SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance. I want to thank
everybody for being here. I also want to thank Fishers Island for always being a wonderful host.
There are some other thank you's I want to be able to read right now. The Fishers Island Ferry

District for providing transportation. Plum Island facility for the use of their dock. Fishers
Island school for being a host of this meeting. Fishers Island residents for always welcoming us.
Fishers Island highway crew, Fishers Island fire department for use of the barbecues, Legislator
Al Krupski for donating the corn. Louisa Evans for helping coordinate. All of the officials that
have made the trip. The department of Public Works and custodial staff. The individuals who
have worked hard to make this day happen are Philip Beltz, John Jerome, Nancy Foote, Carol
Hydell, Regina Blasko and especially to Michelle Tomaszewski and Lauren Standish for
coordinating all this effort and there is quite a bit of work involved in advance of that. I want to
thank each and every one of them. Before we get to the regular business of the meeting we just
want to read off the names of the people who have made the trip today. We have the Southold
Town Board members, of course, myself, Jim Dinizio, Bill Ruland, Bob Ghosio, Jill Doherty and
Louisa. The Town Attorney Lori Hulse is here today, Town Clerk is Betty Neville. From the
Accounting Department, we have John Cushman who is the Town Comptroller. We have Chris
Baiz who serves as chairman for the Agricultural Advisory Committee. From the Anti-Bias
Task Force we have Loretta Hatzel-Geraci, Eleanor Lingo. Architectural Review Committee we
have Steven Geraci and Nicholas Planamento. We are going to take turns here.

SUPERVISOR RUSSELL: Yes, he is asking about the public hearing for the affordable housing
and how you can show your support. What I would strongly recommend is that everything can
come in writing. We had you know, problems. We had to notice the meetings 30 days prior but
I would strongly recommend any words of support or opposition should be brought to Betty
Neville's office and distributed to the Town Board. What we will do is at the end of the agenda,
if you want to speak to that issue we will make sure that's part of the minutes today.

WHEREAS,there has been resented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 6' day of August, 2014, a Local Law entitled "A Local Law in
relation to Amendments to Chapter 280, Zoning, in connection with the Affordable
Housing District" now, therefore, be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold,New York, on the
26th day of August, 2014 at 7:32 p.m. at which time all interested persons will be given an
opportunity to be heard.

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of these Amendments is to allow more flexibility in the design of Affordable
Housing Districts in order to expand the opportunities for the creation of moderate income
housing within the Town.
II. Chapter 280 of the Code of the Town of Southold is hereby amended as follows:
&280-25 Definitions.
For-the puTese of thi S affiele, the following tefms, phfases and words shall have the following
Unless otherwise expressly stated, the following terms shall, for the purpose of this Chapter,
have the meanings as herein defined. Any word or term not noted below shall be used with a
meaning as defined in Webster's Third New International Dictionary of the English Language,
unabridged (or latest edition).
ASSET - Includes real property holdings and equity, personal property (car, boat, etc.)valued in
excess of$10,000, savings, cash, IRAs, 401k, and any federally recognized tax-deferred
vehicles.
CONSUMER PRICE INDEX- The consumer price index as published by the United States
Department of Labor, Bureau of Labor Statistics, for the New York Metropolitan area.
CONVEYANCE -The transfer or transfers of any interest in real property by any method,
including but not limited to, sale, exchange, assignment, surrender, mortgage foreclosure,
transfer in lieu of foreclosure, option, trust indenture, taking by eminent domain, conveyance
upon liquidation or by a receiver, or transfer or acquisition of a controlling interest in any entity
with an interest in real property. Notwithstanding the foregoing, conveyance of real property
shall not include a conveyance made pursuant to devise, bequest or inheritance; the creation,
modification, extension, spreading, severance, consolidation, assignment, transfer, release or
satisfaction of a mortgage; a mortgage subordination agreement, a mortgage severance
agreement or an instrument given to perfect or correct a recorded mortgage; or a release of lien
of tax pursuant to this article or the Internal Revenue Code.
HEAD OF HOUSEHOLD - The adult member of the family who is the head of the household
for purposes of determining income eligibility and rent..
HOUSEHOLD - The family and live-in aide, if applicable.
MODERATE-INCOME FAMILY - A family registered with the Town of Southold Housing
Registry whose aggregate annual income, including the total of all current annual income of all
family members (excluding the earnings of working family members under age 18) from any

