NYSERDA is providing a grant opportunity for a workplace initiative for the purchase, software and
installation of a Level 2 networked Charge Point charging station by Leviton at an 85%cost reduction.
The Town's share will be offset by a grant from NY Power Authority.
RESOLVED that the Town Board of the Town of Southold hereby amends resolutions No
2014-131 and 2014-361 to also include an Electric Vehicle Charging Station at the Peconic
Community Center in the NYSERDA grant application; and be it further
RESOLVED that the Town Board of the Town of Southold hereby authorizes the Town
Director of Human Services to apply for a grant from NY Power Authority to reimburse the
Town's cost share of the Electric Vehicle Charging Station at Peconic Community Center as part
of the clean energy initiative; and be it further
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Scott A. Russell to execute any and all documents in connection therewith.

Comments regarding resolution 786
COUNCILMAN RULAND: Can I speak to that?
SUPERVISOR RUSSELL: Sure.
COUNCILMAN RULAND: I think it is noteworthy that this will be the third electric vehicle
charging station that we will have in the Town of Southold. The grant provides number one, that
it be available for our own electric vehicles now that we have two fully electric vehicles and also
that it is available to any employee that has an electric car that commutes to work and is able to
charge their car on this charging station for a very nominal fee. I think as we go forward that we
are going to find out that we are going to get to the position where we in fact will be able to, the
software will be in place that will be able to open these stations to the public and they will be
able to come and quick charge their electric vehicles as well for a very nominal fee. I think that
we are moving in the right direction especially with our short distance fleet that travels the
minimal number of miles per day and always returns to the same place.

Provide appropriation for an EYS charging station at Peconic Community Center. Note that a

Mattituck Lions Club to use the following roads for its Annual Halloween Parade in Mattituck,
on Friday, October 31, 2014 beginning at 5:30 PM: beginning at the Firehouse, west on Pike
Street, South on Westphalia Road, east on Old Sound Avenue, north on Love Lane, east on Pike
Street to Mattituck High School, provided they adhere to the Town of Southold Policy for
Special Events on Town Properties and Roads. Support is for this year only, as the Southold
Town Board continues to evaluate the use of town roads. All Town fees for this event, with the

Recycling Equipment Grant Application
Resolution Authorizing the Filing of an Application for a State Assistance Grant for a Municipal
Waste Reduction and/or Recycling Project and Signing of the Master Grant Contract, Under the
Appropriate Laws of New York State.
WHEREAS, the State of New York provides financial aid for municipal waste reduction and
municipal recycling projects; and
WHEREAS, the Town of Southold, hereinafter called the MUNICIPALITY, has examined and
duly considered the applicable laws of the State of New York and the MUNICIPALITY deems it
to be in the public interest and benefit to file an application under these laws; and

WHEREAS, it is necessary that a Master Grant Contract by and between THE PEOPLE OF
THE STATE OF NEW YORK, hereinafter called the STATE, and the MUNICIPALITY be
executed for such STATE Aid;
NOW, THEREFORE, BE IT RESOLVED BY the Town Board of the Town of Southold:
1. That the filing of an application in the form required by the State of New York in
conformity with the applicable laws of the State of New York including all
understanding and assurances contained in said application is hereby authorized.
2. That the Southold Town Supervisor is directed and authorized as the official
representative of the MUNICIPALITY to act in connection with the application and
to provide such additional information as may be required and to sign the resulting
contract if said application is approved by the STATE;
3. That the MUNICIPALITY agrees that it will fund its portion of the cost of said
Municipal Waste Reduction and/or Recycling Project.
4. That this resolution shall take effect immediately.

Close Capital Budget for 4Th St. New Suffolk Armoring
Financial Impact:
Formallyclose capital project for Armoring the road end at 4th Street in New Suffolk. This project will be
completed using 90%FEMA funding.
WHEREAS the Capital Projects Fund includes a $5,000 appropriation for the 4th Street New
Suffolk Armoring project, and
WHEREAS the Town Board has determined that the project should be funded in the General
Fund Whole Town as part of a larger Road End Restoration appropriation, 90% of which is
funded by a grant from the Federal Emergency Management Agency, and so the 4th Street New
Suffolk Armoring project appropriation is no longer needed in the Capital Fund, now therefore

RESOLVED that the Town Board of the Town of Southold hereby closes the 4th Street New
Suffolk Armoring Capital Project in the Capital Fund and directs the Town Comptroller to
transfer$5,000 back to General Fund from the Cal2ital Fund effective immediately.

