get whatever the limit, they will donate
one of them whatever and they are filling up the....
SUPERVISOR RUSSELL: Yes, we already have all of that in place. We have refrigeration, we
have about 700 acres of public land that's part of the deer hunt. Half of that is county land, so all
residents of Suffolk county have access to that. About half of that is the town and we limit it to
town hunters and we have so many hunters that are interested that, you know, it's town owned
land so we thought it appropriate to limit it to town hunters. Most of the hunting that takes place

in Southold is actually on private property and we have urged Mr. Tessitore and others to reach
out to private land-owners who probably would want them to come on site and help them cull the
deer. Agricultural....
MS. FRANKE: I would rather Hunters for Deer do it at no cost to tax payers, not another
$225,000. How many deer did they get? Like 100? Out of all that, they didn't ever get 100 I
don't believe.
SUPERVISOR RUSSELL: I don't even know....
MS. FRANKE: For $225,000. That's over$1,000 a deer.
SUPERVISOR RUSSELL: You are right. I think that the feeling of the time was that something
had to be done and that was what was on the table. Recreational hunting is important, we never
said that wasn't going to be a substantial part of the effort to reduce the herd. It is very robust in
Southold, we have plenty of hunters that are participating in our program. Most of the private
hunting that takes place, Mr. Tessitore needs to engage these landowners to be able to get the
permission to go and hunt of those properties. We can't do that for them. Those are private....
MS. FRANKE: And it's not just the deer that are carrying the ticks. There's seven acres of
woods behind me and on the side of me, as you know and we were loaded with ticks. I don't
want to spray anything. I have kids and my horse and whatnot, so we went and got chickens. So
we have fertilizer from the chickens, we have eggs, we give it to the neighbors. Everybody
comes over and gets eggs and we don't have any ticks in our yard anymore. We are not using
chemicals. So I don't know if that's, I mean, you can't throw chickens around everybody's yard
or like out in the woods because then they are just prey for fox and raccoons and whatnot but it's
something that people may want to look into because you could go out in the yard and you'd
come in and have 200 ticks on you without a problem and now we have none, just from
chickens. So, something you might want to look into. But I thought I would mention that, that
you know, the season hasn't been opened that long and last week they had 60-65 deer. It's a
good program that he is running. Thank you.
