SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 24, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 27, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. It was further stated that the structure is located within the VE zone and the SLOSH mapped category 2 zone and is recommended to be located outside of these zones. On July 23, 2013 the LWRP Coordinator issued a memorandum to the ZBA's pointing out that the applicant's revised survey dated July 12, 2013 by Nathan Taft Corwin shows the restored top of the bluff in a different area from the location approved by the Trustees,which was to be the same location as that which existed prior to severe damage caused by Tropical Storm Sandy. Subsequently, the applicant proceeded to reestablish the top of the bluff per Trustees approval, proposed an amended plan to locate the proposed gazebo landward of the VE Zone, and submitted a plan to re-vegetate the bluff slope to achieve bluff stability. As a result, the Board of Appeals now finds the application to be CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject parcel is located in the R-40 zone district and is improved with a two story frame home and accessory framed garage. Prior to storm damage and removal, a framed gazebo also existed on the subject property at approximately 11 feet from the bulkhead. The property has 100.00 feet of frontage on Peconic Bay Boulevard, 356.34 feet along the eastern property line, 96.93 feet on Great Peconic Bay and 354.14 feet on the western property line as shown on the survey dated December 3, 2012 prepared by Nathan = Taft Corwin,LS. v Page 2 of 3—August 22,2013 ZBA#6663—Abbott SCTM#1000-126-5-1 BASIS OF APPLICATION: Request for variance Article XXI 1 Code Section 280-116(B)based on an application for a building permit and the Building Inspector's April 24, 2013 Notice of Disapproval concerning a permit for construction of a 10 ft. X15 ft. covered deck/gazebo at, at 1. Less than the code required bulkhead setback of 75 feet. RELIEF REQUESTED: The applicant requests a variance to construct an accessory 10ft. X 15 ft. (150 sq. ft.) covered deck/gazebo, to replace a storm damaged 154 sq. ft. gazebo at approximately 11 feet from the bulkhead where the code requires a minimum bulkhead setback of 75 feet. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on July 12, 2013 submitted a plan clarifying the setback to the bulkhead and locating the VE flood zone line at approximately 11 feet from the bulkhead. However, although this plan relocated the proposed gazebo landward of the VE Flood Zone, it was proposed to be only 6 inches farther landward than originally applied for and therefore it did not bring the plan into more conformity with the code relative to bulkhead setback. At the August 8, 2013 public hearing the applicant submitted another revised site plan by DKR Shores Inc. showing the gazebo at 16 feet from the bulkhead, landward of the VE Zone, also noting a re-vegetation plan for the reconstructed slope of the bluff. ADDITIONAL INFORMATION: The applicant submitted information on other accessory structures in the neighborhood that were/are located within 75 feet of a bulkhead. However, a majority of these structures did/do not legally exist, since they lack a CO or Pre-CO. In contrast, the applicant's original accessory gazebo did have a CO issued by the Town's Building Department in 1987. This original gazebo suffered significant damage from Super Storm Sandy and was subsequently removed by the applicant for the safety of the public that has beach access through a R.O.W. on the west side of his property. However, the Board notes that once a non-conforming structure or building is removed,be it through human hand or an act of nature, it has no legal right to be replaced in a non-conforming location. Between the first and second public hearings on this application, the applicant restored the slope/top of the bluff that was destroyed by severe storm damage pursuant to the Board of Trustees approved plans. After this bluff restoration was accomplished, the Members of the Board of Appeals conducted another site inspection to review the applicant's proposed location for a new gazebo at 16 feet from the bulkhead. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on July 11,2013 and August 8, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance, as applied for will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Due to the proposed location in the velocity hazard zone, at approximately 11 feet from the bulkhead, the accessory structure has the potential to suffer high, repeatable rate of loss and pose hazards to life and property during storm surge events. While the applicant's amended site plan notes a revised location for a 10' x 15' foot framed gazebo/covered deck landward of the VE Zone at 16 feet from the bulkhead, this proposed location is partially on the slope of a newly restored bluff that suffered severe storm damage which caused slope instability. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The distance between the re-built bulkhead and the existing dwelling is close to the code required minimum setback of 75 feet. Therefore any structure proposed to be located seaward of the dwelling would require a variance. However, the Board finds that the applicant failed to make a compelling argument as to why he could not move the proposed accessory structure further landward of the bulkhead and top of the restored bluff to make it more conforming to the code without undue hardship. r Page 3 of 3—August 22,2013 ZBA#6663—Abbott SCTM#1000-126-5-1 3. Town Law 4267-b(3)(b)(3). The variance requested herein, as amended for a 16 foot bulkhead setback is mathematically substantial, representing 79% relief from the code. However, by moving the proposed structure to the location described in the alternative relief granted herein, the potential for loss of the structure and bluff instability will be reduced. 4. Town Law 4267-b(3)(b)(4) Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The LWRP recommendations cited above outline adverse environmental factors which the Board finds will be mitigated by the re-establishment of the top of the bluff, the re-vegetation of the slope, and the removal of any proposed structures from the VE Zone and slope of the bluff, as described in the alternative relief granted herein. Also,the applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The loss of the original gazebo was the result of a severe weather event in October 2012 called Tropical Storm Sandy. 6. Town Law 4267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new accessory gazebo while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Dantes, and duly carried,to DENY, as applied for, and GRANT ALTERNATIVE RELIEF,as follows: the accessory 10 ft.X 15ft covered deck/gazebo shall be located no less than 20 feet from the bulkhead and landward of the top of the bluff,subject to the following conditions; CONDITIONS: 1. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final survey and building plan, conforming to the alternative relief granted herein.