Southold hereby sets Tuesday, October 21, 2014, at 7:32 p.m., Southold Town Hall, 53095 Main
Road, Southold,New York as the time and place for a public hearing for the purpose of adding a
parcel owned by Richard Sinatra and Camille Sinatra to the Town's Community Preservation
Fund Eligible Parcel List and for the purpose of accepting a land donation of fee title to said
parcel for open space and passive recreational purposes. Said parcel is identified as SCTM
#1000-22.-3-5.1. The address is No # Kayleigh's Court, East Marion,New York, located at the
end of Kayleigh's Court starting with a dirt access which is a part of the subject property in East
Marion. The property is located in the R-80 zoning district and is±10 acres.
The property includes existing Subdivision Open Space and a two (2) acre development area.
The Town's database incorrectly coded this property as entirely Subdivision Open Space when
in fact it includes a two (2) acre development area. The database error resulted in the property
being included on the list of Preserved Lands instead of included on the list of Eligible Parcels.
The Town is adding the property to the list of Eligible Parcels for purposes of open space
preservation, similar to the criteria listed for the properties in the vicinity of the subject property
which are on the current Eligible Parcel List.
The purchase price of this open space donation will be acquisition costs associated with the
transfer of fee title using Community Preservation Funds. The purpose of the acquisition is for

the preservation of open space and passive recreation.
As per Chapter 117 (Transfer of Development Rights) of the Code of the Town of Southold,
Section 117-5, one (1) Sanitary Flow Credit is available upon the Town's acquisition of the
property. The transfer of the Sanitary Flow Credit into the Town TDR Bank will not be finalized,
and shall not occur, until the Town closes on the property, and the Town Board passes a
resolution allowing the transfer into the Town TDR Bank.
FURTHER NOTICE is hereby given that a more detailed description of the above mentioned
parcel of land is on file in Land Preservation Department, Southold Town Hall Annex, 54375
Route 25, Southold,New York, and may be examined by any interested person during business
hours.

A Local Law entitled, "A Local Law in relation to Amendments to Chapter 17, Community
Preservation Fund, in connection with First Time Homebuyer Exemption".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The Town Board has determined that in order to promote the affordability of home ownership
within the Town for first-time homebuyers, certain first-time homebuyers may be exempt from
the Peconic Bay Region Community Preservation Fund transfer tax in accordance with the recent
amendment to New York State §1449-ee(4).
II. Chapter 17 of the Code of the Town of Southold is hereby amended as follows:
§17-4. Definitions.
As used in this ai4iele, the following words and tefms shall have the meanings indieated!Unless otherwise expressly stated the following terms shall for the purpose of this Chapter,
have the meanings as herein defined. Any word or term not noted below shall be used with a
meaning as defined in Webster's Third New International Dictionary of the English Language
unabridged(or latest edition).
FIRST TIME HOMEBUYER - A person who has not owned a primary residential property
is not married to a person who has owned a residential property during the three-year period
prior to his or her purchase of the primary residential property, and who does not own a vacation
or investment home.
PRIMARY RESIDENTIAL PROPERTY—Any one or two family house townhouse or
condominium located in the Town of Southold which is to be owner occupied by such
homebuyer.
§17-25. Additional exemptions.
A. There shall be allowed an exemption of$150,000 on the consideration of the conveyance
of improved real property or an interest therein.
B. There shall be an exemption of$75,000 on the consideration of the conveyance of
unimproved real property or an interest therein.
C. There shall be allowed an exemption for a first time homebuyer where the purchase price
of the primary residential property is within sixty percent of the purchase price limits
defined by the State of New York Mortgage Agency Low Interest Rate Mortgage

Program (SONYMA) in the non-target one-family categories for Suffolk County in effect
on the contract date for the sale of such property and the homebuyer's household income
does not exceed the income limits defined by SONYMA's Low Interest Rate Mortgage

effect on the contract date for the sale of such property.
III. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

