The material has been tested for target compound list and target analyte list parameters,and for cyanide. In addition a sieve analysis has been performed. (The results of these tests are being forwarded to you under separate cover from Dvirka and Bartilucci). Upon receiving DEC approval for use of the fill as intended,the Town of Southold will begin to make plans for having the material delivered to the landfill. January 22, 1999, RE: W.O. #2142.04 SOUTHOLD LANDFILL CLOSURE CONSTRUCTION AND DEMOLITION DEBRIS LAGOON FILL SOUTHOLD, NEW YORK Dear Mr. Maher. As requested, Tectonic Engineering has reviewed in concept the proposed use of residential construction and demolition debris (C&D) as bulk fill for the landfill lagoon. The lagoon is located in the northwest comer of the landfill along the landfill "footprint edge. The lagoon is about 400 feet long, an average of about 120 feet wide, and about 25 feet deep. ' The use of the C&D for lagoon fill is based on the following technical assumptions: 1. The C&D is of a mixed character, i.e., composed of various materials resulting from residential yard work, earthwork, and building demolition and construction. 2. The total volume of C&D stockpiled on site is about 1,000 CY. 3. Based on our review of the preliminary grading plans for the Southold Landfill closure provided to our office by Dvirka and Bartilucci, the proposed maximum fill over the top of the lagoon surface is about 10 feet. The recommendations for use of the C&D in the lagoon are as follows: • The material should be mixed before being placed to the greatest degree practicable. • The C&D should be placed in 8-inch compacted lifts. • Compaction of each lift should be performed with at least four passes over the complete lift surface using the Town's Fiat-Alice FD30B bulldozer or compaction equipment with an equivalent or greater ground pressure. CIVIL-GEOTECHNICAL• STRUCTURAL ENGINEERS ENGINEERING Mr. Thomas F. Maher, P.E. 2 January 22, 1999 • The C&D should be placed in alternating lifts with the glass sand or other acceptable bulk fill material. As discussed in our letter dated January 19, 1999, the glass sand should be placed in compacted lifts of 9 inches and compaction of the glass sand should be performed with at least two passes of the bulldozer. • No significant quantities of materials that create hydrogen sulfide, such as gypsum board, should be landfilled. •• The C&D should only be deposited at an elevation that is at least 5 feetabove the seasonal high groundwater level. In summary, if the above assumptions and recommendations are followed, the C&D should be acceptable for use as fill in the lagoons. Please call me if you have questions. Terry Contracting agrees to provide the same information for any additional vehicles it may use under the contract that are not on the original list, such information to be provided before said vehicle delivers its first load. The Town reserves the right to check the capacity of any truck and/or trailer used by Terry Contracting under this agreement,either through taking measurements of volume or through calculating vehicle weights (loaded and/or tare)using the Town's truck scales located at the Cutchogue landfill. 7) Terry Contracting&Materials,Inc. will comply with all applicable federal, state,and local laws and regulations concerning transportation of clean fill. 8) Either party may terminate this agreement,for any reason,with at least 24 hours notice to the other party. Such termination will not absolve either party of their responsibilities under this agreement while the agreement was in effect. I have learned the following regarding the status of the soil and the needs of both parties regarding the deal: THE SOIL 1) The soil in question is primarily the arsenic-contaminated material that originated from the construction site at Depot Lane and Rte. 48;originally estimated at 3,700 cubic yards, it is now estimated to total approximately 2,100 cubic yards; the DEC has authorized the landfill to accept up to 3,700 yards. 2) The soil was initially spread and graded across virtually the entire Mitchell Park site before some of it was excavated and heaped in the stockpile currently visible at the property, in preparation for removal; (excavation work was stopped as the DEC stepped in to review the situation and determine a clean-up plan); 3) The rest of the soil taken from Depot Lane/Rte. 48 is still spread over other areas of the property and is now to be excavated as part of this project;Village references to `the pile' apparently were not meant to exclude the soil that is stili spread about; 4) The soil samples analyzed by H2M(the results of which were the basis for DEC approval to accept the soil at the landfill)were taken from all areas of the site, including the visible stockpile as well as from several of the smoothly-graded locations; 5) Given the fact that the soil has come into contact with the ground, it