Chairman Wilcenski: Good evening ladies and gentlemen. Welcome to the regularly
scheduled Southold Town Planning Board Meeting for October 6, 2014. First order of
business:
SETTING OF THE NEXT PLANNING BOARD MEETING
Board to set Monday, November 3, 2014 at 4:30 p.m. at the Southold Town Hall, Main
Road, Southold, as the time and place for the next regular Planning Board Meeting.

SET HEARINGS
Chairman Wilcenski: Gordon. Estate of Albert H. - This proposed Lot Line Change
will transfer 0.58 acres from SCTM#1000-9-7-8.2 to SCTM#1000-9-7-8.3. Lot 8.3 will
increase from 0.30 acres to 0.87 acres and Lot 8.2 will decrease from 3.56 acres to 2.9
acres located in the R-80 Zoning District. The property is located on the corner of
Halcyon Avenue and Oceanic Avenue, Fishers Island.
Pierce Rafferty: Mr. Chairman, I would like to offer the following resolution:
WHEREAS, this proposed Lot Line Change will transfer 0.58 acres from SCTM#1000-
9-7-8.2 to SCTM#1000-9-7-8.3. Lot 8.3 will increase from 0.30 acres to 0.87 acres and
Lot 8.2 will decrease from 3.56 acres to 2.9 acres located in the R-80 Zoning District; be
it therefore
RESOLVED, that the Southold Town Planning Board sets Monday, November 3, 2014
at 4:31 p.m. for a Public Hearing upon the map entitled "Survey Map Prepared for
Estate of Albert H. Gordon", prepared by Richard H. Strouse, Land Surveyor, dated
November 20, 2009.

Line Change will transfer 0.02 acres from SCTM#1000-9-2-13.1 to SCTM#1000-9-2-15.
Lot 15 will increase from 1.28 acres to 1.29 acres and Lot 13.1 will decrease from 7.13
acres to 7.12 acres located in the R-80 Zoning District. The property is located on the
corner of Crescent Avenue and Central Avenue on Fishers Island.

80/60 Conservation Subdivision Open Development Area of four parcels SCTM#s1000-
17-4-16, 1000-17-6-14.2, 1000-18-3-30.3 and 1000-18-6-17.3 (total area = 112 acres)
into 17 residential lots, with 94 acres to be preserved. This project includes the transfer
of yield pursuant to §240-42 F of the Southold Town Code.
SCTM#1000-17-4-16 (North Dyer) equals 21 acres proposed to be subdivided into 6
lots where the lots range in size from 0.7 - 0.9 acres. This property includes a 0.7 acre
private right-of-way and 15.6 acres of preserved subdivision open space inclusive of 6
acres of unbuildable lands. North Dyer is located on the n/s/o NYS Route 25,
approximately 366 feet west of Oysterponds Lane, in Orient.
SCTM#1000-17-6-14.2 (South Dyer) equals 35.3 acres proposed to be subdivided into
6 lots where the lots range in size from 0.5 - 0.9 acres; property includes a 0.5 acre
right-of-way and 28.5 acres of open space inclusive of 15 acres of unbuildable lands.

South Dyer is located on the s/s/o NYS Route 25, approximately 460 feet west of
Oysterponds Lane, in Orient.
SCTM#1000-18-3-30.3 (North Brown) equals 28.7 acres proposed to be subdivided into
5 lots where the lots range in size from 0.7 - 0.8 acres. This property includes a 1.2 acre
private right-of-way and 23.7 acres of open space inclusive of 2 acres of unbuildable
lands. North Brown is located on the n/s/o of NYS Route 25, approximately 2,223 east
of Platt Road, in Orient.
SCTM#1000-18-6-17.3 (South Brown) equals 26.9 acres proposed to be subdivided
where Lot 1 equals 0.92 acres. This property includes 25.5 acres of open space
inclusive of 1 acre of wetlands. South Brown is located on the s/s/o NYS Route 25,
approximately 1,960 feet east of Platt Road, in Orient.

WHEREAS, this proposal is for an 80/60 Conservation Subdivision Open Development
Area of four parcels SCTM#s1000-17-4-16, 1000-17-6-14.2, 1000-18-3-30.3 and 1000-

South Brown" prepared by Nathan Taft Corwin III, Land Surveyor, dated April 1, 2011
and last revised October 22, 2013.

SUBDIVISIONS - SKETCH DETERMINATIONS
Chairman Wilcenski: Ski (Przyborowski, Chemerynski & Blomguist) - This proposal
is for a Standard Subdivision of a 4.98 acre parcel into two lots where Lot 1 = 3.05
acres and Lot 2 = 1.93 acres located in the R-80 Zoning District. The property is located
at Montauk Avenue & Oriental Avenue, Fishers Island. SCTM#1000-10-10-8.1
Pierce Rafferty: Mr. Chairman, I'd like to offer the following resolution:
WHEREAS, this proposal is for a Standard Subdivision of a 4.98 acre parcel into two
lots where Lot 1 = 3.05 acres and Lot 2 = 1.93 acres located in the R-80 Zoning District;
and
WHEREAS, on July 2, 2014, the agent submitted the Sketch Plan Application and
Sketch Plans; and
WHEREAS, on July 21, 2014, the Planning Board, at their Work Session, reviewed the
application and found it incomplete with items to be submitted; and
WHEREAS, on August 21, 2014, the agent submitted items requested at the July 21,
2014 Work Session; and
WHEREAS, on September 12, 2014, the Planning Board, at their Work Session, found
the application complete and that all requirements have been met pursuant to Article V
Sketch Plat; be it therefore
RESOLVED, that the Southold Town Planning Board hereby grants Conditional Sketch
Plan Approval upon the map prepared by Richard M. Strouse, Land Surveyor, entitled
"Standard Subdivision prepared for Jane Chemerynski, David Blomquist & Jimmy
Przyborowski", dated June 16, 2014 and last revised July 24, 2014 with the following
condition:
1. Submission of all Preliminary Plat requirements pursuant to §240-16
Submission and §240-17 Technical Requirement of the Southold Town Code.