SUPERVISOR RUSSELL: Would anybody like to address the Town Board on any subject?
Leroy Heyliger
LEROY HEYLIGER: Good afternoon, I am Leroy Heyliger. I live in Mattituck. The Mattituck
carter study back in July of 2011 and in that study on Factory Avenue it was resolved then that
work had to be done to make a safe pathway on Factory Avenue from the Mattituck Cottages
down to the shopping area Waldbaums, Wal-Mart and the movie theater and since then I have
been before the board several times about this project and it seems like it has been stalled and the
last time that I was here I was told that you would look into it and someone would come out and
survey the area and see what has to be done and how much it would cost. And so far I haven't
heard or seen from anyone and now I see on page 10 category 793 today on page 10, budget
modification create a budget for road end restorations, create a budget for road end restoration
and supplies, materials, equipment, rentals etc. Then it says FEMA. New York State has a, as I
said before when I addressed this Board, New York State has a law for safe streets law that was
enacted several years ago and I believe that Factory Avenue, this project on Factory Avenue
would fall under that category of safe streets. The people from the Cottages going down the
street on the east side, the west side, have to navigate through a very difficult area. They have to
cross the railroad tracks, avoid a sand trap which is slowly eroding from the rain and then cross
over to the other side with the carriages and wheelchairs or whatever and I have been observing
this for the last three years. And I don't see anything that has been approved. I mean, the
recommendation back in 2011 outlines it right here what should be done. I am just talking about
a small area. And a cross walk that would make it safe for these individuals to be able to safely
navigate that portion and the sandy portion from the railroad track, I already, when they were
doing the construction there from the, on the railroad crossing, the guy promised me that they
would come and they would fill in that area so it wouldn't wash down the sand and that the
roadway erodes. Every time there is a big downfall the sand just erodes right down and then
between the roadway and the sand, leaves a large gap like that. And someone is going to, a car
could go across and lose control. I hate to see someone get hurt or an accident happen in that
area. I notice here that a lot of these farms, they, we can't put, if we can't afford to put asphalt
in, why can't we put in that poor man's asphalt that they use on the roads, you know, in the roads
to the farms? You know, that broken down asphalt, there's plenty of it. There's a supply. To
keep that sand from eroding down and making it at least you can walk and it won't be a
difficulty for someone to come out there with a baby carriage. That's all I am asking the town is

to look into it and see what can be done and if we can fall under this budget that is outlined in
793.
SUPERVISOR RUSSELL: A couple of points to clarify, first that budget that you are talking
about, that's for the restoration of infrastructure that was destroyed during the storm. It's a
specific replace in kind reimbursement from FEMA. With regard to the other issue, I think you
were on site when we met one day with the MTA representatives, with county representatives
and they assured us that they would take and do something about making that more negotiable.
We agree with you 100 percent but it's MTA property and they need to bring the solution to the
table. We have been trying, very much.
MR. HEYLIGER: What about the town itself? Has anyone come down and....
SUPERVISOR RUSSELL: Yes, we did all that when we met on site. The thing is, we can't
improve property that's owned by the MTA. We can't do that.
MR. HEYLIGER: Well, I am not talking, excuse me, but I am not talking about that piece of
property the MTA, I mean that but we do own the rest of the pathway there. Isn't there
something that can be done, you know, to make something, it can't be filled in with that cheap
asphalt that the farms use? They call it poor man's asphalt, to keep it from washing away?
COUNCILMAN RULAND: Mr. Heyliger, I think it is kind of ironic, I was there yesterday
afternoon and my attention was drawn to something else at that crossing, so I am familiar with
how it looks today. And I think that previously there had been discussions with the highway
superintendent, at this point I can't tell you which one it was, the previous highway
superintendent or the new highway superintendent. But I think we certainly can reach out to him
and working with him, see if we can coax not only the railroad but see what kind of resources we
might have that could alleviate that part of the problem. I know there had been discussions
previously with the town engineer and the town attorney about the west side of Factory, south of
the crossing and we had discussions with the chief of police about a cross walk somewhere in the
vicinity of the church that would transition people from the west side of the road to the east side
of the road where there is an existing sidewalk. I think that it may have gotten lost in the shuffle
and I for one will pursue it with the highway superintendent tomorrow and see if we can't come,
work towards a solution that will alleviate the problem. I happen to agree with you there, right
now there are millings taken off Route 25, that a reasonable amount of it could alleviate the
erosion problem that you are talking about. But I don't see it as a huge project but I think that if
we could all put a little time and talent into it, I think we could create what you are looking for.
MR. HEYLIGER: Thank you. Another thing I would like to ask is, if you would talk with the
police chief, we need more of a presence of the police on that street for the, to control the speed
that goes through there. they come off the Main Road, make that turn onto Factory Avenue and
they gun it and they go up and they go flying over the railroad track and then you have got a
residential area on the other side with children. I mean, they actually fly over and it's supposed
to be a 30 mile an hour speed limit. They don't slow down and it's constant.