is possible that some soil to be excavated will include material that was not part of the original soil brought from Depot Lane/Rte. 48; MEMORANDUM re: *11 Park Soil j p. 2 THE PLAN 1) The plan is to move the approximately 2,100 cubic yards of contaminated soil to the Cutchogue landfill for placement under the cap, which will be constructed next year. 2) The Village will provide for all labor and equipment to do the work, and will comply, under contract with the Town, with all applicable laws and regulations and other conditions stipulated by the Town. VILLAGE ISSUES/RESPONSIBILITIES 1) The Village must excavate a variety of soils from the site,only some of which it seeks to deliver to Cutchogue; 2) The Village's bid specifications call for the contractor to segregate any soil destined for Cutchogue from any other materials at Mitchell Park; 3) The Village's bid specifications incorporate a DEC requirement for further testing of any soil destined for Cutchogue. The test to be performed is called `TCLP',which stands for`Toxics Characteristics Leaching Procedure.' It tests for a variety of contaminants, as well for their tendency to leach out of the soil into surrounding materials. It is regarded by DEC as providing a complete characterization of the threat posed by contaminated materials. 4) THE VILLAGE IS REQUIRED TO GET THE TCLP RESULTS PRIOR TO MOVING ANY SOIL TO THE LANDFILL. The DEC will review the results and authorize the removal of the soil. 5) The Village plans to begin work on the excavation on Monday, September 11. it does not expect the contractor to be ready to move soil to the landfill until at least the end of that week, more likely the following week. TOWN ISSUES/RESPONSIBILITIES 1) The Town will draft a contract between the Town and the Village outlining roles, responsibilities, and conditions; the Town will secure signatures on the contract prior to allowing soil to be delivered; 2) DEC approval of TCLP results should be a condition of accepting the soil; 3) The Town will require the Village to provide a complete listing of trucks transporting the soil, including license plate#s and volume capacities; 4) The Town will keep track of both tonnage and volume of soil deliveries,and will provide this data to the Village on a daily basis; 5) I will personally visit the Mitchell Park property after excavation begins to familiarize myself with site activities and observe the handling of soils designated for delivery to the landfill. This report should also include a construction quality assurance and construction quality control plan of the final cover system design meeting the appropriate provisions of 360-2.13. 1. Response The Department approved Final Closure Plan dated December 1998 provides a detailed stability analysis. The analysis evaluates the stability of the capping system on the east side of the landfill where there will be steeper slopes in some areas (i.e., 33%). The Mitchell Park soil will be used on the west side of the landfill where the slopes are four percent, and, therefore, slope stability is not a concern with respect to subgrade soils. Please note that the construction quality assurance and construction quality control program for the landfill closure construction is described in detail in the approved contract documents and specifications, which were submitted to the Department in October 1999. The department has reviewed the analytical data provided and has no objection to the use of this material as general fill/contour grading material, provided that this material be used underneath the cap at the Southold Landfill. The use of clean fill or contaminated soil, which are both solid waste materials, is subject to the provisions of subdivision 360-2.13(w), equivalent design. The equivalent design provisions would allow the clean fill or contaminated soil from the Mitchell Park site to be accepted at the landfill without counting the waste material as part of the permitted daily throughput of the landfill,providing that these materials are placed as part of the construction of the landfill's approved closure plan. As outlined in subdivision 360-2.13(w), when the equivalent design involves the substitution of waste materials as a component of the landfill's final cover system, and where the material substitution is within the landfill's environmental containment system, as is proposed in this closure plan, the equivalency determination is not subject to the variance requirements of Part 360 and the use can be deemed consistent with the predetermined beneficial use provisions of Part 360-1.15(b)(10). However, before the equivalency determination can be granted by the Department, the following issues will need to be addressed by the facility: 1. The final closure design needs to be supported by a engineering report attesting to the proposed final cover systems design being stable inaccordance with the provisions of 360-2.7(b)(6).
