County of Suffolk and State of New York, more bounded ani descrihnd as follows- BEGINNING at a stake set on the northerly line of Main Road at the southwesterly corner of lands now or formerly of Curt W. Meyhoefer and Hope E. Capossela: RUNNING THENCE along said northerly line of Main Road South 42 degrees 00 minutes West 182.80 feet to a concrete monument and land now or formerly of Lillian A. Gozelski; THENCE along said land North 40 degrees 17 minutes West 253.80 feet to a concrete monument and land now or formerly of George Berkowski; THENCE along land now or formerly of George Berkowski North 49 degrees 54 minutes East 188.80 feet to an old post; THENCE still along land now or fomerly of George Berkowski and later along land now for formerly of Curt W. Meyhoefer:: and Hope E. Capossela South 37 degrees 54 minutes East 181.24 feet to a certain fence post; THENCE still along said land South 40 degrees 09 minutes East 47.57 feet to the point or place of BEGINNING. IT BEING the intention of the parties that the mortgage to the parties of the second part from the parties of the first part dated the 24th day of May, 1988, and recorded in the Office of the Clerk of the County of Suffolk on the 9th day of June, 1988, in Liber 14143 of Mortgages, page 487, shall not merge into the fee interest conveyed hereby, but that such mortgage shall remain as a good and valid mortgage, separate and apart from any other interest olf the parties of the second part in the fee. THIS DEED is an absolute conveyance of title, in effect asw 11 as form, and is not intended as a mortgage, trust conveyance or security of any Lind. The consideration therefore is the full release of the parties of the first part from all debts, bonds, notes,,obligations, costs and charges heretofore subsisting on account and by the terms of the aforementioned mortgage. TOGETHER with all right, tide and interest, if any, of the party of the first part of, in and to any streets and roads abutting dte above-described premises to the center lines thereof; TOGETHER with the appur- tenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such con- sideration as a trust fund to be applied first for the purpose of payingthe cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word"party"shall be construed as if it read "parties" whenever the sense of this indenture so requires.