COUNCILMAN RULAND: I certainly think that's a very easy conversation to have with the
chief. We will follow up on that.
MR. HEYLIGER: Thank you.
SUPERVISOR RUSSELL: Thank you. Who else would like to address
Nancy Pester
NANCY PESTER: Good afternoon, my name is Nancy Pester. I have a residence on Skunk
Lane in Cutchogue. I am here today simply to inquire about the job that is open in the court
office.
SUPERVISOR RUSSELL: The justice court director? That's civil service position, there is a
list put out by civil service. We would need to hire off that list. I believe, I haven't sat in on the
interviews but I believe members of the board have started already interviewing prospective
candidates. People who have applied for it.
MS. PESTER: I did print a list from the civil service. I believe there were only seven names
that could apply for that. I also remember reading in the newspaper that you preferred to, before
anyone applied, you preferred to give them approximately a $20,000 raise before they even
applied. Stating that no one applied but there were no applications. I stopped several times. I
am interested in the job, I did place an application. I am not sure I agree with giving someone a
raise before they even apply for a job and I see I am not the only one because it was printed in
the newspaper, why would we pay $85,000 stating that no one applied for the job and it's not
because no one wanted to, it wasn't up when I stopped in and dropped off an application down
the hall. I was told, well, we don't even have an application for that job but they took my
application anyway. So that's why I am here.
SUPERVISOR RUSSELL: Okay. First of all, we didn't vote to specifically give someone a
raise. We voted to increase the salary so that we could cast a wider net. We were looking for
people who had the credentials, who have worked in the justice court before. It takes,
unfortunately, it takes some money, a salary, to get people interested in working in Southold
Town particularly if they live up west. We tried to cast as wide a net to get the most qualified
candidate we could find. We are still encumbered by civil service rules, interviewing those on
the list etc. That's what we tried to do. It is certainly not unprecedented, we have done it many
times in Southold before. The Planning director, the engineer. Time and time again we have
been required to raise salaries to qualify the best possible candidates we could, who would still
qualify under civil service rules. Thank you,Nancy.

SUSAN GEITZ: Susan Geitz, 1580 Leeton Drive Southold. I realize that the army corps of
engineer study is not going to include us as we thought it would. I hope that, have you just told
us now that we are on our own as far as that jetty goes? Because it is just getting worse and
worse. Last time that I was here at the town board meeting you had said that we should look into
the county and the town and ourselves putting up the money to have sand brought in to put on
the beach, well, that wouldn't do any good because there is no beach to put sand on or to plant

