From everything I read in the paper I thought this kind of development is not good for the bay and ground water. Please let me know. The NSWF said it's going to be very low key and not effect the community or bay. I think if you put 1200 feet of new decking on Peconic Bay and serve alcohol and food its going to be very busy. Thank you Daniel Petrie 1 • • Cantrell, Elizabeth From: Germaise, Victoria <Victoria.Germaise@elliman.corn> Sent: Monday, October 20, 2014 12:55 PM To: Cantrell, Elizabeth j Subject: New Suffolk Waterfront OCT 2 0 711 'J 727 Dear President Bredemeyer, +T;. I am writing to implore you to please consider the negative impact which the proposed New Suffolk Waterfront site plan will have on our tiny hamlet. The size and scope of this commercial venture is not consistent with the basis upon which funding was raised. Where we had been promised preservation by the New Suffolk Waterfront Fund, we were presented with plans for a restaurant, a large septic system, surrounded by a retaining wall and a large parking lot. All this in a high flood zone with a fragile eco-system. The Southold Town website states: "It is the purpose of the Town Trustees to administer all activity within 100 feet of the town's wetlands and the underwater lands owned by the Trustees for its citizens (also known as 'common lands'."For its citizens! So too the NSWF was formed to protect the citizens of New Suffolk from further unwanted development. Thus the NSWF Board, became the owners and trustees of our land. It should take a lesson from town law and act on behalf of New Suffolk's citizens instead of usurping the use of the land against the wishes of the majority of the community for its own ill-conceived purposes. Who will protect New Suffolk from this organization whose self-appointed board operates with impunity and no independent oversight? Hopefully, you will, Sir. Peconic Land Trust 10/18/13 • We are New Suffolk residents concerned about the New Suffolk-Waterfront Fund's restaurant plans and its Aug.15 letter. Here are some of the issues troubling us: • The Suffolk County Department of Health (SCDH) Wastewater Management rejected NSWF's application on June 2, 2014, the date of the first Planning Board hearing, but NSWF chose not to tell the community until the August 15 letter. • NSWF's modified plan now has a lower but larger septic that requires removal of the barn, after touting it as "historic" at the July 12th schoolhouse meeting. • If NSWF goes ahead with a new Galley Ho restaurant and removes the barn, there will be no facility for the community's use. • NSWF says they are responding to the community by setting rules for special events, but they are still planning event rentals, now with "parking outside the hamlet. . ."Will they bus people in? • NSWF is still ignoring community input, informing us what they had done after the fact, just the way did with the original plan. They are still planning a 66 seat restaurant with noise, garbage, traffic, delivery trucks and parking problems. • NSWF said "roundtable" discussions would take place in August, but now they've announced: "Once we have approvals for the renovation of the Galley Ho, we will be hosting roundtables to discuss the details of its use." What is the point of meetings after the site plan is approved? IMPORTANT QUESTIONS NEED HONEST ANSWERS: • Why hasn't the Waterfront, purchased with community donations and volunteerism, been transferred to the residents of New Suffolk as promised? • How did a small group of self-selected individuals, many of whom are either part- time or non-residents of New Suffolk, become the owners and sole decision- makers for the Waterfront? • Why is a private restaurant more important than the long-promised use of the Galley Ho for the community's benefit? • Why did the NSWF abandon its obligation to protect and preserve the Waterfront and pursue commercial development instead? We want the site plans withdrawn, the Waterfront protected from development, the NSWF re-structured to reflect the community's wishes, and the property transferred to New Suffolk residents as was intended. Hope to see you at the NSCA 9/13 meeting. • S John Bredemeyer, PresidentoguFFat Town Hall Annex Michael J. Domino, Vice-President °°\ c°s; 54375 Route 25 James F. King 5! P.O. Box 1179 Charles J. Dear Mr. Wilcenski: As per a request from your office, I have written this letter to address concerns about tidal flooding related to the New Suffolk Waterfront Fund Site Plan. It is my understanding that a number of citizens have raised concerns that the construction associated with this project, specifically the raised bulkheads and septic system, will exacerbate the periodic tidal inundation experienced in the New Suffolk waterfront area. Please note that the height of tidal inundation is a function of the phase of the moon and the intensity and prevailing direction of the wind. No amount of filling or bulkheading of this or any other property in New Suffolk can have an appreciable effect on the ultimate height of water during a normal tidal cycle or during a storm. Raised bulkheads and/or filled property only serve to protect the individual property and comply with all applicable building regulations. St' LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM SEP 52014 J Southold Town To: Donald Wilcenski, Chair Planning Board Town of Southold Planning Board ( From: Mark Terry, Principal Planner !,EI ' `7 LWRP Coordinator y!, Date: September 5, 2014 Re: LWRP Coastal Consistency Review for New Suffolk Waterfront Fund, nc. SCTM# 1000-117.