SITE PLAN DETERMINATIONS
Chairman Wilcenski: I am going to recuse myself from Royalton Equestrian. Vice-
Chairman Jim will read that.
Vice-Chairman Rich: Royalton Equestrian -This Site Plan is for the proposed
construction of a 120' x 240' (28,800 sq. ft.) indoor riding ring on an existing horse farm
for the purpose of keeping, breeding, raising and training of horses, and not open to the
public. Existing on site are two horse barns, a roofed horse-walker, and a single family
dwelling and garage on 37 acres in the A-C Zoning District. The property is located at
55 Cox Neck Road, ±50' across from Westphalia Road, Mattituck. SCTM#1000-113-7-
19.23
At this point, based on current information received today, I would ask a motion that we
put this determination on hold, table it until we can talk with counsel and review the
information that was supplied to us today.

PUBLIC HEARINGS
Chairman Wilcenski: 6:01 p.m. - Sidor Family - This proposal is for an Conservation
Subdivision Open Development Area of a 61 acre parcel into three lots where Lot 1
equals 2.6 acres, Lot 2 equals 2.7 acres, Lot 3 equals 1.8 acres, located in the A-C
Zoning District. This property includes a LIPA Easement and 53.9 acres of preserved
open space. The property is located at 2010 Oregon Road, on the s/s/o Oregon Road,
approximately 1,305' e/o Mill Road, in Mattituck. SCTM#1000-100-4-4
Martin Sidor: Have the record show that I will recuse myself on this, as I am one of the
principals.
Chairman Wilcenski: Martin Sidor is recusing himself. At this time, I'd ask anybody
from the audience who would like to speak to the Board in regard to the Sidor Family
Public Hearing, please step to one of the podiums. Please write your name, and state
your name for the record.
Patricia Carroll: My name's Patricia Carroll. I'm here on behalf of the applicant, the
Sidor Family. You've basically stated all of the details that are before the Board. We
have a Conservation Subdivision Application with an Open Development Area. This
application would result in 53.9 acres of preserved farm land. And this has been

recognized as a priority for the State, the Town, and many other local municipalities,
especially given the rural history of this area. I think this is a very important priority for
the Town, and we would respectfully request that this application be approved.

Chairman Wilcenski: 6:02 a.m. -Josephson. Zapf& Dow - This proposed Lot Line
Modification transfers 0.01 acre from SCTM#1000-17-2-6.1 to SCTM#1000-17-2-1.9.
Lot 6.1 will decrease in size from 2.68 acres to 2.67 acres; Lot 1.9 will increase from
2.02 acres to 2.03 acres located in the R-40 Zoning District. The property is located at
900 Birds Eye Road and 725 Munn Lane, on the east side of Birds Eye Road,
approximately 500 feet north of NYS Route 25, Orient.
Chairman Wilcenski: At this time, I'd like to ask anyone if they would like to address the
Board on Josephson, Zapf& Dow. Please state your name and write your name for the
record. And direct your comments to the Board.
Karen Hoeg: Good evening. Karen Hoeg. I'm an attorney with Twomey, Latham, Shea.
I'm here on behalf of the owners, Josephson & Dow. The application, as you said, is
for the transfer of a small part of the property, 264 square feet of land. The reason for
the Lot Line Modification request is to provide access to a pre-existing garage. Each lot
is considered a recognized lot pursuant to the Town Code, and they are located in the
R-40 Zone. The affidavits of posting and mailing have been timely submitted. And I am
unaware of any opposition. I respectfully request approval of the application.

William Cremers:
WHEREAS, this proposal is for an Open Development Area of a 61 acre parcel into

WHEREAS, on August 27, 2014, referrals were sent to the following agencies:
1. Local Water Front Revitalization Program Coordinator
2. Office of the Town Engineer
3. Mattituck Fire Department
4. Suffolk County Department of Health Services
5. Suffolk County Planning Commission; and
WHEREAS, on September 4, 2014, the agent submitted items requested at the August
18, 2014 Work Session; and
WHEREAS, on September 9, 2014, the Planning Board set the Public Hearing for the
October 6,,2014 Public Meeting; and
WHEREAS, on September 16, 2014, the Mattituck Fire Department responded to the
referral request; and
WHEREAS, on September 19, 2014, the Suffolk County Planning Commission
responded to the referral request; and
WHEREAS, on October 1, 2014, the Town of Southold Local Waterfront Revitalization
Program (LWRP) Coordinator reviewed this application, and has recommended the
proposed project be found consistent with the policies of the Southold Town LWRP;
and
WHEREAS, on October 2, 2014, the Office of the Town Engineer responded to the
referral request; and
WHEREAS, the Planning Board has been made aware of flooding due to storm water
run-off from the above-referenced parcel to Wickham Avenue. The applicant is working
with the Suffolk County Soil and Water Conservation District to create a plan to control
the storm water run-off through farming practices; and

WHEREAS, on October 6, 2014, the Planning Board, at their Work Session, reviewed
the responses from requested agencies and incorporated the comments into the
application. The Board found that all requirements have been met pursuant to Article V
Sketch Plat; and
WHEREAS, on October 6, 2014, the Public Hearing was held and closed; and
WHEREAS, an executed contract for the Sale of Development Rights on 53.9 acres
exists and is on file with the Town of Southold Land Preservation Department; be it
therefore
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is consistent with the policies of the Town of Southold Local Waterfront
Revitalization Program.

authorizes the Chairman to endorse the map.