grass on. The sand that was brought up from the previous dredging of Goldsmiths inlet, that was
put along the dunes there is long gone. That is not the answer. Something else has to be done. I
mean, there are a lot of there who were hoping that you would help us with this situation.
Because we are in danger of losing our homes with every storm that we have. Right now, two
doors down from me, they are putting in what looks like the Bastille, as far as six foot high stone
walls about five or six feet deep. Alright? They are ugly. They are costing one family $40,000,
another family $45,000 and another family $90,000. Most of us who live along there have been
there for a very long time and don't have that kind of money to put into something like that. it is
also ruining the character of the beach. It is ugly and I can't blame these people for doing it
because they have million dollar homes that they are trying to hold onto. And I just wish the
army corps of engineers in previous studies had said that Goldsmith jetty is part or is the
problem. And something should be done about that. I mean, why should we have to suffer for
the people down there? We live there all year, quite a few of us. And if our homes go, the homes
in back are going to go because we are on a dune and they are lower and they are going to lose
their houses too. I wish that the town would do something. I mean, if you would just come and
look at what these things look like that they are putting in, there's, at high tide, there is no beach.
Nobody is going to be able to walk along there. That's, it's not the solution. I wish that you
would see that and do something about that jetty.
SUPERVISOR RUSSELL: We are down there quite often. The problem is, doing something
about the jetty requires a very expensive study. We just don't have the engineering to back up
any action right now. We are talking about a couple of hundred thousand....
MS. GEITZ: What happened to the previous study that the army corps of engineers did that
stated that the problem was the Goldsmiths jetty. Nothing has changed. Except the loss of more
property.
SUPERVISOR RUSSELL: The time has changed and the dynamics of the shoreline changed
quite a bit and if you are going to take action based on the study, that study needs to be as up to
date as you can. And we looked into that and the study that we did as a town was just simply too
old to take action on.
MS. GEITZ: I mean, anybody can stand on that jetty and look on either side. You could put a,
that property down there, I know on our deed it says that we own this much property. It gives
the footage going down to the Sound.
SUPERVISOR RUSSELL: Right.
MS. GEITZ: I am sure down there they have the same thing. So who owns that property now?
After their property, deeded property. You could put a road down in there and open up a town
park, there's that much property down there now. it is ridiculous. In their lifetimes, if you took
that jetty down, they would not lose their homes with the amount of beach down there. and they
don't even, people don't even use the beach. They come over to the inlet to swim and
supposedly that water is polluted. I have no idea. But I really wish that, you know, my daughter
in law has called you several times and left messages for you and you haven't gotten back to her.

SUPERVISOR RUSSELL: Oh, I am sorry. The last time I got a message from her was a couple
of months ago and I called her back right away.
MS. GEITZ: But you never called her back she said.
SUPERVISOR RUSSELL: Yes, I did. Yes, I did.
MS. GEITZ: She told me that you hadn't. I am sorry, you might not have gotten through to her.
SUPERVISOR RUSSELL: I absolutely did and I write down the date and the time.
MS. GEITZ: But something has to be done.
SUPERVISOR RUSSELL: I agree. But I think that you need to understand that being able to
address the jetty is going to require a very expensive study and you don't know what the
conclusions of that study are going to be. Whether the, any change to the jetty at this point is
going to have an impact down there or not. It has to be looked at. It's a very expensive
proposition. We were hoping the army corps would include that in the broad scope that they
originally proposed, they didn't. They decided to hone in on Ashamomaque. But we will work
together with your group, all the other groups to get army corps and get our federal
representatives to secure the funding to do a more thorough coastal study.
MS. GEITZ: Now the girl who lives down there at Arshamomaque spoke to me after the
meeting that I was at and she said she realizes the only reason they are doing that study is
because of the roadway. And she says eventually they will probably confiscate my house
because and say that it's for the public interest that they need to put up a wall or a sea wall or
something there to prevent further damage to the roadway. I mean, if the county comes in and
the army corps of engineers comes in and looks at our properties, is that what's going to happen
to us? That they would confiscate our property for the betterment of whatever?
SUPERVISOR RUSSELL: I don't envision why they would need to confiscate your property.
MS. GEITZ: I can't either but and I don't understand why the county isn't interested in that
property. They put a lot of money, our taxpayer money into buying that Bittner property and the
camp, the camp can't even leave a boat on the beach anymore. We have called the camp several
times to tell them their sailboats are floating away. So I don't understand why nobody cares
about that and isn't doing anything.
SUPERVISOR RUSSELL: Yes, well we certainly have tried to get the county to pay attention
to its assets along that area. The county unfortunately evaluates assets based on low impact uses
and they don't see the uses out here that would....
MS. GEITZ: Why did they bother to buy it?