source whatsoever at the time of application for the purchase or lease of an affordable housing
unit or the purchase of an unimproved affordable lot, does not exceed 120% of the HUD median
income for the County of Suffolk.
MODERATE-INCOME FAMILY DWELLING UNIT - A dwelling unit reserved for rent or
sale to a moderate-income family and for which the maximum monthly rent (excluding utilities)
or the maximum initial sales price does not exceed the maximum rent or maximum sales price
set forth in § 280-30D hereof.
MODERATE-INCOME FAMILY UNIMPROVED LOT -An unimproved lot reserved for
sale to a moderate-income family and for which the maximum initial sales price does not exceed
the maximum sales price set forth in § 280-30D hereof. Said "unimproved lot" shall mean a
vacant parcel of real property designated as a lot on a filed map, inclusive of all utilities brought
to the property line.
NET WORTH-The net worth of an applicant shall include all liquid assets less debt. Liquid
assets shall not include sheltered assets, trusts, Individual Retirement Accounts (IRAs), 40lKs
and all other federally recognized tax-deferred vehicles.
PERMANENT FIXED IMPROVEMENT - An improvement to a lot or a moderate-income
family dwelling unit which cannot be removed and which provides value to the property above
and beyond repairs done to maintain the property in good condition. A permanent fixed
improvement must be approved in advance of construction or installation in writing by the
Special Projects Coordinator.
PRIMARY RESIDENCE - The address listed on a person's federal income tax return.
SPECIAL PROJECTS COORDINATOR- The employee of the Town who is responsible for
the development, implementation and coordination of the Housing Registry and affordable
housing initiatives for the Town of Southold.
§280-27. Use regulations.
In the AHD District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any use except the following:
A. Permitted uses.
(1) Owner-occupied Moderate-Income Family Dwelling Unit ("MIFDU"), in
accordance with the following requirements:
(a) An owner-occupied MIFDU shall not be leased, except one time for up to a
two-year term, subject to the written approval of the Special Projects
Coordinator.
(b) Owner-occupied MIFDUs may either be attached or detached, or any
combination thereof.
(2) Tenant-occupied MIFDU, in accordance with the following requirements:

(a) A tenant-occupied MIFDU must be leased for a term of not less than one-year.
(b) Tenant-occupied MIFDUs may either be attached or detached, or any
combination thereof.

B. Accessory uses.
(1) Accessory uses as set forth in and regulated by §280-13C(1), (2), (3), (4), (6) and
(7) of this chapter.
(2) Accessory apartments are permitted only within owner-occupied MIFDUs,
subject to the written approval of the Special Projects Coordinator, the issuance of
a rental permit in accordance with X280-13(1)) and the following conditions:
a) The accessory partment shall be located within the MIFDU.
b) Only one accessory apartment shall be permitted in a MIFDU.
C) The owner shall occupy either the principal dwellingor r the
accessory apartment as the owner's primary residence.
d) The accessory apartment shall only be occupied by an eligible
family or individual as defined by §280-30 (C).
e) The term of the lease for an accessory apartment shall be at least
one year.
f) The accessory partment shall be at least 350 square feet and shall
not exceed a square footage equal to one half of the total square
footage of the MIFDU.
g) The accessory apartment shall have only one bathroom.

h) A minimum of one off-street parking space shall be provided.
i) Not more than 50% of the dwelling units in an approved
Affordable Housing District shall have accessory apartments.
§280-28. Bulk, area and parking regulations.
No building or premises shall be used and no building or part thereof shall be erected or altered

B. The Planning Board shall have the authority to reduce or amend yard setback
requirements, lot dimension requirements, parking requirements, and highway
specifications. In making this decision, the Planning Board shall take into consideration
the benefit to the applicant, as weighed against the detriment to the health, safety and
welfare of the neighborhood or community. In making such determination, the Planning
Board shall also consider: (1) whether an undesirable change will be produced in the
character of the neighborhood or a detriment to nearby properties will be created by the
granting of the amendments; (2) whether the benefit sought by the applicant can be
achieved by some method, feasible for the applicant to pursue, other than the sought
variance; (3) whether the variance is substantial; (4) whether the proposed variance will
have an adverse effect or impact on the physical or environmental conditions in the
neighborhood or district; and (5) whether the alleged difficulty was self-created, which
shall be relevant to the decision but shall not necessarily preclude the proposed
amendment or variance. This provision supersedes and amends New York State Town
Law §§267, 267-a, 267-b and 267-c insofar as these sections give such authority to the
Zoning Board of Appeals. Any amendment to highway specifications shall meet with the
approval of the Highway Superintendent.
§280-29. Application procedure.
A. Application and fees. The application for rezoning shall be filed with the Town Clerk, in
a form approved by the Town Board and available in the office of the Town Clerk. Fees
applicable to the AHD zoning application shall be set by resolution of the Town Board.
B. Application procedure. The procedure for approval of any future development in a
proposed AHD District shall involve a three-stage review process as follows:
(1) Approval by the Town Board of a preliminary development concept plan.
(2) Approval of the final, detailed subdivision plat or site plan by the Planning Board.
In an AHD zone, &280-137(A)(5) is inapplicable and the allowable density of
MIFDUs shall be determined by the following_yield calculation:
(a) Buildable land (square feet) divided by the minimum land area per dwelling
unit = number of MIFDUs.