-8-18 _ This proposed Site Plan is for the re-location, renovation and addition of 47 sq. ft. to the historic Galley Ho restaurant building, totaling 1,725 sq. ft., to include a 66 seat restaurant and 16 slip marina on 2.3 acres in the M-II Zoning District. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department and the records available to me, the proposed action is CONSISTENT with the LWRP specifically: Policy 10. Protect Southold's water-dependent uses and promote siting of new water-dependent uses in suitable locations. The intent of this policy is to protect existing water-dependent commercial, industrial, and recreational uses and to enhance the economic viability of water-dependent uses by ensuring adequate provision of infrastructure for water-dependent uses and their efficient operation. This is relevant to Southold because other important concentrations of water-dependent uses are located at Orient Point.... New Suffolk.... 10.1 (a) Protect existing water-dependent uses. The term Water-dependent use means a business or other activity which can only be conducted in, on, over, or adjacent to a water body because such activity requires direct access to that water body, and which involves, as an integral part of such activity, the use of the water. Existing uses should be maintained and enhanced where possible and appropriate. This action maintains the existing use as a marina. • 10.1 (b) Improve the economic viability of water-dependent uses by allowing for non-water dependent accessory and multiple uses, particularly water enhanced and maritime support services where sufficient upland exists. The term water-enhanced use means a use or activity which does not require a location adjacent to coastal waters, but whose location on the waterfront adds to the public use and enjoyment of the water's edge. Water-enhanced uses are primarily recreational, cultural, retail, or entertainment in nature. These uses may be necessary for the successful financial operation and viability of water-dependent uses. The preservation and operation of the culturally significant Galley Ho restaurant building, (a water enhanced use) adds to the public use and enjoyment of the historic waterfront area. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. If you concur, please include this document in the findings of the Southold Town Board of Trustees meeting, October 22, 2014. Sincere , Patricia E. Box 146, New Suffolk, NY 11956 ❖ www.newsuffolkwaterfront.org 4111 ; OCT 21 I i 275- 12 Standards for Issuance of Permit iJ ,,0 n The Trustees may adopt a resolution directing the issuance of a permif to perform operations applied for only if it determines that such operations will not substantially: A. Adversely affect the wetlands of the Town. Will not substantially adversely affect the wetlands of the Town in that the subject property is bulkheaded. Beach area is remote from parking and improvements. B. Cause damage from erosion, turbidity or siltation. Will not substantially cause damage from erosion, turbidity or siltation in that the subject property is bulkheaded. On site drainage will be provided, grading and plant material will control erosion. Large surfaces will be permeable, not paved. C. Cause saltwater intrusion into the fresh water resources of the Town. Will not cause saltwater intrusion into the fresh water resources of the Town because there are no above ground fresh water resources on or near the property, and the sanitary system meets Health Department standards. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof. Will not substantially adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof. Installation of a new septic system, on a smaller scale than the previous system and built to current code, will decrease septic load. Rainwater will be contained on site and not cause runoff into the bay. Native plant material will provide habitat. E. Increase the danger of flood and storm-tide damage. Will not substantially increase the danger of flood and storm-tide damage. All proposed building is upland, at a considerable distance from the bulkhead. Bulkhead was recently renovated and increased in height, decreasing potential storm surge damage. Also see letter from Town Engineer, dated 8/18/2014. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the Town. Will not substantially adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the Town. All this work is upland behind the bulkhead. G. Change the course of any channel or the natural movement or flow of any waters. Will not substantially change the course of any channel or the natural movement or flow of any waters. All this work is upland behind the bulkhead. H. Weaken or undermine the lateral support of other lands in the vicinity. Will not substantially weaken or undermine the lateral support of other lands in the vicinity, as there is no activity which affects lateral support of other lands. I. Otherwise adversely affect the health, safety and general welfare of the people of the Town. Will not adversely affect the health, safety and general welfare of the people of the Town. Proposed improvements and renovations on the property will make it safer. Will provide substantial open space for public recreation, guaranteed in perpetuity by an easement held by New York State Department of Parks, Recreation and Historic Preservation. Public access to Peconic Bay National Estuary as well as to the property's renovated marina will be available. Scenic vistas will be protected. The property will