SUPERVISOR RUSSELL: Well, that's a good question but certainly it's a good thing that they
bought it but the problem is the county doesn't bring as much attention to those low use areas
such as you might find in Southold Town.
MS. GEITZ: So is there anything we can do as a group to get somebody to help us with this?
SUPERVISOR RUSSELL: Well, yeah, I guess we can sit, we can, like I said, I will work with
your group to try and get the army corps involved, try to get our federal legislators to try to
secure the funding. Those are the things that are going to need to take place. It is very difficult
to just say oh, we need to correct this now without knowing exactly how to do that without a
thorough study. You can't just undertake coastal projects and hope for a result. You really need
to know in advance as best you can what the outcome of that would be. It's a...
MS. GEITZ: It just seems like it's no common sense. It just seems that way. If you just went
down there and looked at the thing.
SUPERVISOR RUSSELL: I am down there all the time, I have been down on your beach many
times. I assure you, common sense is one thing but being able to document it through scientific
analysis is something else. If we didn't do that, we would be, it would be, we would be subject
to a substantial litigation and we would get nowhere.
MS. GEITZ: Well, I wish you would come down and see these walls that are going up now.
And see what the trucks come from Connecticut. I mean, these trucks are coming over on the
ferry. It sounds like an earthquake when they dump the stones. I don't object to the noise, these
people are trying to save their houses but the lengths that we have to go to, to do this is really
ridiculous. If more people had to do that, the cost of taking down the jetty would be nothing
compared to having everybody have to put up those stones and they are hideous. But thank you.
COUNCILMAN GHOSIO: I think part of the problem too is what we would consider or what
you or I might consider common sense, there are other people who think that common sense is a
totally different direction. You have been here when you have had neighbors of yours stand at
the podium and give us the opposite....
MS. GEITZ: I don't call him a neighbor.
COUNCILMAN GHOSIO: Whatever but the point is....
MS. GEITZ: You know he's notice he is not here. He got his point across with the army corps
of engineers down at Arshamomaque and he is happy as a little pea in a....
COUNCILMAN GHOSIO: And that is where the problem lies. But from our perspective, we
have to be able to justify decisions that we make because there are differences of opinion of who
thinks what is common sense.

MS. GEITZ: To me, he doesn't even live on the beach so I don't know what his gripe is. He
doesn't even live on the beach and he has got this thing going. I mean, the jetty, when they put
that jetty up, that was the start of the problems of Goldsmiths inlet. When I was a teenager, we
used to go in there in a motor boat and ride up into that inlet because they had two little wooden
jetties on either side that kept that inlet open. No big huge stone things. Two wooden jetties that
kept that inlet open and you could ride right up in there in a boat. There was no issue.
COUNCILMAN GHOSIO: I think that the fact of the matter is, is that no matter what the
solution is, getting to the solution is going to cost an awful lot of money and that is unfortunately
probably the overriding factor to us making the decisions that we make. It's not a little bit of
money, it's a lot of money and I think that that's what Scott was saying about getting the feds
involved is going to be critical as to whether or not anything gets done there. I just think that
that's the way it is....
MS. GEITZ: I will come down with people that are more knowledgeable than I am and see if we
can get something going with this. I mean, a lot of people have said it's like banging our heads
against the wall because it feels so good when we stop.
COUNCILMAN GHOSIO: Well, I think that taking a look at what they did down at
Arshamomaque cove and how they were able to lobby and get some activity done is probably a
good place to start.
MS. GEITZ: Well, of course, Soundview restaurant's there, that's a multi-million dollar
complex, too.
COUNCILMAN GHOSIO: As far as I know, they weren't too much involved in the lobbying
effort.
MS. GEITZ: Okay. Thank you very much for your time.
Jill Franke
JILL FRANKE: Jill Franke, Southold. That woman just brought up about the justice court
director, you had initially said that you had canvassed everybody and nobody wanted the job at
$63,000. You canvassed the landscape and when I did all the surrounding towns were between
$55,000 and $64,000. You just told this woman you don't have money to do anything to help
them save their property.....
SUPERVISOR RUSSELL: That's not true.
MS. FRANKE: You are going to possibly be reducing the taxes at Peconic Landing, you are
acquiring more property so you are taking them off the tax rolls. You are giving yourself raises.
How do you think we are going to continue to live out here and pay and continue to pay all these
people? You also have a promotion coming up for the guy in the computer department. How do
you expect all of us who don't have jobs or who have low paying jobs to stay here and support
all of this stuff?

