R.O. Welch Asphalt Co. received no formal addendum, as is required by Municipal Law, which specified the sub- mission of more than one price per gallon or an additional applied price per gallon. At the time of the bid opening the other two bidders stated that they had not received any formal addendum from the Town of Southold regarding any change in the bid specifications. When questioned by Super- visor Pell as to the reason for the additional prices, each bidder responded that they had received information request- ing more than one (1) price per gallon through "indirect sources". R.O. Welch Asphalt Co. having been the success- ful vendor of liquid asphalt products to the Town of Southold during the last few years had received no "indirect informa- tion" from any source. The Town Clerk offered the informa- tion that no formal addendum had been sent out regarding the liquid asphalt bid April 3, 1980. Neither had "informal in- formation" been sent to the perspective bidders from the of- fice of the Town Clerk prior to the opening of the bid. At the time of the bid opening of April 3, 1980 R. 0. Welch Asphalt Co. offered to submit an additional price per gallon applied to the Supervisor of the Town of Southold. The Supervis6r declined this offer pending further study of the bid results by the Town Board and Town Attorney. All necessary legal requirements of the bid specifications have been fulfilled by R.O. Welch Asphalt Company. The one (1) price submitted is significantly lower than the next high- est bid of R. Lansdell Bituminous Corp. The bid of R.O. Welch Asphalt Co. is the lowest bid, a valid bid, and more important a bid in the best interest of the Town of Southold. Each bid must be submitted in a sealed envelope clearly endorsed with the name of the person, firm or corporation presenting it. Each bid must be marked "Bid for Asphalt Road Materials" . Said materials must be delivered to and made available in the Town of Southold, to be delivered to trucks of the Town of Southold. The bidder must have not less than 30, 000 gallons of Grace RC-2 material and not less than 30,000 gallons of GRade MC-2 material in heated storage tanks located in the Town of Southold, or delivered to locations in the Town of Southold designated by the Superintendent of Highways, heated to a temperature of not less than 150 degrees Farenheit and available for immediate delivery to trucks of the Town of Southold, as and when required by the Superintendent of Highways for the calendar year 1980 . The bidder must specify the facilities which he will maintain in the Town of Southold for storage of the above materials as well as the location of said storage facilities in the Town of Southold, or the heated tank truck to be utilized in the performance of the contract. Each bid must be accompanied by a "Bidder Certificate” for Asphalt Cut Back, showing the supplier of this material and the location of the plant, and authorizing the Bidder to act as agency for the supplier, in the Town of Southold.