be landscaped with native plant materials, which require minimal water once established. Mil zoning allows very intensive lot coverage and uses, but this proposal is for extremely limited development. i J. Adversely affect the aesthetic value of the wetland and adjacent areas. Will not substantially adversely affect the aesthetic value of the wetland and adjacent areas. The proposed work will provide increased aesthetic value to the adjacent areas because it includes renovation of a presently dilapidated building as well as extensive landscape work. The building renovation is in character and scale, and the site plan provides 95% open space with appropriate plantings for the waterfront location. The proposed work will provide the public with Peconic Bay vistas in perpetuity, in a park-like setting, and will restore vitality to the property. OCT 1 6 2014 From: Mark Terry, Principal Planner I Y.— LWRP Coordinator Date: October 15, 2014 Re: Proposed Wetland Permit for NEW SUFFOLK WATERFRONT FUND SCTM# 1000-117-8-18. Patricia McIntyre on behalf of NEW SUFFOLK WATERFRONT FUND requests a Wetland Permit to permanently relocate the "Galley Ho" and associated features; renovate 1,200sq.ft. of the building, replacing 478sq.ft. of storm destroyed section of building, construct a new 47sq.ft. addition to building, and for the installation of a storm water management system of gutters to leaders to drywells; construct 1,612sq.ft. of wood decking attached to building with two (2) sets of steps (70sq.ft.) to grade; install a 10,560sq.ft. parking lot with French drains; construct a 450sq.ft. long handicap access ramp to building; install a 480sq.ft. concrete walkway along eastern edge of parking lot with a set of 98sq.ft. of steel steps to grade; install a 210sq.ft. concrete walkway along southern edge of parking lot; construct a 200sq.ft. bridge/deck on the landward side of the bulkhead; install a 2,325sq.ft. non-turf buffer along the eastern bulkhead; and install a northern 1,280sq.ft. non-turf buffer on the seaward side of proposed parking area. Located: 650 First Street, New Suffolk. SCTM# 117-8-18.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department and the records available to me, the proposed action is CONSISTENT with the LWRP specifically: Policy 2. Preserve historic resources of the Town of Southold. 2.1 Maximize preservation and retention of historic resources. A. Preserve the historic character of the resource by protecting historic materials and features or by making repairs using appropriate methods. • B. Provide for compatible use or reuse of the historic resource, while limiting and minimizing inappropriate alterations to the resource. C. Minimize loss of historic resources or historic character when it is not possible to completely preserve the resource. 1. Relocate historic structures only when the resource cannot be preserved in place This action attempts to preserve the SPLIA listed building known as "Galley Ho" and meets this policy. Policy 10. 10.1 (b) Improve the economic viability of water-dependent uses by allowing for non-water dependent accessory and multiple uses, particularly water enhanced and maritime support services where sufficient upland exists. The term water-enhanced use means a use or activity which does not require a location adjacent to coastal waters, but whose location on the waterfront adds to the public use and enjoyment of the water's edge. Water-enhanced uses are primarily recreational, cultural, retail, or entertainment in nature. These uses may be necessary for the successful financial operation and viability of water- dependent uses. The preservation and operation of the culturally significant Galley Ho building, (a water enhanced use) adds to the public use and enjoyment of the historic waterfront area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. PREPARED BY Patricia McIntyre TITLE NSWF, Chair DATE •902 Amended on 8/1 i05 I 1111 NEW SUFFOLK WATERFRONT FUND creating the future of our waterfront September 26, 2014 To John Bredemeyer and Southold Town Trustees, We are submitting all required materials for a Trustee permit to relocate the Galley Ho building. The building was originally located 18 feet from the bulkhead, but since Hurricane Sandy has been supported on cribbing waiting for a new foundation at its proposed location, 75 feet from the bulkhead. We have provided planted buffers along the northern bulkhead, and in the area adjacent to our 6 foot wide planked walkway along the eastern edge of the property. Per the attached planting schedule, please note that our landscape architect has specified native and drought tolerant plantings. Run-off will be contained on site, in cisterns, French drains, and a vegetated swale alongside our eastern walkway. In addition to the material required for our application,we are submitting several documents which we believe will further clarify our application-an Editorial written by Bob DeLuca, President of Group for the East End in support of the environmental aspects of our proposal, a letter from Michael Collins, Town Engineer responding to flooding concerns voiced by the community, The Planning Board's SEQRA determination, NYS DEC letter to the Planning Board acknowledging Town of Southold as Lead Agency for SEQRA, an LWRP compliance review written by Mark Terry, Town Planner. We believe that our modest site plan sensitively responds to planning criteria and environmental concerns, and hope it will be considered positively by the Trustees. Sincerely, "k"/771*-- Patricia E.