SUPERVISOR RUSSELL: It's a balancing act. But there are people that....
MS. FRANKE: Well, you are not balancing too well.
SUPERVISOR RUSSELL: We are trying to balance as best we can. People that do an
exceptional job ought to be recognized with a promotion. Further, the justice court director, my
understanding is in the beginning we didn't get much interest, we had to raise the salary and you
know what? We had good interest after that. It essentially worked. We had some very good
candidates to pick from recently.
MS. FRANKE: You have a girl that works in the back 13 years. She would have taken the job
at $63,000 and been happy with it. And she has been doing that job for 4 years and nobody will
promote her.
SUPERVISOR RUSSELL: Well, I am not aware of that being the case. I will defer to the
justices on that.
MS. FRANKE: Well, you ought to look into that. you are the supervisor, you should look into
that.
SUPERVISOR RUSSELL: We never got any applications, so...
MS. FRANKE: Well, she was interested in it. Another question is, I heard you are possibly only
picking up leaves this year, no brush.
SUPERVISOR RUSSELL: We do every fall. Just leaves. And in the spring is the brush.
MS. FRANKE: You are just doing brush in the spring?
SUPERVISOR RUSSELL: That has been going on for several years now.
MS. FRANKE: Okay and Mr. Dinizio, you were looking into, you sent Mr. Orlando an email
about the lines in the road in Orient.
COUNCILMAN DINIZIO: Yes, I spoke to him....
MS. FRANKE: Have you heard anything from him?
COUNCILMAN DINIZIO: I guess they are going to be redoing the Main Road down there....
MS. FRANKE: Yes.
COUNCILMAN DINIZIO: And I think at that point in time they are going to make a
determination how far they state is going to go in to redo that road and then decide what you
want to do, you know, put lines in that road or....

MS. FRANKE: Okay because in 2006 they were supposed to put new sidewalks in there on both
sides I guess, and it was all surveyed and we were told....
COUNCILMAN DINIZIO: I have no....
MS. FRANKE: That within a couple of weeks it would be started. That was in 2006.
COUNCILMAN DINIZIO: I have no idea about that.
MS. FRANKE: Yeah, well, that's what we were told. So, okay. And also, I was wondering
why it was going to take 43 days to get an answer from a FOIL?
SUPERVISOR RUSSELL: I will defer to, who has responded? Betty's office or?
MS. FRANKE: Well, I asked for copies of police report for damage to vehicles. I asked for the
public notice for the job that was just given in the Town Clerk's office. I was told it is going to
take 43 days.
TOWN ATTORNEY FINNEGAN: It was my understanding that you have been provided with
responses to those.
MS. FRANKE: I got a letter right here that tells me that I will have a response around....
TOWN ATTORNEY FINNEGAN: Did you get a response, an email response? You should be
getting it...
MS. FRANKE: Well, I don't get phone calls from you either. I called you in 2010 for two
weeks, every day and in July I called three or four days and I have talked to people in your office
but you never call back.
TOWN ATTORNEY FINNEGAN: Well, I am sorry. But you will get a response to your FOIL.
MS. FRANKE: Okay.
Lynn Summers
LYNN SUMMERS: Lynn Summers, 1290 Oriole Drive. For three years, Theresa McCaskie,
Marie Dominici and I have attended Eastern Helicopter Association and we wanted to share with
you, Theresa had to work tonight. At this morning's work session, there was conversation about
who would liaison from East Hampton, who is at this time ready to liaison with you and that
person's name is Bob Malafonte. He is willing to do anything with you at any time. I will give
you contact information. I cannot state enough that this is the time to do it. I was walking today
door to door, there were five people that would have signed a petition, I am not on the cut of
these people nor is Theresa. But we are still ready to work and walk and get the job done. This
is the time. and it is real and if ever, the people who attended that East Hampton, I feel we can
go someplace. It's there, so run with it and they are ready to help you. Thank you very much.

here for a couple of meetings already and we have been relying on him for a great deal for his
insight. Certainly Theresa has been fighting this fight harder and better than anybody for a long