(3) The zoning classification by the Town Board of a specific parcel or parcels of
land for development in accordance with that plan.*
§280-30. General regulations and requirements.
H. If more than one MIFDU exists on a single lot, the dwelling units must either all be
owner occupied or tenant occupied units.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law

Ken Edwards
KEN EDWARDS: Good afternoon, I thank the Board for coming to Fishers Island again. My
name is Ken Edwards, lifelong resident of Fishers Island and I would like to support this project,
the affordable housing project that's on the agenda today and ask the Town Board to support it
also.
SUPERVISOR RUSSELL: Thank you. Who else would like to address the Town Board?

Peter Brinckerhoff,Fishers Island
PETER BRINCKERHOFF: Good afternoon, I am Peter Brinckerhoff. I was under the
impression that the right of way along the Navy fence was going to be on the agenda today. Can
you comment?
SUPERVISOR RUSSELL: Yes, we actually have, in January we voted to engage the services,
we got the survey I believe the beginning of June. We have already started discussions on at
least two occasions with a Navy representative to discuss possibly relocating the fence and trying
to gain easement language so that we could use that property.
MR. BRINCKERHOFF: Thank you very much.
SUPERVISOR RUSSELL: Sure. Who else would like to address the Town Board? Please.
Karen Goodwin, Principal F.I. School District
KAREN GOODWIN: Hi, I am Karen Goodwin, I am the principal of the school here,
superintendent as well and a resident and I would also like to echo the sentiments expressed for
the affordable housing modifications. It is a critical need here on Fishers Island.
Harry S. Parker, III
HARRY PARKER: Good afternoon, my name is Harry Parker. I am a resident of the Island,
registered voter and a supporter of the town. I wanted to ask a general question which relates to
the bonding capacity of Southold. To what extent are we, do we have remaining capacity in the
town's bonding level? If we do have, what are the procedures that would lead to having capital
projects considered for the next time bonds are going to be issued. How does that work?
SUPERVISOR RUSSELL: We actually establish the capital project first and then we go to bond
markets. There is always potential to borrow more money from the bond markets. As you
borrow more money, the rating agencies get a little nervous, if you are taking too much debt

service on and it might affect future bond ratings. For the time being, I think our debt is well
managed. If there are capital projects specific, then what we need to do is we need to look at the
capital project, we need to cost estimate it and then we go to the bond markets after we establish
how much we need to bond.
MR. PARKER: Is the process is one year,two year, three years?
SUPERVISOR RUSSELL: It depends on the project but we should be completed well within
one year.
MR. PARKER: And you initiate it through the departments?
SUPERVISOR RUSSELL: Yes. It comes through the departments, usually presented to the
Town Board,the Town Board then decides if we want to move forward with the capital project.
MR. PARKER: Do you attempt to allocate it according to the property, taxpayers contribution
to the ....
SUPERVISOR RUSSELL: You mean apportion out debt service hamlet by hamlet? No.
MR. PARKER: So it is going on a merit judgment?
SUPERVISOR RUSSELL: Exactly.
MR. PARKER: Because it seems to me Fishers Island has had relatively little participation in
this kind of capital funding in the past and yet we are identifying needs now that would require
significant amounts, ferries that need replacement and schools, well school I guess is a separate
issue, road discussions and so on that would require perhaps millions to be spent and we are so
far out of the zone that it would be hard for us to get....
SUPERVISOR RUSSELL: Some of those projects wouldn't be town projects. With respect to
the ferry district, all ferry district bonding and borrowing is done on the full faith and credit of
the Southold Town Board, Southold Town government. Any interest rates, any bonding rates
that come in lower is because they are backed by the town government. With respect to
investments in the school, they are a taxing entity and would need to undertake their own bond.
With regard to infrastructure investments such as the utilities, again, that would need to be an
entity that would undertake the bonding. A few years ago, I know we did go out to bond for road
improvements, curbing, sidewalks and drainage improvements. T hat was estimated to be about
$1.4 million, I believe the number came in about $1.1 million. We are discussing now some
capital projects that may or may not need bonding, in particular we looked at the theatre this
morning which is in desperate need of repair, how much and what the cost of that repair is, we
still need to evaluate. We are also looking at expanding the exercise or bike trail, that might
require bonding. It would be my hope that we could allocate those resources in house depending
on the cost. If it does need bonding, we could do that rather quickly.

