Onsite review of the approved plans and the written permit terms of Wetland Permit 8509 revealed a discrepancy between them that compels the Trustees to adhere to the written terms of permit 8509 as advised by counsel. Accordingly, we appreciate that you are honoring those written permit terms by agreeing to broadened the non-turf buffer by our measured and flagged approximate 2' (feet) addition, that we marked on May 20th. We also appreciate that the fence relocation to the landward edge of the above newly flagged boundary was being expedited by Mr. Zoitas in our presence. It is my understanding that your client, Mr. Zoitas, subsequently met with Assistant Town Attorney, Lori Hulse on Wednesday 5/7/14 in her office: The permit application submission must be a"Full" Wetland Permit application with associated as-built fee of$500 and contain at a minimum the terms and conditions enumerated by then Southold Town Trustee President, Jim King and Lori Hulse in discussions leading to agreements with Mr. Zoitas and his advisor on 7/30/13, allowing minor changes to the prior approved plan dated 6/9/10 by providing for a 4'wide walk-way instead of 3', a fence at 40'from the bluff instead of 55' and plantings of a substantially similar make up to the 6/9/10 plan. The recent submission of your client is deficient in that the plans propose a fence within 20' of the bluff, not located at least 40 feet from the bluff and the plantings proposed are inadequate in number and species. The Baccharis proposed will not likely survive in this location due to a number of factors, whereas the plantings proposed on the 6/9/10 plan are appropriate for this site. Your fleeting suggestion of the possibility of yet another meeting with Mr. Zoitas, yourself, myself, Ms. Hulse/others is rejected out of hand. Your client was I afforded the opponity to meet again with Ms. Hulse thisfednesday as noted above. Speaking on behalf of the Board, we are not in a position to negotiate with you/your client or mediate any interest(s)of your client while the property remains in substantial violation of our code and the return wetland permit application submission does not comport with the conditions set forth in the agreement of Lori Hulse and Jim King and Mr. Zoitas on 7/30/13 that was to effectuate settlement. Absent a compliant wetland permit application submission consistent with the said prior agreed to terms, I would request any questions you have be directed to Assistant Town Attorney, Ms. Lori Hulse.
