Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant proposes to remove an existing two car garage with a non-conforming setback from the road. This action will greatly improve the streetscape for the entire neighborhood. In addition,the work to be completed on the house will only minimally increase the footprint by squaring off a portion on the building and adding new decks and entry ways. 2. Town Law 267-b 3 2 .The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance because any expansion of the house will require a variance due to it's proximity to the wetlands. 3. Town Law &267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing approximately 500/6 relief from the code at its most severe measurement. However,none of the existing setbacks of the house will be decreased and the front yard non-conforming setback will be eliminated after removal of the garage. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and has submitted a plan to comply with all current drainage and run off which will greatly improve the conditions that's currently exist on the property.Additionally,the Southold Town Trustees required the establishment of a naturally vegetated 10 foot wide, non-turf vegetated, buffer landward of the bulkhead under permit#7765. The applicant will be required to conform to the recommendations of the LWRP memorandum. 5. Town Law&267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267-b. The applicant also proposes to demolish die existing garage. In order to proceed with this matter, compliance with 4 236 of tlic Southold Town Code is required. This SWPPP complies with the performance standards set forth in 4 236-13 of the Southold 'Town Code. The Town's Stormwatcr Code requires that site erosion, sedimentation and stonnwater runolf control measures be appropriate for existing topography, vegetation and other salient natural feature of the site. This SWPPP is intended to minimize grading and cut and fill operations, ensure general conformity with natural topography, and retain natural vegetation and trees to the Maximum extent practicable in order to create the least erosion potential and handle adequately die volume and rate or velocity of'surface water runoff. No stonnwater will be diverted to another property, or onto Beachwood Road, either during site preparation or alter development. 4236 of tlic Town Code establishes performance controls that are satislied in this SWPPP. They include: 1. The appropriate control of erosion, sedimentation and stonnwater runoll'prior to, during and after site preparation and construction; 2. The implementation ol'appropriate measure for dust control during grading operations; 3. The protection of areas exposed by site preparation and during site construclion with hay bales; 4. The substantial preservation of natural drainage patterns by site design; and 5. Careful site preparation, including timing of llic stripping of vegetative cover and grading, so that no individual building site is stripped of its vegetation cover more than 30 days prior to commencement of construction through irnplementalion of a reasonable schedule to minimize the amount of time for site clearing, construction and restoration. Section 2: Project Description Applicant proposes to demolish die existing single family residence, and replace it with a new single family residence on a similar footprint. The applicant also proposes to demolish the existing garage. §236-10 requires that a Drainage Control Permit be obtained because proposed grading or stripping of the parcel in excess of 5000 square fcct is proposed. In order to obtain a Drainage Control Permit compliance with the standards set forth in §236-13 is required. Included in this Storm Water Pollution Prevention Plan is a Sltc Erosion/Sedimentation and Storm Water Control Plan prepared by Joscph Fischetti, P.E. dated August 16"', 2012. Section 4: Description of Soils Present at Site Soils Lound on the sub.ject parcels consist ol'the following: Be Beaches, 0 to 3 percent slopes (5.1%of,lot area) Fd Fill land/Dredged material (94.9%of*lot area) The main soil type found at the project site is Fill Land/Dredged Material. This denotes that the majority ol'the soil on lie property has been reclaimed from the nearby inlet over many years. Generally the soil composition oI'dredged materials From beach front properties has a high percentage sand of', with a much more moderate percentage of'clay, and organic matter. This composition makes tie soil very permeable,which will reduce the aniount of stormwater which will flow into the recapture systems. When dredging soil is used as till behind bulkieads such as on this property, the soil is dried before being put in place, allowing the organic material in the soil to dry and dramatically lialt the decomposition in all but the top soil layer. Fill I;.uld ��� 1)rccl;;cc1 :�9.Ucrial Because dredged material and fill land is not made up of a single soil type,but is in fact a composite of many different kinds of soil types mixed with sand and organic material, it is difficult to classify its soil characteristics beyond its propensity for being well drained. In tens of erosion, the property is well bulklieaded which will reduce much of lfie potential soil runofl'into the bay. Furtliennore the property is to be well vegetated which will reduce possible wind driven erosion. Section 5. Construction Please VI: ❖ Install drainage structures Construction Phase VII: ❖ Alter all construction, re-vegetate all disturbed arca Construction Phase VIII: ❖ Remove silt fence as required Section 6: Implementation of Minimum Erosion and Sedimentation Control Practices 6.1 Schedule of initial placement or implementation of erosion and sediment control practices I ipon the issuance of a Building Permit, the owner will install the hay bales and siltation fencing as per the SWPPP Plan. Prior to the start of construction on the new dwelling, the site will be re-graded, and a topsoil stockpile will be created surrounded by siltation fencing. The contractor will then commence his construction of the proposed dwelling and its appurtenances, such as the deck and swimming pool. Aller the residence is built, the driveway and drainage structures will be completed. All excess concrete and other construction materials will be removed from the site and suitably disposed of. 6.2 Minimum time frames for continuance of erosion and sediment control practice The erosion and sedimentation control practices prescribed herein are to continue until all disturbed areas are stabilized. Stabilization is achieved upon the establislnnent of full vegetated germination in the construction area. Disturbed areas arc anticipated to be fully stabilized by the fall of 2013. In the event that disturbed areas are not fully stabilized, the erosion control BMPs sliall remain in place until the following spring. Section 7: Erosion and Sedimentation Plan The Site Erosion/ Sedimentation and Storm Water Control Plan prepared by Joseph Fischetti, P.E. August 16", 2012 and attached hereto at Appendix B. This SWPPP envisions the implementation of these temporary sediment control measures consistent with the standards contained in the §236 of the "Town code. In essence, disturbance over the land is minimized and any sediment laden stonnwater would be controlled by strategic placement of hay bales and silt fences. Beachwood Road would be similarly protected during construction. After completion of construction the full stabilization of disturbed lands will be achieved through plantings. The permanent solution is a structural upgrade for the site and a benefit to the town. Section 10: Pollution Prevention Measures 10.1 Litter Control and Control of Construction Debris All litter and waste materials will be collected and disposed into a dumpstcr. Only trash and construction debris will be disposed of into the dumpstcr. The dumpstcr will remain covered to prevent wind born dispersal of deposited materials. Once filled to capacity, the dumpster will be removed and replaced by a private carter. Materials such as wood pallets and cardboard will be collected and recycled. 10.2 Control of Construction Chemicals Waste materials including petroleum products, paints, solvents, and used oil filters will be stored in structurally sound and clearly marked containers. The containers will be kept separate from the litter and construction debris and disposed of in accordance with applicable regulations,which pertain to hazardous materials.
