party of the first part, and
DAVID HARTER, residing at 101 Choate Lane, Pleasantville,New York 10570,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Cutchogue, in the Town of Southold, County of Suffolk and
State of New York, known and designated on a certain map entitled "Subdivision Map of Ismar
Acres," and filed in the Office of the Clerk of the County of Suffolk on 3/13/73 as Map No.
5872, being shown on aid Map as Lot No. 10, said Lot being more particularly bounded and
described as follows:
BEGINNING at a point on the northeasterly side of Bridge Lane, distant 540.69 feet
southeasterly from the comer formed by the intersection of the northeasterly side of Bridge Lane
with the southeasterly side of the Long Island Railroad MTA, said point of beginning being
where the division line between Lot 10 and Lot 11 intersections the northeasterly side of Bridge
Lane;
THENCE from said point of beginning, along said division line, North 37 degrees 19 minutes 00
seconds East, 327.60 feet to lands now or formerly of Foster;
THENCE along said lands now or formerly of Foster, South 54 degrees 14 minutes 00 seconds
East, 120.00 feet to other lands now or formerly of Foster;
THENCE along said lands, South 34 degrees 41 minutes 20 seconds West, 325.00 feet to the
northerly side of Bridge Lane;
THENCE along said northerly side of Bridge Lane, North 55 degrees 18 minutes 40 seconds
West, 135.00 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated January 6, 2005, and recorded January 27, 2005, in the Office of the Suffolk County
Clerk in Liber 12368, Page 416.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
