As an addendum to the attached SPUD, the Planning Department has conducted a review of the proposed LTE modifications pursuant to §280-74 B.(2), and has received a report from our Wireless Technical Consultant, Cityscape, Inc. (see attached repo�t). Although, as our consultant points out, this proposed generator does not technically meet our noise requirement in §280-70 J.(5), the intent of that noise requirement was to have it be easily met by virtue of the large distances required to the property lines in�this zoning district for new wireless facilities. Due to this wireless antenna support structure being a pre-existing non-conforming facility that the Planning Board recently agreed to allow to expand, and given that the projected noise levels are very close to meeting the limits in the code despite the cell tower being located in what is now a non-conforming location, the noise limit in §280-70 � J. (5), should not be strictly applied in this case, and that the certificate of occupancy and/or permit not be held up on the noise issue. AT&T Mobility requested and was approved to make modifications and upgrades to the subject wireless communications facility. In Section 280-70J(5): Wireless Communications Facilities: `Noise from base equipment' and further Section 180-6: `Prevention of Noise;' the Town has a specific requirement regarding the noise emitted from the subject facility. The specific language states "Noise from base station equipment, including any backup generator, measures less than 45 dB at all adjacent property lines. " In Section 180-6: Prevention of Noise: "No person shall create or cause to be emitted any noise pollution which when measured on a sound-level meter from the property line of a complaining property owner exceeds the following standards: A. Sunday through Thursday: (1) From 7:00 a.m. to 7:00 p.m., airborne or amplified sound in excess of 65 dBA; (2) From 7:00 p.m. to 7:00 a.m., airborne or amplified sound in excess of 50 dBA. B. Friday and Saturday: (1) From 7:00 a.m. to 11:00 p.m., airborne or amplified sound in excess of 65 dBA; (2) From 11:00 p.m. to 7:00 a.m., airborne or amplified sound in excess of 50 dBA. / � � • Town of Southold July 9,2014 Page 2 Conclusion: The submitted noise report measurements were all conducted in dBA which is applicable in the Town Codes for Section 180-6, but not Section 280-70J(5) which are measured in dB. Being that dB is normally a showing of peak levels and dBA is normally an average and not peak levels the difference in level rating scales is not reasonably applicable and dBA and dB should be considered as comparable. The sound levels were measured in three (3) locations along the fence. The generator noise level at location # 1 (closest) was 54.4dB; location # 2 (middle) 51.7dB; and location #3 (farthest) was 53.6dB. Noise level at location #1 was exceeded by 9.4dB; location #2 was exceeded by 6.7dB; and location #3 was exceeded by 8.6dB. The test concluded that all locations failed compliance and the facility is in violation. Based on the provided information the facility meets the Town's noise codes Sundays, Mondays, Tuesdays, Wednesdays and Thursdays between 7:00 AM and 7:00 PM; Fridays and Saturdays between 7:00 AM and 11:00 PM; but fails to meet the Town's noise standards in all other hours, more specifically Mondays, Tuesdays, Wednesdays, and Thursdays from 7:OOPM until 7:OOAM the following morning and Friday evenings from 11:OOPM until Saturday mornings at 7:OOAM and Saturday evenings at 11:OOPM until Sunday mornings. The Applicant should explore other methods to accomplish the Town Code and general references the Town's noise requirements on a consistent level in the Town's Section 180-6 of general noise levels. The controlling factor will be Section 280-70J(5) which is consistent at 45 dB. Please note the two measurement standards are not consistent. Loudness and Sound Intensity (Power) The relative loudness that we perceive is a subjective psychological phenomenon,not something that can be objectively measured.Most of us perceive one sound to be twice as loud as another one when they are about 10 dB apart;for instance,a 60-dB air conditioner will sound twice as loud as a 50-dB refrigerator.Yet that 10-dB difference represents a tenfold increase in intensity.A 70-dB dishwasher will sound about four times as loud as the 50-dB refrigerator,but in terms of acoustic intensity,the sound it makes is 100 times as powerful. The sound levels in the three different locations are somewhat confusing until recognizing that location 3 is in line with the output of the generator e�aust pipe, location 1 is on the opposite side of the e�aust pipe and location 2 is physically closer but not in alignment with the eachaust pipe. Based on measured sound levels taken at the facility's property limits the Town's compliance are exceeded by as much as 10.9 dBA in ambient noise which apparently is from traffic and wind alone. The average ambient noise level at the facility's property lines are 54.13 dBA. With the Applicant's generator and all air conditioners operating simultaneously the average noise level at the site is 56.87 dBA ar an average increase of 2.74 dBA. Based on standard and general references the Town's noise requirements on a wireless facility will be difficult if not impossible to maintain when general traffic and wind noise exceeds the operating noise level of the wireless facility; furthermore the ambient noise level in locations with average traffic patterns will be difficult to achieve on a consistent level in the Town's Section 180-6 of general noise levels. Regardless of the measurements, calculations and comparisons the Town requires the noise level of wireless facilities a minimal of 5 dBA or a maximum of 20 dBA lower than other operations, facilities and institutions. Without the generators the noise level exceeds the allowable noise levels in the Town's codes. What is a solution? CityScape initially suggests the separate standards for wireless facilities should be brought into agreement with the Town's general noise level standards for two reasons: (1) A maximum noise level of 45 dBA cannot be maintained consistently 24 hours a day 7 days a week in many areas of the jurisdiction because the ambient noise levels can currently exceed the permitted limits. (2) The wireless facility noise level limits are not consistent with general noise level limits for other services in the Town of Southold. (3) The language in Section 180-6 requires there be a complaining properiy owner. Regarding the subject application,the Town could require additional silencers be installed on the existing generators, but such a requirement would not gain greater noise reduction below the surrounding ambient noise levels will exceed the noise of the generators. CityScape can only address the technical facts and the specifics within the ordinance; in this situation it is likely there is no solution. Historically CityScape has recommended the noise limit for generators not exceed 65 dBA at the property limits and that any testing shall be limited to only between the hours of 9AM until 4PM Monday through Friday. Regardless of the MetroPCS addition having been completed or not has no impact of the permitting of the proposed AT&T changes because both of the structural analyses include the composite of all changes.