CHRIS FINAN: Hi, Chris Finan, president of the Fishers Island Utility Company. I would also
like to support the affordable housing initiative.
SUPERVISOR RUSSELL: Thank you very much. Who else would like to address the Town
Board on any issue?
Ken Edwards, Fishers Island
KEN EDWARDS: Ken Edwards again. I would like to address this question to the
Superintendent of Highways, Vinnie Orlando. I am just concerned, is Fishers Island in the
budget to have some road repair? We seem to be getting left out. The street right in front of my
house was half done about 8 years ago and was told it was going to be completed the next time
you came. Well, the time came and it wasn't done. I talked to Peter Harris last year about some
very diseased street trees which I believe are in the right of way of the town road that needed to
come down. He discussed it with the two employees on Fishers Island, the trees are still there. I
direct that question to our Superintendent of Highways.

VINCENT ORLANDO: I have been on some tours of the island. I will be glad to meet with you
later you can show me some of the spots you are talking about right now though, my resurfacing
budget is full but I am hoping for next year there might be more money to try to do some of these
things (inaudible).
MR. EDWARDS: In answer to my question, there is no more money in the budget next year for
Fishers Island for highway resurfacing or repair?
MR. ORLANDO: Well, it is not specifically for Fishers Island, it is just the resurfacing in
general budget number there, where it is appropriated (inaudible) right now, I have $150,000. A
lot of it was used for other projects, for the bridge temporarily but I should be receiving it back
hopefully once it is bonded, to use for resurfacing. So next year in my preliminary budget I put
some more money in, hopefully it will be approved and we can do some resurfacing over here as
well.

PETER BURR: I will ask one quick question. My name is Peter Burr. I am just curious if the
Board has had the opportunity to read our Yale study that has been circulated around for the last
year or two and if you have an particular comment you would like to make on that in terms of
what it says. Thank you.

SUPERVISOR RUSSELL: I will tell you, I actually read the Yale study and I read it a few
times. The study is very comprehensive, I think it does a very good job of outlining the
challenges that Fishers Island faces. Affordable housing, infrastructure investment, meaningful
employment, I recognize all those issues. And it provides a good historical context of those
challenges. And I said in this room before that those challenges are not unique to Fishers Island.
They are a challenge everywhere. We have a difficult time trying to create meaningful
employment in Southold Town. Southold's biggest export is young people and it is becoming a
real crisis. The schools populations are shrinking, the mainland has difficulty. We have tried to
create meaningful employment. We have an Economic Advisory Council, we have difficulty
and we are only 20 minutes from a major thoroughfare, the Long Island Expressway. Fishers
Island is even more isolated, you are not 20 minutes, you are 20 knots away. It becomes very
difficult. But we would certainly work with this Island on how to create vibrancy here. To try to
solve those affordable housing issues. I do know it covers in great detail, the second part of the
study, the issue of incorporation as a village, that whole section starts with a statement that says
for Fishers Island to control its future, it needs to establish its own governance. Then it goes into
a great deal of detail on how you create a village and it provides a lot of mathematical
calculations on what the costs of that village would be. But you know, I have read it many times,
it never really answered the question to that first whole statement which is that you need to
create a village, it never really answered why. I don't want to see bias because I have to be
candid, as a Supervisor, can I be more attentive to the needs of Fishers Island? Yeah, you bet I
can. I can say that any hamlet I sit in, whether it is Orient, whether it is Mattituck, whether it is
Southold and when you run for office you actually try to develop a long range vision of where
you want to see the town to go but it becomes difficult and I get sidelined by the hundreds of
little things you have to do on a regular basis. But ultimately, you have to decide as a
community, I am not a resident, I am certainly not invested personally in the island and it is not
for me to say whether you should create a village or not, that's a decision you need to make. You
need to evaluate this Board, the people that are sitting here and decide whether you can better
represent the interests of Fishers Island whether you can do it more efficiently, more
economically(tape ends here)
